RESOLUTION RE: GRANT PERMIT FOR TEMPORARY ASSEMBLY TO AMERICAN CANCER SOCIETY - SEPTEMBER 18, 2010 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the American Cancer Society, Attn: Nancy Clark, 8221 West 20th Street, Suite A, Greeley, Colorado 80634, has presented to the Board of County Commissioners an application for a Permit for Temporary Assembly on land within the unincorporated portion of the County of Weld, State of Colorado, to be held from 5:00 p.m., on September 18, 2010, until 12:00 a.m., September 19, 2010, on property described as follows: Church Barn, LLC, 34283 County Road 33, Greeley, Colorado 80631; being further described as Lot B of Recorded Exemption#3961; being part of the SE1/4 of Section 10, Township 6 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant has paid Weld County the sum of ONE-HUNDRED DOLLARS ($100.00) for said Weld County Permit for Temporary Assembly, and WHEREAS, having examined said application, the Board deems it appropriate to grant a Weld County Permit for Temporary Assembly to the American Cancer Society, and WHEREAS,said permit shall be issued subject to compliance with the terms and conditions as set forth in the application materials and upon the express condition and agreement that the temporary assemblage will be conducted in strict conformity to all laws of the State of Colorado, and WHEREAS, any violation to said terms and conditions shall be cause for revocation of said permit and forfeiture of bond. SERVICE,TEAMWORK,INTEGRITY,QUALITY Memorandum TO: Clerk to the Board I DATE: August 12, 2010 O • FROM: Ken Swanson, Building Official COLORADO SUBJECT: Temporary Assembly Permit— Cattle Barons Ball Building Inspection staff has reviewed the proposed temporary assembly permit for the Cattle Barons Ball. Staff also visited the proposed structure in which the event will be held. Permit History of this Structure: This building was constructed in 2004 under an Ag-Exempt permit. Ag-exempt permits do not require plans, engineering, building inspections, or a Certificate of Occupancy. As such, staff has little technical knowledge concerning the construction of the structure. Building Code Interpretation: The building use for this proposed special event with an anticipated occupancy load of 900 (IBC Sec. 1004) and an occupancy group classified as an A2 (Assembly-IBC Sec. 303), due to the serving of alcoholic beverages and food. Although not all inclusive of the minimum building code requirements, but with respect to life, health and safety, some of the key concerns this building lacks for this group classification in its current state are: • No required fire suppression system ( sprinklers-IBC Sec. 903) • Inadequate means of egress: exits, exit width, travel distance, panic hardware, emergency lighting, exit signage (IBC Chapter 10) Additionally, it was observed gas fired heaters had been installed in the building, a separate wood framed kitchen area with water; kitchen sink and electrical baseboard heat have also been installed. According to our records, no permits were obtained for this work. Recommendation: As noted above, this building was not constructed for this proposed temporary event use. Should this permit be approved, we recommend at a minimum, the following conditions: 1. The applicant shall contact the local fire department and request a site inspection. All recommendations of the fire department should be implemented. 2. All doors (man and garage doors) within the structure should remain unlocked for the duration of the event for egress purposes. Note: Staff has assumed that the structure was constructed to code (other than noted above) in accordance with the Ag-Exempt permitting process. Additionally, because water, heat, and a kitchen area was added to this structure without building permits (required by the Weld County Code) staff will contact the owner of this property following this event and initiate the process to appropriately permit these modifications.
