RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION NO. 289 - H. A. SCHNEIDER JR.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 21st day of November, 1977 , in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of H. A. Schneider, Jr. , located
in the NW4 of Section 11, Township 6 North, Range 66 West of the
6th P.M. , Weld County, Colorado, and more particularly described
as follows, to-wit:
A tract of land being the Northwest Quarter of Section 11,
Township 6 North, Range 66 West of the 6th Principal Mer-
idian, Weld County, Colorado. Said tract of land contains
160 acres, more or less.
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not with-
in the purposes of the Weld County Subdivision Regulations and
the Board desires to exempt this particular division of land from
the definition of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-lA(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by H. A. Schneider, Jr. be exempt
from the definition of the terms, "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) .

RE: Recorded Exemption #289
Dear Commissioners :
The attached application, plat , and related materials are in reference
to a request by H. A. Schneider for a recorded exemption. The parcel
of land is described as the Nfl of Section 11, TGN, R66W of the 6th
p.m. , Weld County, Colorado. Said property is located 2 miles west
and 1 1/3 miles south of Eaton. The subject property contains
approximately 160 acres of Class II , III, and IV irrigated soils. The
request is to split the property into parcels of 159 acres and 1 acre.
Both of the two resulting parcels would contain an existing set of
improvements. A letter submitted from H. A. Schneider, Jr. indicates
that he and his father own the 160 acre parcel in question. Mr.
H. A. Schneider desires to split the one acre parcel from the remainder
of the 160 acres for his own home site. As indicated in that letter ,
both Mr. Schneider and his father farm the property in question.
Based upon the information submitted and the adopted policies in the
county, the Department of Planning Services staff recommends the request
be approved for the following reasons :
1. The Town of Eaton Planning Commission has indicated they have no
objections to approval of the request.
2. The proposed split conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural District (Section
3. 3A of the Weld County Zoning Resolution) , and the Weld County
Comprehensive Plan in that each resulting parcel would have an
existing set of improvements and the use would be compatible with
the surrounding agricultural uses ,

3. The request complies with the provisions of Section 9-4(a)
of the Weld County Subdivision Regulations.

Dear Sir:
On October 21 , 1977, a visual inspection of the individual sewage
disposal system owned by Mr. Sonny Schneider, located at 34520
Weld County Road 33, in Section 11 , Township 6 North, Range 66 West,
Weld County Colorado. At the time of the inspection, there was
no visible evidence that the system was malfunctioning.
A copy of the septic permit for a new house north of the present
building is also included. The perc test has been conducted showing
that a system can be installed at the site.
