copy of this notice is required by Colorado Air Quality Control Commission regulations. The
notice must be available for public inspection for a period of thirty (30) days from the

NOTICE is hereby given that an application to renew an Operating Permit has been submitted to
the Colorado Air Pollution Control Division, 4300 Cherry Creek Drive South, Denver, Colorado
80246-1530, for the following source of air pollution:

Facility: Denver Regional Landfill (South) Inc.
Denver Regional Landfill (South) Inc. has applied to renew the Operating Permit for the Denver
Regional Landfill (South) Inc. in Weld County, CO. Denver Regional Landfill South (DRLS) is
classified as a municipal solid waste landfill, which falls under the Standard Industrial Classification
4953. Decomposing waste encapsulated within the landfill produces a gas that is primarily
composed of methane and carbon dioxide. Emissions of non-methane organic compounds (NMOC),
which include, Volatile Organic Compounds (VOC) and Hazardous Air Pollutants (HAP), also result
from the decomposition of solid waste placed in the landfill. A gas collection and control system is
in place at this facility. Collected landfill gas is sent to a 1,200 cfm open flare or a gas-to-energy
plant separately owned by Timberline Energy. Combustion emissions from the flare include Oxides
of Nitrogen (NOx), Sulfur Dioxide (SO2), Particulate Matter (PM) and Carbon Monoxide (CO). Denver
Regional Landfill South (DRLS) historically has been considered a single source with Front Range
Landfill (FRL), Denver Regional Landfill North (DRLN), and Timberline Energy but, due to recent
EPA determinations, DRLS requested to be separated from DRLN and Timberline Energy. DRLS and

FRL will continue to be considered a single source. The Division has reviewed the requirements to
separate and has determined that DRLS and FRL are a separate source from DRLN and Timberline
Energy. Design capacity increased to 14,697,819 Megagrams on July 21, 2020. The existing 3,000
scfm enclosed flare has been replaced with a 1,200 scfm open flare. The landfill has stopped
accepting additional waste and requested removal of the fugitive dust limits along with the waste
acceptance limit. The fugitive dust limits were removed because waste is no longer accepted at
the facility. The reduction in flare capacity also reduced all flare emissions. Emission calculations
and limits were updated to reflect the changes to AP-42 chapter 2.4 (8/2024 version) and LandGEM
version 3.1. A copy of the application, including supplemental information, the Division's analysis,
and a draft of the Renewal Operating Permit 03OPWE254 are available on the Division's website.
The Division has made a preliminary determination of approval of the application. Based on the
information submitted by the applicant, the Division has prepared the draft renewal operating
permit for approval. Any interested person may contact the Division at
cdphe_apcd_title_v@state.co.us to obtain additional information. Any interested person may
submit written comments to the Division concerning 1) the sufficiency of the preliminary analysis,
2) whether the permit application should be approved or denied, 3) the ability of the proposed
activity to comply with applicable requirements, 4) the air quality impacts of, alternatives to, and
control technology required on the source or modification, and 5) any other appropriate air quality
considerations. Any interested person may submit a written request to the Division for a public
comment hearing before the Colorado Air Quality Control Commission (Commission) to receive
comments regarding the concerns listed above as well as the sufficiency of the preliminary analysis
and whether the Division should approve or deny the permit application. If requested, the hearing
will be held before the Commission within 60 days of its receipt of the request for a hearing unless
a longer time period is agreed upon by the Division and the applicant. The hearing request must: 1)
identify the individual or group requesting the hearing, 2) state his or her address and phone
number, and 3) state the reason(s) for the request, the manner in which the person is affected by
the proceedings, and an explanation of why the person's interests are not already adequately
represented. The Division will receive and consider the written public comments and requests for
any hearing for thirty calendar days after the date of this Notice.
