RE: RESCINDING THE RESOLUTION OF OCTOBER 13, 1976, WHICH
RESOLUTION APPROVED A PREMIUM DEPOSIT FUND AGREEMENT
BETWEEN WELD COUNTY AND PACIFIC MUTUAL LIFE INSURANCE
COMPANY.
WHEREAS, the Board of County Commissioners of Weld
County, Colorado, on the 13th day of October, 1976, at a
regular meeting of said Board, did approve a Premium Deposit
Fund Agreement between Weld County and Pacific Mutual Life
Insurance Company, which Resolution approved an agreement
for premium deposit funds to be held by Pacific Mutual Life
Insurance Company on behalf of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld
County, Colorado, has been advised by legal counsel that
Section 24-75-201, CRS 1973, and Section 24-75-601, CRS 1973
would prohibit Weld County from entering into such an agreement
as contemplated by the aforementioned Resolution of October 13,
1976, and
WHEREAS, the Board of County Commissioners of Weld
County, Colorado, therefore, believe it to be in the best
interests of the County to rescind the Resolution of October 13,
1976, setting up a Premium Deposit Fund Agreement between Weld
County and Pacific Mutual Life Insurance Company.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Resolution of
October 13, 1976 approving a Premium Deposit Fund Agreement
between Weld County and Pacific Mutual Life Insurance Company
in connection with Group Policy No. 8864, be and the same is
hereby rescinded.
The above and foregoing Resolution was , on motion duly
made and seconded, adopted by the following vote on the 1st
day of November, A.D. , 1976.
