Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jess Reid Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Molly Wright The following business was transacted: A public Probable Cause hearing, PCSC25-0014, was conducted to consider setting a Show Cause Hearing to determine whether or not the permittees, Santos Vega and Luz Yadira Vega, are in compliance with certain Permit Conditions contained in Zoning Permit for Home Occupation Class II, ZPHB16-0015. Karin McDougal, Deputy County Attorney, made this a matter of record. Molly Wright, Department of Planning Services, stated a home office is allowed with this permit, and it was never intended to be used for parking or the storage of vehicles and materials. She provided the general location of the site and reviewed the timeline of events leading to the Probable Cause hearing, including complaints from surrounding property owners and the Greeley Fire Department, for illegal burning without a Burn Permit. She stated the Vegas submitted a Resubdivision application on November 3, 2025, and relayed staff had not had any communication with them since the Probable Cause notification letter was mailed on November 12, 2025. Ms. Wright displayed aerial images of the site, provided the dates of staffs site visits, and described the condition of the site, which is not in compliance with Permit Conditions A.8, A.9, and A.13. Yadira Vega, daughter of the permittees, represented them and stated the grey semi, seen in the December pictures, is no longer there, relayed there is a dumpster onsite for cleanup, and the permittees are working to come into compliance. In the matter of Probable Cause hearing, PCSC25-0014, Commissioner Ross moved to find there is adequate evidence to set a Show Cause hearing, for January 7, 2026, at 10:00 a.m., for Zoning Permit for Home Occupation Class II, ZPHB16-0015, held by Santos Vega and Luz Yadira Vega, based on the evidence presented by Planning staff. The motion was seconded by Commissioner James, and it carried unanimously. Ms. Wright stated that Permit Condition A.13 was not in the Draft Resolution and asked that said Condition be added. Both Commissioners Ross and James amended their motions to include Permit Condition A.13, as well as A.8 and A.9, which were in the Draft Resolution.
