RE: DENIAL OF REQUEST TO VACATE ALLEY AND WEST HALF OF 4TH
AVENUE IN GILL, COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, during the October 17, 1977 regularly scheduled
meeting of the Board of County Commissioners, a certain land-
owner in Gill, Colorado, did petition the Board of County Com-
missioners regarding the following two requests:
1. vacation of the West Half of 4th Avenue
between 1st and 2nd Streets in the Town
of Gill, Colorado;
2. vacation of a north/south alley in Block
8 of the Town of Gill, Colorado.
and
WHEREAS, a representative of the Weld County Department of
Engineering Services has, after an on-site investigation of
the above-referenced area, recommended that the Board of County
Commissioners deny both requests for the reasons as set forth
in the letter from the Weld County Department of Engineering
Services, a copy of which is attached hereto and incorporated
herein by reference, and
WHEREAS, after taking into consideration all of the facts
presented, the Board of County Commissioners of Weld County,
Colorado deems it in the best interest of Weld County to deny
both requests.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the requests , as set
forth above, be, and hereby are, denied.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
November, A.D. , 1977.

Vacation of Street and Alley in Gill
Subject:
Road petitions to vacate the West half of 4th Avenue
between 1st and 2nd Streets and the north-south alley
in Block 8 all in the Town of Gill has been reviewed.
After an on site inspection it is my recommendation to deny
both requests . 4th Avenue is currently paved from 3rd Street
to 6th Street and, from all appearances, in the future 4th
Street could become very necessary from State Highway 37
east to 6th Street . In my opinion it would not be practical
to vacate a street for 1/2 of a block. To eliminate the public
from using the West part of 4th Street between 1st and 2nd
Street to enter State Highway 37 barricades and/or proper signs
could be installed or , as an alternative, request the State
Highway Department to install the proper approach and open 4th
Street to thru traffic. As for the north-south alley in Block 8
there appears to be utilities already in this area and to
vacate alleys in a subdivision without utility easements many
problems could occur.
