RESOLUTION / /
WHEREAS, by Resolution adopted February la , 1974, by the
Board of County Commissioners, Weld County, Colorado, the area
described as follows:
The North a of Section 8, Township 1 North, Range 68 West
of the sixth Principal Meridian. Containing in all 336. 25
acres, more or less, and subject to all easements, roads,
and rights of way existing or of record,
,, was changed from "A" Agricultural District to "E" Estates District,
planned Unit Development, with certain conditions, and
WHEREAS, it now has come to the attention of the Board that said
conditions have not been complied with, including the condition imposed
that made it manditory for the petitioner to proceed with due diligence
to begin development of the area rezoned within a period of twelve (12)
months; otherwise, the County would take action to rezone the property
to its former classification, and
WHEREAS, petitioner has requested that the present zoning be
extended for a period of six (6) months from January 30, 1975 to July 30,
1975, due to problems peculiar to the premises, and
WHEREAS, the Board has reviewed the facts and circumstances
surrounding the delay in the matter, and
WHEREAS, the Board being fully advised in the premises;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the request of the petitioner
of the hereinabove zoned land, be, and it hereby is granted.
BE IT FURTHER RESOLVED, that the present zoning of "E" Estates
District, Planned Unit Development, be extended to July 30, 1975, on con-
dition that the owner or owners of the land proceed with due diligence to
effect development of the area so rezoned; otherwise, the Board may, for
good cause shown, on its own motion, revert the area to its original zoning.

Re : Application for Rezoning
Parkland Estates
Gentlemen:
Representatives of Parkland Estates have requested that you
be advised as to progress of negotiations between themselves
and Erie Water and Sanitation District concerning sanitation
service to the proposed subdivision by the District.
Please be advised that representatives of Parkland Estates
and the Board of Directors of the District have had several
meetings within the past 60 days. No final decision has
yet been reached.
A part of the problem has been that the District is presently
involved in its own long range planning for expansion of its
existing system. Application has been made by this District
to EPA and the State of Colorado for financial assistance.
Tentative approval of grants have been given which are con-
tingent upon reports concerning engineering, environmental
impact, and economic feasibility before final approval is
given by these agencies. These studies and reports are now
in progress.
Until these studies and reports are more nearly completed,
it is extremely difficult for the District to make any final
decision as to the service which it can provide Parkland
Estates or upon what terms.
It is hoped that substantial progress will be made by the
District in its planning within the next 60 days so that

Dear Mrs. McKim,
We received your letter dated February 27th regarding Park
Land Estates. We hope the following replies will answer
your requests sufficiently.
(1) A copy of the minutes of the hearing December 10, 1973:
minutes of these hearings are not usually transcribed from the
tapes of the meetings; however, the tapes are available to
anyone who would like to listen to them and may be obtained in
the Clerk to the Board's office.
(2) A copy of the minutes of the hearing when Park Land was
approved: Park Land was not approved at the hearing but taken
under advisement and approved at a regular Board meeting of the
Commissioners on February 13, 1974. A copy of those minutes is
enclosed as is a copy of the resolution approving Park Land Estates.
Please note the conditions of the approval:
(a) that any water and sanitation facilities to be installed
shall be approved by the State Health Department
(b) all applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the
zoning resolutions of Weld County, Colorado
(c) subject to complying with the recommendations of the Town of
Erie, Colorado, regarding adequate sewer and water service for
area rezoned
(d) that said change of zone herein granted is conditional only for
a period of twelve (12) months from date hereof, on condition that
developer proceed with due diligence to begin development of the
area rezoned and submit plans for such development for the approval
of the Weld County Planning Commission and subsequent recording of
said plans in the office of the County Clerk and Recorder of Weld
County, Colorado; and that major construction shall commence thereon
within said twelve (12) month period; otherwise, the County may take
action to rezone the property to its present classification

(3) How each of the Commissioners voted, by name: Harry Ashley, absent;
Glenn Billings, yes; Roy Moser, yes.
(4) A copy of the petition signed by 26 persons living adjacent to the
airstrip who were in favor of this proposal: in our file there is no
petition signed by 26 persons favoring the airstrip but there is a petition
signed by 24 persons engaged in cattle production stating that the airplane
traffic would not be detrimental to their business. Also in the Park Land
file are several letters from citizens living near an airport similar to the
proposed Park Land Estates and officials from counties containing similar
airports and they state the airports have not proved hazardous, nuisances or
sources of complaints. You are welcome to look at the file if this answer
does not meet with your satisfaction.
(5) Does Park Land have a definite deadline when they must comply with
the stipulations requested by the town of Erie? If so, how long?
The fourth condition in the resolution of approval deals with the deadline
(12 months) and the third condition deals with stipulations of the town of
Erie.
Numerous meetings were held prior to the Commissioners' approval of Park
Land Estates. Before the Planning Commission made its recommendations to
the Board field checks were made and a joint meeting with the Erie Town
Council and Planning Commission was held, at which time an update of Erie's
recommendations was requested. On the basis of these meetings and
information the Planning Commission recommended unfavorably regarding Park
Land Estates due to the main objection that Park Land would not be using
Erie's water and sewer systems. (This was also the basic problem listed
by Erie concerning Park Land.)
The matter was next before the Commissioners who held a hearing on December
10th, which you attended; the issue was taken under advisement and during
that time the Commissioners viewed the area and asked Erie for another letter
outlining water and sewer requirements for developments within its future
growth area. Based on this letter and the improvements Park Land Estates had
made in their plans the Commissioners granted approval with conditions which
took into consideration Erie's main objections to Park Land, including water
and sewer matters and restrictions regarding aircraft traffic patterns.
We hope that this letter and the papers enclosed will be of help to you.
