This is a follow-up to your emails inquiries. This is Public Works' status on outstanding issues prior
recording of the plat. The following USRs and SPR are addressed below:

3rd AmUSR-597 — I have asked Duke Energy to update the Long-Term Road Maintenance and
Improvements Agreement with Associated Natural Gas. The site is located on WCR 52 (39`h Street).
This item was covered under Conditions 1M. Attached are the agreement and the original agreement
from Associated Natural Gas. The reason for re-doing the agreement is to stay current with the new
operators.

Kim, I spoke with Virginia this morning for clarification of items that were sent to you. The following are my
comments:
Condition 1A Dust Abatement plan A plan has been submitted, reviewed and is approved by this department.
This condition has been met.
Condition 1B Waste Handling plan A plan has been submitted, reviewed and is approved by this department.
This condition has been met.
Condition 1O Storage Tanks At this time the applicant's will not be utilizing the fuel tanks on their property. If
they decide to use them in the future the applicants have assured me that they will get the appropriate permits
and send copies to this office. This condition is not relevant at this time. This condition has been met.
Condition 1 E Septic System As stated in a prior e-mail the septic system is completed and adequate. This
condition has been met.

Dear Kim and Char
I am sending this to Kim as I don't seem to have the e-mail from Char after we upgraded our AOL. I am
hoping that Kim will forward this to Char.
I apologize for the length of time that has passed. Glen had to have surgery and was complicated by some
surprise heart problems so I have been trying to keep things together with his help and the help of our drivers
during this tense time. All is good now and I want to get this finished up if it is still possible.
I plan to re-submit the mylar plat with the corrections tomorrow, May 10. I am hoping that this e-mail will
address what I remember concerning Char's questions about the points that involve the Health Dept. aspect of
our application.
1. Our Dust Abatement Plan using calcium chloride did not seem to meet appropriate
guidelines. As a result, we have contacted Stark Enterprises in Loveland about
purchasing recycled asphalt to put down in our parking and work areas. This will
be done by Sept 1,2006. If this is not acceptable, we will do whatever is
recommended.
2. The only waste material we have is used oil and we store that in a container that
is part of our oil burning furnace for heat in the shop during the winter. The furnace
is a Reznor furnace, model RA-140 that was professionally installed by the
distributor. At this point, we have no other waste materials as we have all radiator
work done at Del Camino truck stop in Longmont.
3. We have fuel tanks in back of the house but are not operational and at this point
considering the cost of fuel and very few opportunities to get a discount when
purchased in bulk, we will not be making that storage tank operational any time
soon. We did include the permit application to show that when we decide that
it would be beneficial to use this system, we will be getting it permitted
appropriately first.
4. We would like to construct a truck washing stall in the future improvements on
the shop but need to get the appropriate information to permit that before we
build on to the shop, an improvement shown on the revised plat. Until that time,
most of the washing is done at Del Camino in Longmont. We do very minimal
washing at this point. We have had Castle Rock Construction come and grade
our parking area to allow any run-off to drain toward the outside edges of the
property where we have bushes growing. Before we put down any recycled
asphalt, this area will be graded again to maintain drainage to the appropriate
areas.
5. We have purchased a 6 foot privacy fence to enclose the trash dumpster. This
will be done by Sept. 1,2006.
As I said, I have lost Char's e-mail pertaining to these items. I hope I have covered them all. We will be out
of town May 11-15. If you could e-mail me and let me know if these items are acceptable, I would really
appreciate it. I know that you are all really busy, especially with the big changes around here. Thank you for
your patience. I hope to here from you soon.

Re: Conditions of Approval: USR-1519
Dear Applicant:
Your application for a use by special review was administratively approved by the Weld County Board of
County Commissioners with specific Conditions of Approval.
One of the required Conditions of Approval grants applicants sixty(60)days to submit a Mylar Plat. Should
you choose not to complete the use by special review process and provide the required Mylar Plat, the
Department of Planning Services will need to be notified in writing of your decision.
If you do not formally withdraw your application and/or are unable to meet the Conditions of Approval, your
case will be scheduled for a hearing before the Weld County Board of County Commissioners. Planning
Staff will be recommending denial or your request at this hearing. If your application is denied by the Board
of County Commissioners, the decision could affect future land development applications located on this
parcel. Withdrawing applications will not generally affect future applications.
Planning Services Staff is aware of the difficulty and associated delays in meeting the Conditions of
Approval normally associated with land use cases, and is willing to work with you in completing your
request. Please notify the Department of Planning Services, in writing, within 10 working days of your
decision. Planning Services Staff can be contacted at the above address or phone number.

On April 4, 2006, an evaluation of the existing individual septic disposal system at:
22970 County Road 22, Hudson;
Section 14, Township 02 North, Range 65 West,
was conducted by Stephen J.Wiatrowski,an Environmental Health Specialist of this department.
The existing individual septic disposal system is of sufficient size and capacity to adequately handle the
proposed load. This evaluation is based on a final treatment capacity for a 4 bedroom residence and
8 additional workers.
Be advised,neither the County of Weld nor any of its agents or employees undertake or assume any
liability to the owner of the above property, to any purchaser of the above property or to any lending
agency making a loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and
for detecting health hazards observable at the time of inspection. This does not constitute a warranty that
the system is without flaw or that it will continue to function in the future. Inspections requested during
periods of snow cover and high soil saturation may be of questionable value to potential buyers due to
adverse conditions. Evaluations based on Statements of Existing(S.O.E.)relies on information the
property owner provides,under oath, indicating current status of the system and representing to the best
of his/her knowledge the system is not failing to function properly.
