RE: RECORDED EXEMPTION NO. 266 - K & R LIVESTOCK COMMISSION
COMPANY, INC.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County
Home Rule Charter, is vested with the authority of administering
the affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 29th day of June, 1977, in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of K & R Livestock Commission
Company, Inc. , located in the SEa of Section 34 , T1N, R68W of
the 6th P.M. , Weld County, Colorado, more particularly described
as follows :
The Southeast one quarter of Section 34, Township 1 North, Range 68
West of the Sixth Principal Meridian, County of Weld, State of
Colorado.

Right of way for Colorado State Highway No. 7 as filed in Book

above described property is dividing the sane as shown on the attached

does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-
28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado desires to exempt this particular division of land from
the definition of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by K & R Livestock Commission
Company, Inc. , be exempt from the definition of the terms ,
"subdivision" and "subdivided land" pursuant to its authority

The above and foregoing Resolution was, on motion duly made

RE : Recorded Exemption #266
Dear Commissioners :
The attached application, plat , and related items are in
reference to a request by K & R Livestock Commission
Company, Inc. for a recorded exemption . The parcel of
land in question is described as the SE4 of Section 34 ,
T1N, R68W of the 6th p .m. , Weld County, Colorado. Said
property is located at the NW corner of the junction of
interstate Highway 25 and Colorado State Highway 7. The
subject property contains 160 acres of Class II , III , and
IV irrigated soils . The request is to split the property
into parcels of 10. 005 acres and 149. 095 acres . The re-
quest is to sever the 10. 005 acre parcel which contains
the existing auction barn and associated facilities from
the remainder of the property in question. As shown on
the recorded exemption plat , the 10. 005 acre parcel is
severed from the remainder of the property by the Bull
Canal . Additionally, a residence currently exists on the
northeast corner of the proposed Parcel A.
Based upon the information submitted and the adopted poli-
cies in the county, the Planning Commission staff recom-
mends the request be approved for the following reasons :
1 . The proposed split conforms with the intent clause of
the recorded exemption procedure (Section 9. 2 of the
Weld County Subdivision Regulations) , the intent clause
of the Agricultural District (Section 3 . 3(A) of the
Weld County Zoning Resolution) , and the Weld County
Comprehensive Plan since each resulting parcel contains

existing improvements and the use would be compatible
with surrounding agricultural uses .
2. The request complies with the provisions of Section
9. 4(A) of the Weld County Subdivision Regulations .

approval of the Weld County Planning Commission.
This property was not sold on that specific day
but was sold at a later date to Mr. Bob Calvert
and Mr. Al Porreco of Denver, subject to the
approval of Weld County.
Due to the age and health of the present owners
it is imperative for them to divest themselves of

If the seller fails to deliver possession on the date herein specified, the seller shall be subject to eviction and shall be

more than ten per cent of the total purchase price,the seller shall be obligated to repair the same before the date herein
provided for delivery of deed. In the event such damage cannot be repaired within said time or if such damage shall
exceed such sum, this contract may be cancelled at option of purchaser. Should the purchaser elect to carry out this
agreement despite such damage, such purchaser shall be entitled to all the credit for the insurance proceeds resulting
from such damage, not exceeding, however, the total purchase price. Should any fixtures or services fail between the
date of this agreement and the date of possession or the date of delivery of deed, whichever shall be earlier, then the
seller shall be responsible for the repair or replacement of such fixtures or services with a unit of similar size, age and
quality,or an equivalent credit.
9. Time is of the essence hereof,and if any payment or any other condition hereof is not made,tendered or performed
as herein provided, there shall be the following remedies. In the event a payment or any other condition hereof is not
made,tendered or performed by the purchaser,then this contract shall be null and void and of no effect,and both parties
hereto released from all obligations hereunder,and all payments made hereon shall be retained on behalf of the seller as
liquidated damages. In the event that the seller fails to perform any condition hereof as provided herein, then the
purchaser may,at his election,treat the contract as terminated,and all payments made hereunder shall be returned to
the purchaser; provided, however,that the purchaser may,at his election,treat this contract as being in full force and
effect with the right to an action for specific performance and damages.
10. In the event the seller fails to approve this instrument in writing on or before June 1
1947,or if title is not merchantable and written notice of defects is given to the seller or agent within the time herein
provided for delivery of deed and shall not be rendered merchantable within 60 days after such written notice,then this
contract,at purchaser's option,shall be void and of no effect and each party hereto shall be released from all obligations
hereunder and the payments made hereunder shall be returned forthwith to purchaser upon return of the abstract, if
any, to seller; provided, however, that in lieu of correcting such defects, seller may, within said 60 days, obtain a
commitment for Owner's Title Insurance Policy in the amount of the purchase price showing the title to be free from
such defects and seller shall pay full premium for such Title Insurance Policy.
11. Additional Provisions:This contract is expressly conditioned upon the purchasers
obtaining all mineral rights in and under said real estate but not limited to oil,
gas, sand and gravel. At the present time there is only one outstanding lease or
permit on said property, which is an oil and gas lease. In the event of production
it is understood the lease will be unitized end purchasers are to receive 1/4 of the
sellers interest of all oil and or gas produced anywhere on the SE-1/4 of SE-1/4,

RE: Request by K and R Livestock Commission, Inc. for a Recorded
Exemption on the SE*, Section 34, T1N, R68W of the 6th p.m. ,
Weld County, Colorado
Dear Mr. Radcliffe:
The application and related materials for the above described request
are complete and in order with the following exceptions :
1. Submission of an additional $2. 00 for the recording fee since
there are two pages in the recorded exemption plat (payable to
the Weld County Clerk and Recorder) ,
2. Submission of the original mylar recorded exemption plat which
must be signed by the property owners of record,
3. Submission of a letter of explanation detailing the reasons for
requesting the split .
I have tentatively scheduled a hearing by the Board of County
Commissioners for June 29, 1977, at approximately 9: 30 a.m. Said
meeting will take place in the County Commissioners ' Hearing Room,
first floor, Weld County Centennial Center, 915 10th Street , Greeley,
Colorado. It is recommended that you and/or a representative be
there to answer any questions the Board might have with respect to
your request .
