HomeMy WebLinkAbout20102594.tiff RESOLUTION RE: APPROVE PURCHASE OF SERVICES AGREEMENT FOR THE BUILDING HEALTHY MARRIAGES PROGRAM AND AUTHORIZE CHAIR TO SIGN - UNIVERSITY OF NORTHERN COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Purchase of Services Agreement for the Building Healthy Marriages Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and the University of Northern Colorado, commencing October 1, 2010, and ending September 30, 2011, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement,a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Purchase of Services Agreement for the Building Healthy Marriages Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and the University of Northern Colorado be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Griego, Director, Human Ser �J�epattr nt „ f COLORADO RE: Purchase of Services Agreement between the Weld County Department of Human Services Building Healthy Marriages and the University of Northern Colorado (UNC) Enclosed for Board approval is a Purchase of Services Agreement between the Department's Building Healthy Marriages and the University of Northern Colorado. This Purchase of Services Agreement was presented at the Board's October 25, 2010, Work Session. The University of Northern Colorado will create evaluation progress reports required of the Building Healthy Marriages Program including general outcomes and specific outcomes of intake, enrollment, family support, and marriage education, supportive services for couples. UNC agrees to provide status reports to the Board of County Commissioners, as requested by the Department. These reports will serve as the building blocks for the comprehensive bound evaluation report due at the conclusion of this grant. This includes both quantitative as well as qualitative data analysis. The Department agrees to pay UNC for professional and related services pursuant to this agreement a sum of$73,300.00. The term of this Agreement is October 1, 2010 through September 30, 2011. If you have any questions, give me a call at extension 6510. 2010-2594 • PURCHASE OF SERVICES AGREEMENT THIS AGREEMENT is made and entered into this day of , 010, by and between the Board of County Commissioners of the County of Weld, State of Colorado, sitting on behalf of the Weld County Department of Human Services, hereinafter referred to as "DHS", and the State of Colorado acting by and on behalf of the Board of Trustees of the University of Northern Colorado for the use and benefit of the Office of Sponsored Programs, hereinafter referred to as 'UNC". WITNESSETH: WHEREAS, Building Healthy Marriages, hereinafter referred to as "BHM" supports the DHS' goal to intervene successfully with families in the least intrusive manner while maximizing safety before they enter the judicial system; and upon their entry into the child welfare and juvenile justice systems, to expedite the positive resolution of their treatment or case plans; and WHEREAS, BHM supports the DHS' desire to develop balanced system of care in Weld County under a community based services integration process, emphasizing family strengths through interagency and community collaboration; and WHEREAS, BHM supports the development of balanced systems of care with evidenced- based and promising practices that are outcome based; and WHEREAS, under the Personal Responsibility and Work Opportunity Reconciliation Act, the Temporary Assistance for Needy Families (TANF), which is the Colorado Works Program, BHM supports the DHS' desire to encourage the formation and maintenance of two-parent families; and WHEREAS, DHS, through a competitive bid process for the Weld County Building Healthy Marriage Demonstration Grant, awarded three contracts to form a collaborative partnership; and WEREAS, the collaborative partnership required certain functional responsibilities be developed, further defined, functionally complementary, and successfully transitioned under the Federal Marriage Education Demonstration Grant; and WEREAS, the collaborative partnership tested the overall management and functional design of the Weld County Building Healthy Marriages Demonstration Grant with specific major responsibilities as follows: • UNC with the responsibility of evaluating impact of the program; and • DHS with the responsibility of intake, enrollment, and a family support program; and • United Way of Weld County with the responsibility of a recruitment and marketing campaign, supportive services development; and • Community Mediation Project, Inc., with the responsibility of identifying and Page 1 of 7 &D/o — c 59V developing marriage education providers, education, and related services; and • DHS, United Way of Weld County, and Community Mediation Project, Inc., to assess the overall management and design of the project. WHEREAS, DHS was awarded the Federal Marriage Education Demonstration Grant through a national competitive process under the U.S. Department of Health and Human Services, Administration for Children and Families, Office of Family Assistance for Federal Fiscal Year October 1, 2010 through September 30, 2011; and WHEREAS, DHS with its collaborative partners prepared for the implementation of the Federal Marriage Education Demonstration Grant by: • phasing in proven outcomes and collaborative processes developed under the Weld County Marriage Education Project; and • identifying a local delivery system that promotes a successful project under the Federal Marriage Education Demonstration Grant; and • developing a viable work plan and budget to address the requirements of the Federal Marriage Demonstration Grant; and • identifying a program name of "Building Healthy Marriages Program" that best conveys the values of the Weld County Community and lends to a positive recruitment and marketing campaign; and WHEREAS, UNC has the expertise and knowledge to develop and organize a qualitative and quantitative program evaluation which meets the federal requirements under the Federal Demonstration Marriage Education Grant; and WHEREAS, DHS, as the Weld County grant administration of the Federal Marriage Demonstration Grant, wishes to contract with UNC to be the evaluator of the Building Healthy Marriages Program, as required by Federal Marriage Education Demonstration Grant; and WHEREAS, DHS and UNC agree that an evaluation of the Building Healthy Marriages Program is vital to quantify and qualify the outcomes of the project. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties hereto agree as follows: 1) TERM: The term of this Agreement shall be from October 1, 2010 through September 30, 2011. 2) SERVICES PROVIDE BY UNC: UNC agrees to assist and report directly to DHS in its preparations of evaluation for the Building Healthy Marriages Program for 2010 - 2011, related to a) UNC agrees to evaluate the Building Healthy Marriages Program, under the grant management of DHS, through certain functions of recruitment numbers and project outcomes required under the Federal Marriage Education Demonstration Grant. Page 2 of 7 i) UNC, as the evaluator of the Building Healthy Marriages Program, agrees to govern its research evaluation with the highest standards of scientific research regarding the selection of instruments, data collection, methods, and statistical analyses. b) Actively participating as a Partner of Building Healthy Marriages by reviewing and participating in the ongoing development of the design of the Federal Marriage Education Demonstration Grant Project with DHS, and United Way of Weld County with special emphasis on the marriage education and community saturation component; and i) Actively participate in the planning and implementation of the Federal Marriage Education Demonstration Grant project revisions as identified by the Federal Project Officer (FPO) and/or Technical Assistance (TA) with representatives of Human Services, Community Mediation Project, and United Way of Weld County: and H) Assist in identifying the expectations (target goals) of the BHM Partners and anticipated expectations of other contractors under the Federal Marriage Education Demonstration Grant; and Hi) UNC agrees to continue with DHS to identify outcomes that will be used in evaluating the success and promising practices of the Building Healthy Marriages Program with DHS, by: (a) developing the definition of services to be provided including how these services will be quality-driven, cost-effective, community- and faith-based, and culturally inclusive; and (b) UNC will follow and implement state & local compliance of Federal Guidance to Faith-Based and Community Organizations on Partnering with the Federal Government; and (c) charged with the development of the evaluation of activities; and (d) assisting in the identification of the necessary data to be provided to support the evaluation. c) UNC agrees to provide evaluation progress reports required of the Building Healthy Marriages Program including general outcomes and specific outcomes of intake, enrollment, family support, and marriage education, supportive services for couples. UNC agrees to submit, semi-annual reports regarding the project by April 15, 2011, and August 31, 2011. Additional information to the report may be requested by DHS throughout the year in order to make informed decisions on best practices. UNC agrees to provide status reports to the Board of County Commissioners, as requested by DHS. These reports will serve as the building blocks for the comprehensive bound evaluation report due at the conclusion of this grant. i) UNC will specifically provide: (a) evaluation of outcomes through pre- and post-program evaluation data received from the Marital Satisfaction Inventory ( MSI-R) and the program satisfaction surveys administered at the end of each program for change in marital /couple relationship; impact on family relationship; and (b) increased knowledge in relationship skills, financial competencies, conflict resolution, and communication skills. Page 3 of 7 H) Longitudinal data after the completion of the program including (a) tracking couples for six months to identify which couples were successful and why; and (b) the impact of program in meeting all goals and objectives set out by the demonstration grant allowable activity areas; and (c) the number of participants. Hi) Qualitative Research to be implemented as follows: (a) Each qualitative interview lasting 1 hour will take about 9 hours of further work to accomplish all tasks. 1 hour interview takes approximately 6 hours to listen to and transcribe, 2 hours to review the data, develop into themes and analyze, an hour to conduct a member check and an hour to make revisions, and incorporate into the final report. (b) Participants will be Marriage Educators and Couples who have participated in Marriage Education workshops. Initially we plan to interview 8-10 couples (1/2 English speaking and V2 Spanish speaking) and 5-8 Marriage educators (similar cultural composition). However we may conduct several focus groups with participants if there is sufficient interest and if the results of the personal interviews indicate a need for further data collection. All participants are adults over the age of 18 years and the only vulnerable population that may be represented is pregnant women. All participants will have been thoroughly informed of the right to withdraw from the study at any time and the measures taken to protect confidentiality. (c) Up to 18 individuals will be interviewed and perhaps conduct one of two focus groups d) UNC will assist the Partners in ensuring that public statements, promotion and marketing in print, broadcast, and internet incorporates: i) Building Healthy Marriages is a project of the Weld County Department of Human Services. Partners for the project are DHS as the grantee, Community Mediation Project and United Way of Weld County. Logos and recognition of DHS, UNC, United Way of Weld County and Community Mediation Project. H) Federal grant requirements containing the wording as follows: "Funding for this project was provided by the United States Department of Health and Human Services, Administration for Children and Families, Grant: 90FEO134, Any opinions, findings, and conclusions or recommendations expressed in this material are those of the authors and do not necessarily reflect the views of the United States Department of Health and Human Services, Administration for Children and Families." e) Actively participating in the resolution of problems and issues with DHS during the planning and implementation of the Federal Marriage Education Demonstration Grant Project; Building Healthy Marriages Program as identified by the Partners DHS , Community Mediation Project and United Way of Weld County. Page 4of7 i) Meet a minimum of once a month with the Project Manager in addition to the Partners meetings which will also be held at a minimum of once a month; and ii) Committing 2.75 FTE to the planning, development and delivery of the BHM per the guidelines of the Federal Marriage Education Demonstration Grant; and 3) COMPENSATION: DHS agrees to pay UNC for professional evaluation pursuant to this Agreement a total sum of $73,300, according to the budget as follows: Description ! Total Direct Costs $67,869 Indirect Costs (8%Total Direct Costs) $5,430 Total Costs 73,300:: a) UNC shall submit an itemized quarterly bill according to the above mentioned budget line items to the Program Manager for all costs incurred and services provided pursuant to this Agreement in accordance with criteria established by DHS. UNC shall submit all itemized Page 5of7 quarterly billings to DHS no later than the 15th (fifteenth) day of the month following the quarter the cost was incurred (January, April, July). The final invoice for services must be submitted no later than September 15th, 2011 in order for DHS to meet grant fiscal requirements. b) Payments of costs incurred pursuant to this Agreement are expressly contingent upon the availability of the Federal Marriage Education Demonstration Grant. c) DHS may withhold any payment if UNC has failed to comply with the Financial Management Requirements, Project objectives, contractual terms, or reporting requirements. In the event of a forfeiture of reimbursements, the parties agree to mediate such dispute. If meditation does not resolve the dispute, the dispute will be submitted to the Colorado State Controller whose decision shall be final. d) The parties agree that the service rate as contemplated herein shall constitute the entire amount of compensation due to UNC for any work performed hereunder. 4) ASSURANCES: UNC shall abide by the following Assurances. 5) TERMINATION: Either party may terminate this Agreement at any time by providing the other party with a 30-day written notice thereof. Furthermore, this Agreement may be terminated at any time without notice upon a material breach of the terms of the Agreement. 6) TIME OF THE ESSENCE: Time is of the essence in each and all of the provisions of this Agreement. 7) ENTIRE AGREEMENT/MODIFICATIONS: This Agreement constitutes the entire understanding between the parties with respect to the promises and covenants made therein. No modification of the terms of this Agreement shall be valid unless made in writing and agreed to by both parties. 8) NON-APPROPRIATION: No portion of this Agreement shall be deemed to create an obligation on the part of DHS to expend funds not otherwise appropriated in each succeeding year. 9) WAIVER OF IMMUNITIES/THIRD PARTY LIABILITY: No portion of this Agreement shall be deemed to constitute a waiver of any immunities of DHS or its officers or employees may possess, nor shall any portion of this Agreement be deemed to have created a duty of care with respect to any persons other than DHS and not a party to this Agreement.
