Dear Richard and Tammi Fisher:
This letter is being sent for informational purposes. Please be advised that this office has received a
complaint regarding the use of a dirt track that has been installed on your property. Currently this
does not appear to be a Zoning Violation of Chapter 23 of the Weld County Code; however, this
office wanted to provide some information for your consideration:
• The acceptance of any monetary gain or advertisement of the dirt track would then
make this track a public Recreational Facility, and as such, require a Use by Special
Review(USR) permit. The USR application process involves 2(two)public hearings
of which the outcome is ultimately is determined by the Board of County
Commissioners. Questions should be directed to one of our On-Call Planners @
970-353-6100, extension 3540 (just ask for the On-Call Planner).
• No parking or staging of vehicles is allowed on any County Road (including but not
limited to State Highway 392 and all County Roads). If complaints are received,they
will be directed to the Sheriff's Office for enforcement.
• Appropriate accommodations for restrooms shall be made available at all times. If
complaints are received, they will be directed to the Weld County Department of
Public Health and Environment.

The initial complaint was in regards to high noise levels throughout the day and blowing
dust. The complainants have been directed to contact Phil Brewer, Weld County
Department of Public Health and Environment at 970-304-6415, Extension 2227.

Thank you for asking the questions.
I looked over the files with Don Carroll, and we agree that the applicant must indeed pursue a Flood Hazard
Development Permit because:
Building is in the floodplain, the building will most likely have a bathroom/plumbing facilities that Dept of Health
should review, and because we want to respond back to them that there should not be any contaminated runoff
from the vehicle parking area that could escape the site to the water course. As you and I discussed, I would also
want to request that the applicant not store floatable materials in the floodplain. They should complete the FHDP
application showing location of building, parking relative to 100-year FEMA-defined floodplain (from the FIRM
map). They should specify"agricultural use". They should show building finished floor elevation. Unless Weld
Health Dept. has an objection, I see no reason why they shouldn't receive approval.

condition has been met.
Condition 1D Storage Tank According to the applicant "No tanks shall exceed 500 gallons". A permit from the
Colorado Dept of Labor and Employment is not needed. This condition can be removed it is not relevant.

Fisher Lawn & Landscaping Service, 20 749 Hwy 392, Greeley, is currently on
service with Northern Colorado Disposal, Inc. They have a 3 yard dumpster for
light commercial, office trash and landscaping debris. Northern Colorado Disposal,
Inc. then hauls the trash to the North Weld Landfill, 40000 WCR 25, Windsor.
