RE: ACTION OF THE BOARD CONCERNING ZCV #0900204 AGAINST RODNEY AND
KAREN STEELY FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Rodney and Karen Steely, ZCV #0900204, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of October, 2010, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, at the request of Planning staff, the Board deems it advisable to refer the
matter back to the Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV#0900204 be, and hereby is, referred back to the Department
of Planning Services.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of October, A.D., 2010.

permitted to use the special review permit process to develop.
COMMERCIAL VEHICLE: Any vehicle, other than an automobile, used or previously used to
facilitate an activity where goods, products or services are bought, sold or transferred in
ownership on a fee, contract or barter basis, excluding those uses listed by right and
accessory uses in the A (Agricultural) Zone District. A COMMERCIAL VEHICLE shall
include, but is not limited to, semi-tractors and trailers, dump trucks, construction
equipment and tow trucks. A COMMERCIAL VEHICLE shall not be allowed to deteriorate to
the condition of a DERELICT VEHICLE or be utilized as a storage unit, unless the use is
allowed through the zone district.

REMEDY
As discussed during a Pre-Application meeting on July 31, 2009 a Use by Special Review(USR) permit
shall be completed and submitted to the Department of Planning Services for the commercial operation
or the number of vehicles shall be reduced to not exceed 1 (one) at any given time. Once a USR
application has been deemed complete by Planning Staff, the violation case will go on hold pending

approval/denial of the application request.
I also need to mention that upon research I discovered a deed for a new property (115 E 4th St Rd). This
property is also situated within unincorporated Weld County and while the zoning is 1-3 (Industrial). In
this zone district an administrative process called a Site Plan Review (SPR) is required verses a Use by
Special Review(USR) a public hearing process. Please contact the Department of Planning Services if
your intention is to relocate the commercial vehicle storage to this new property. I will be inspecting the
property as soon as possible to determine current compliance.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office for immediate legal action.

REMAINING ARE OTHER SPARES THAT THEY ARE
TRYING TO SELL. I EXPLAINED TO HER I WOULD FAX
THE PRE-APP MEETING REQUEST TO HAVE HER FILL
OUT AND RETURN. SHE ASKED IF SHE NEEDED TO
STOP OPERATING IMMEDIATELY. I TOLD HER WE
WOULD KNOW MORE AT THE PRE-APP MEETING
BUT AS LONG AS THERE ARE NO IMMEDIATE
HEALTH OR SAFETY CONCERNS AND THEY ARE
GOING TO GO THROUGH THE USR PROCESS WE
ALLOW PEOPLE TO CONTINUE OPERATING. I TOLD
HER THE OTHER OPTION IS TO REDUCE THE
COMMERCIAL VEHICLES TO ONE. A PRE-APP

08/30/2010 Phone Call Karen Steely (339-9105 office or 396-7364 cell) called.
She said she has every intention of submitting the USR
application, she is just confused by the process and has
several questions that she can't seem to get answered.
She also said she needs to see about getting the hearing
date changed. She said she was going to be in Hawaii at
the time of the hearing. I asked her to fax me in a letter
stating that she was going to be out of state and ask for
the hearing to be continued. I told her I would present it to
the Board. I also told her that I would see about getting a
planner to call her back yet today.
08/30/2010 Phone Call Michelle Martin (POC) and I called Karen on speaker
phone. Karen mentioned that every time she comes into
the office, she is told that she is missing something else.
Michelle explained the process to her. She said she had
submitted the completeness review and now she has to
come up with some really hard calculations. Michelle
gave her Heidi Hansen's number and name with Public
Works and told Karen to call her because she was really
helpful and nice. Karen said she would call her. She also
said she may just end up hiring someone to handle this
application, she is very uncomfortable and frustrated with
the process. Michelle gave her the POC hours and days
and said she could either just come into the office or call
and we would be happy to help her.

Rod and I will be out of town on business on September 14, 2010. Can we please
reschedule this for another date?
We are still trying to work on finishing this up. Every time I take in what I am
told will finish up the application, I am given another thing that needs to be done. The
process has been drawn out because of our schedule and the time it takes for your
planning office to get back with us. We have also tried to get a name and number of
someone that knows all the things that are required so that they can help us. We have
been told that you can't give out a name because it would be showing favoritism. If you
can give us a list of several people or companies that could help us, then we could decide
who to use and hopefully this would solve the problem of showing favoritism. Any help
you can give us would be greatly appreciated so that we all can move forward.

the business day before or as soon as possible to the above mentioned Violation Hearing date.

On Friday, July 31, 2009 an informal discussion took place at the Greeley Administrative Offices
Conference Room regarding a proposed USR for truck parking. (The legal description is Lot A
RE-3779; located in Part of the S2 of Section 16, T6N, R65W of the 6th P.M.; Situs Address is
20759 Hwy 392)
Background Information:
The applicants are proposing to store a maximum of 6 trucks on site with parking for up to 15
trucks at any given time. These trucks are used to haul crude oil from tanks in the field to the
refinery, pipelines and rail cars.
The applicant performs minor maintenance on the trucks. The office is located inside the house.
There are 22 employees associated with this business.
Safety meetings are held every quarter at this site.
Health Department
Water is provided by North Weld County Water District. The Septic Permit No. is SP04-00297 is
sized for 10 people. Staff informed the applicants that an engineer will need to evaluate the
septic system for adequacy. The applicants indicated that plumbing is available in the shop to
install a bathroom if needed.
No oil changes are preformed on site. Only minor maintenance of the vehicles such as
changing bulbs, wire repair, etc. are done in the shop. Occassionally vehicles are spot washed
to make the repairs; however trucks are typically washed in truck washes. Staff advised the
applicant that if washing vehicles they will need to capture the oil.
The interior of the site consists of recycled asphalt and gravel.
Public Works
Access to the site is from Highway 392. Staff advised the applicants to visit with Gloria (970-
350-2148) or Tim Bilobran (970-350-2163) of CDOT for any required improvements to the
access.
The site is not located in a FEMA regulated floodplain.
Drainage flows toward Eaton Draw which is located west of the property. The applicants stated
that the perimeter of the property is bermed which prevents any spillage reaching Eaton Draw.
Staff will evaluate if a drainage report will be required. Staff suggested providing blankets to
clean up any spillage that might occur in the shop.
No Traffic Study is required.
No Geotechnical Report is required.

Depending on the location of the truck parking, screening may be required.
Staff encouraged the applicants to visit with the Building Department (970-353-6100 ext. 3540)
for guidance on ADA requirements for restrooms as well as a Change of Use Permit for the
shop. Staff stated that if a Change of Use Permit is required for the shop additional fees such as
Road Impact Fees will be required at issuance of the building permit.
Staff will need to determine if the applicants will be applying under a "Home Business" or"Other"
and will follow-up with written communication.
A completed application will need to be submitted within 60 days to avoid violation hearings and
an additional investigation fee.
Staff urged the applicant to contact staff for any questions:
Planner On Call Monday through Thursday 7:30 am to 4:30 pm.
Staff explained the USR process. The applicant shall submit 4 packets. Staff requested that the
applicant submit the remaining material in electronic form. Upon submittal of a completed
application it will be sent out for referral for 28 days. The applicant will then meet with their
Planner to discuss the referrals and address as many of the referrals as possible. At that
meeting the Planning Commission hearing will be scheduled. The Board of County
Commissioners hearing typically follows approximately 3 weeks after the Planning Commission
hearing.

PRE-APPLICATION REVIEW REQUEST
• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews are required
prior to beginning the application process: however, - this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. The second and fourth Friday of any given month pre-applicant reviews are held in the
Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre-Application
reviews are held Thursday of any given week in the Greeley office. To be on the pre-submittal agenda, the request
and required checklist items must be received one week prior to the review date, and shall include at a minimum, a
description of the property including surrounding lands and land uses, property owners name and contact
information, a brief narrative and a map delineating the property location, in addition to the other items listed.

Weld County Code are as follow:
THE PRESENCE OF 5+ COMMERCIAL VEHICLES WITHOUT A USE BY SPECIAL
REVIEW (USR) PERMIT. THE CODE ONLY ALLOWS FOR ONE COMMERCIAL VEHICLE
ON AN AGRICULTURAL LOT OF LESS THAN 80 ACRES WITHOUT A USR PERMIT.
COMMERCIAL VEHICLE: Any vehicle, other than an automobile, used or previously used
to facilitate an activity where goods, products or services are bought, sold or transferred in
ownership on a fee, contract or barter basis, excluding those uses listed by right and
accessory uses in the A (Agricultural)Zone District. A COMMERCIAL VEHICLE shall
include, but is not limited to, semi-tractors and trailers, dump trucks, construction
equipment and tow trucks. A COMMERCIAL VEHICLE shall not be allowed to deteriorate
to the condition of a DERELICT VEHICLE or be utilized as a storage unit, unless the use is
allowed through the zone district.
