This proposal has been reviewed on behalf of Weld County Department of Planning Services and the
Department of Public Works. Staff comments made during this phase of the application process may not be
all-inclusive,as other issues may arise during the remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: Zoning Permit for a 70-ft Telecommunication Antenna Tower.
This project is east of and adjacent to County Road (CR) 15 and south of CR 24 (Firestone BLVD).
Parcel: 131108000020.
Access: CR 15 is Under the Jurisdiction of the Town of Firestone.
ACCESS
Development Review has reviewed the application materials related to access and determined the
following:
The parcel has one existing access point onto CR 15 located approximately 980 feet south of CR 24
(Firestone BLVD). This portion of CR 15 is under the Jurisdiction of the Town of Firestone. Contact the
Town of Firestone to verify the access permit or for any additional requirements that may be needed to
obtain or upgrade the permit.
ROADS AND RIGHTS-OF-WAY
This portion of CR 15 is under the jurisdiction of the Town of Firestone. The municipality has jurisdiction
over access to the road. The applicant shall delineate on the sketch plan the future and existing right-of-
way and the physical location of the road. Be aware that physical roadways may not be centered in the
right-of-way. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90, the required
setback is measured from the future right-of-way line. Contact the Town of Firestone to verify right-of-way
and setback requirements.
REQUIRED CONDITIONS
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The applicant shall provide documentation from the Town of Firestone showing approval of the
access onto CR 15. (Development Review)
3. Access shall be maintained to mitigate any impacts to the public road including damages and/or
offsite tracking. (Development Review)
4. The historical flow patterns and runoff amounts on the site will be maintained. (Development Review)

The Staff of the Weld County Oil and Gas Energy Department (OGED) appreciates the opportunity to
comment on the captioned planning case. Staff has completed review of the proposal and have included
additional comments below:
1. There are no active 1041 WOGLA Permit on the associated parcels. There are several oil and
gas well sites on and in the area surrounding the parcel.
2. The parcel(s) includes no active oil and gas wells.
3. The parcel includes one (1) plugged and abandoned (PA) well listed in Table 1 below. OGED
appreciates the applicant relocating the tower away from this well,which improves the safety
of both the Weld County public and the project proponents.

4. The subject lands may include additional oil and gas related infrastructure, such as off-
location flowlines or pipelines which are a use by right and not regulated by Weld County.

and utilize Colorado 811 prior to any excavation activities.
These comments and recommendations are based upon the review of the application materials submitted
by the applicant and other relevant information available on the E-Permit site.

3. The parcel includes one (1) plugged and abandoned (PA) well listed in Table 1 below. Based
on the applicant's submitted materials, a fence is planned directly over the PA well, and the
tower itself appears to be within 50 feet of the well. While not in violation of County Code,
this design raises safety concerns and puts the applicant at risk of removing the tower if the
well needs to be re-entered. OGED recommends that the Applicant review this information
and contact the responsible operator regarding well infrastructure that may have been
abandoned in place prior to conducting operations in proximity to the wells.

5. Condition to Locate Subsurface Utilities. Mr.Cavanagh,the Director of the Oil and Gas Energy
Department indicates that, for safety concerns, all subsurface utilities, including but not
limited to, all oil and gas pipelines,flowlines etc. should be located.The Condition asks for an
ALTA survey map to be provided to Weld County prior to construction, for review and
approval before construction proceeds.

Mountain View Fire has no issue with the tower installation. If there are batteries to be installed and or a fuel operated
generator, please apply for permit with MVFD for those specific uses. Please post an emergency contact sign with
name and number at access point to the tower.
