A public hearing was conducted on December 10, 2025, at 9:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a Notice dated November 25, 2025, and duly published
November 29, 2025, in the Greeley Tribune, a public Show Cause hearing was conducted
to determine whether good cause exists for the revocation of Use by Special Review
Permit, USR15-0042, for Mineral Resource Development Facilities, Oil and Gas Support
and Service (office/shop and storage of vehicles and equipment) in the A (Agricultural)
Zone District, held by Peitz Land Investments, LLC. Karin McDougal, Deputy County
Attorney, made this a matter of record.
Diana Aungst, Department of Planning Services, stated, since the Probable Cause
hearing on November 19, 2025, a pre-application meeting took place on November 25,
2025, at which time it was determined the property owner is not leasing any part of the
subject parcel out. She relayed the permittee will submit a survey to confirm the outdoor
storage boundaries, provide details for, and photos of, the water quality pond, as well as
an inventory list of all of the equipment being stored onsite. She stated, although staff had
not done a recent site visit, the permittee submitted photos showing he is working to
correct the violation. Ms. Aungst displayed said photos, which showed the storage items
had been cleaned up, and the trucks had been consolidated into the defined parking area.

In response to Commissioner Maxey, Ms. Aungst clarified that staff had not been out to
the site to verify it is in compliance.
Eric Wernsman, Wernsman Engineering and Land Development, LLC, represented the
permittee, and confirmed they had consolidated the oil and gas equipment into the
allowed boundary and referenced the receipts presented at the Probable Cause hearing
for the mowing and spraying of the site. He confirmed they will get the site surveyed and
verify the water quality pond is there, and of the correct volume.
Responding to Commissioner James, Brian Kreisinger, employee of Peitz Land
Development, LLC, stated additional storage panels need to be moved and anticipated
that process would take approximately four (4) to six (6) weeks.
No public testimony was offered concerning this matter.
In the matter of Show Cause hearing, PCSC25-0012, Commissioner James moved to
continue the matter to February 4, 2026, at 10:00 a.m., to allow the permittee additional
time come into compliance. The motion was seconded by Commissioner Ross and it
carried unanimously. There being no further discussion, the hearing was completed at

The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Hearing Certification, on motion duly made and seconded, by the following
