Hearing Certification Docket No. 2025-92 Board of County Commissioners Weld County, Colorado Zoning Permit, ZPTT25-0002, for a Telecommunication Tower, 70-foot in height in the A (Agricultural) Zone District— Gregory and Sheri Lyn Farmer A public hearing was conducted on December 17, 2025, at 10:00 a.m., with the following present: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jess Reid Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Molly Wright The following business was transacted: I hereby certify that pursuant to a Notice dated December 4, 2025, and duly published December 6, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of Gregory and Sheri Lyn Farmer, for a Zoning Permit, ZPTT25-0002, for a Telecommunication Tower, 70-foot in height in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Molly Wright, Department of Planning Services, presented a brief summary of the proposal for a monopole telecommunication tower to improve wireless coverage and capacity. She stated access is on County Road (CR) 15, this will be an unmanned facility, and relayed the site is within the three (3)-mile referral area of the Towns of Frederick and Firestone and displayed images of the site and surrounding views. She indicated notice was sent to 16 surrounding property owners (SPOs) and seven (7) letters of objection were received, which surpassed the 30% objection threshold, therefore, staff recommended denial. Garrett Kendall, Kappa Consulting, represented the applicant, and in response to Chair Buck, indicated he had not had contact with any of the Commissioners regarding this case. Mr. Kendall indicated there is not great service in the area of the proposed tower, and Verizon, the anchor tenant, stated they would have co-located on an existing tower, if there was one. He stated the tower will be set back as far as possible on the parcel, and at the request of Kerr-McGee (oil and gas), due to an abandoned oil and gas cc;PL(DE/MN/DA/Mw/KR) 2025-3360 01/2.g/2.6 PL2989 Hearing Certification (ZPTT25-0002) — Gregory and Sheri Lyn Farmer Page 2 well. He described the SPOs' objections as subjective, indicated the Federal Communications Commission (FCC) is responsible for mitigating any health concerns associated with the tower, asserted the current lack of service is actually a detriment to property values, and displayed a current service coverage plot. In response to Commissioner Maxey, Ms. Wright stated the Oil and Gas Energy Department (OGED) recommended the 150-foot setback, due to safety concerns with plugged and abandoned wells, even though Weld County Code only requires a 75-foot setback. No public testimony was offered concerning this matter. Ms. Wright confirmed for Commissioner James that the reason Planning staff recommended denial was due to more than 30% of SPOs having objections. Commissioner Ross indicated the application meets Code Section 23-4-890 and reiterated the proposed setback is double what is required. There was discussion about a specific concern from an SPO and Commissioner James reiterated the FCC regulates such concerns. Commissioner Maxey moved to approve the request of Gregory and Sheri Lyn Farmer for a Zoning Permit, ZPTT25-0002, for a Telecommunication Tower, 70-foot in height in the A (Agricultural) Zone District, based on the recommendations of Planning staff, with the Development Standards, as presented. The motion was seconded by Commissioner Ross, and it carried unanimously.
