WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that Henry Betz, Route 1, Box 121,
Berthoud, Colorado, is the owner of approximately 76 acres of irrigated
land, and Mr. Betz desires to split off from said parcel of land a portion
more particularly described as follows, to-wit:
That portion of the Southwest Quarter, Section 14, Township
4 North, Range 68 West of the 6th Principal Meridian, County
of Weld, State of Colorado, more particularly described as
follows:
Beginning at the Southwest corner of said Section 14; thence
along the Westerly line of said Section North 30. 00 feet; thence
parallel with the Southerly line of said Section North 89°19'36"
East 50. 00 feet to the TRUE POINT OF BEGINNING; thence
continuing along said line North 89°19'36" East 254. 92 feet;
thence parallel with the Westerly line of said Section North
299. 03 feet; thence parallel with the Southerly line of said
Section South 89°19'36" West 254. 92 feet to the Easterly
Right-of-Way line of Interstate Highway 25; thence along said
Easterly Right-of-Way line, said line lying parallel with the
Westerly line of said Section, South 299. 03 feet more or less
to the TRUE POINT OF BEGINNING.
The above described parcel contains a gross acreage of 1. 75
acres, more or less,
WHEREAS, Mr. Betz is desirous of splitting off 1. 75 acres, more
or less, of this land and keeping the balance intact, and
WHEREAS, it appears that to accomplish this purpose, Mr. Betz
may apply for a recorded exemption from the subdivision regulations of
Weld County, as same is definied in Section 9-4 of the Weld County Sub-
division Regulations, and
WHEREAS, in addition to evidence presented by Mrs. Betz, the
Weld County Planning Commission Staff has presented evidence, made
representations concerning the desirability of granting said variance, and
WHEREAS, the Board of County Commissioners feels that when
all of the evidence and representations are considered, good cause for
granting a variance from the minimum lot size requirements of the Weld
County Zoning Resolution has been shown.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers
granted to the County under Chapter 106 CRS 1963 and Section 9-4 a(6), Weld
County Subdivision Regulations as amended; that Mr. Betz is granted an
exemption from the lot size requirements of the Weld County Zoning Reso-
lution.
BE IT FURTHER RESOLVED, that this Exemption is allowed so that
Mr. Betz may proceed to apply for a Recorded Exemption and the lot size
variance is conditioned on Mr. Betz applying for and doing all necessary to
obtain said Recorded Exemption within one (1) year, and said variance is
limited to Mr. Henry Betz, and will terminate if he sells or otherwise dis-
continues his interest in the above mentioned land prior to obtaining approval
for and recording the above mentioned Recorded Exemption.

The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 19th day of February, A.D. ,
1975.

Dear Sirs:
The enclosed letter and other items are in reference to a request for
a Lot Size Variance, by Henry Betz, so he may apply for a recorded
exemption. The parcel in question contains approximately 76 acres
of irrigated agricultural land. He desires to split a parcel of
1 .75 acres more or less.
Under existing subdivision regulations, Section 9-4A. (6) , the following
is required:
"That the original tract or parcel of land to be divided
under this Section meets the minimum lot size require-
ments established by the Weld County Zoning Resolution;
variance from this requirement being allowed only upon
good cause being shown to the Board of County Commissioners
or where said tract or parcel of land lies within the
comprehensive plan area of an existing incorporated town
of Weld County. (Rev. 4/17/74)11
Based upon information submitted and the Weld County Regulations, the
Planning staff recommends denial for the following reasons.
1 . The applicant has failed to show good cause as required by Section
9-4A(6) of the Weld County Subdivision Regulations.
2. The proposed split is not in conformance with the intent of the
recorded exemption, Section 9-2 of the Weld County Subdivision
Regulations, which is defined as "a means where-by non-productive
agricultural lands may be developed for higher or more productive
uses, in-so-far as such uses are compatible with surrounding

agricultural uses in areas where such land divisions are
proposed. (Rev. 4/17/74)"
3. The soils are Class II and III irrigated agricultural lands.
4. The proposed land division does not conform with the Weld County
Comprehensive Plan (page 48, number 1 ) printed September 1973
in-so-far as it promotes non-agricultural use of agricultural
lands.
