RE: Special Review Permit#1478/Jose Aguirre and Josefina Aguirre
DUST ABATEMENT PLAN
Jose Aguirre and Josephina Aguirre, applicants in USR 1478, submit the following dust
abatement plan which is hereby submitted to the Environmental Health Services
Division of the Weld County Department of Public Health and Environment. Applicants
anticipate that there will be intermittent, from time to time, a temporary pile of dirt
between jobs. If dirt is stored, dirt will be stored for a minimal amount of time.
The property presently has an existing well which can be used to control dust. The
applicants will apply such sprinkling of water, as necessary, from the existing well to the
dirt pile and to all parking and driveway areas as needed. The parking and driveways
will meet County standards, gravel parking area and driveways. The applicants do not
anticipate any further dust abatement plan will be necessary. The applicants reside on
the property, and are available to make application for dust abatement as needed.

2. The applicants submit that there will be no chemicals used or stored on
the site.
3. All waste will consist of typical household waste and will be disposed of
through the trash company, BFI, 1925 15t Avenue, Greeley, CO; 352-6124.
4. The applicants are not anticipating the need of any special waste handling
procedures as there will be only typical household waste.

STORM WATER MANAGEMENT PLAN
The applicants submit the following as the storm water management plan. Originally,
the applicants anticipated that the storm water generated beyond the present historical
flow could flow into the Union Ditch. After further review, the elevations prohibit the flow
of storm water run off into the Union Ditch.
The applicants are not making any changes to the historical flow until any subsequent
buildings would be constructed. At the present time, there is no need for the applicants
to address additional water flow as there will not be any change in the conditions on the
property.
When the applicants construct a storage shed on the northeast corner of the property,
the applicants will submit a new storm water management plan which will incorporate
that the applicants absorb any new run off beyond historical flows on the farm ground
the applicants own adjacent to the property within the recorded exemption. The
adjacent property is presently open ground and any retention facilities, if necessary,
may be constructed on the adjoining property.

On behalf of the applicants Jose and Josefina Aguirre, I am providing the following additional
information concerning the requirements for the above referenced USR.
Under item 2.(f), the applicants have advised me they have no intentions of washing vehicles or
equipment on site and therefore, item no. f. is not required.
Under item K.(6), lighting, the applicants will not be installing any exterior lighting. Any other
lighting, including light from high temperature processes, such as welding, will be contained
within a building.
The applicants are in the process of finalizing their plans for screening and fencing. This plan
will be submitted to the County for approval. This should comply with the requirements under K.
(2), (4), and (5).
I have also recently spoken with Jerry McRae who is performing the requirements for the plat.
Mr. McRae has advised me he will have the draft of the final plat prepared not later than
Monday, August 29, 2005. Upon receipt of the same, I will submit two copies to the Department
of Planning Services for preliminary approval.

Our office represents Jose Aguirre and Josefina Aguirre, the owners of the above
referenced property. The property has recently been approved for a use by special
review for the applicant to conduct his concrete business operations on the above
described property. The property was formerly a feed lot operation. At present, the
applicant is not constructing any new buildings on the property and the historic run off
water will not be affected.
The prior and historic run off on the water has by natural slope of the land drained into
the Union Ditch that proceeds along the entire east side of the Aguirre's property. The
Aguirre's do not intend to make any changes to the existing historical run off.
I have therefore prepared an agreement stating that the Union Ditch Company has no
objection to the continued historical storm water drainage off of the property into the
Union Ditch Company. I have enclosed a draft of that letter agreement herein and I am
requesting on behalf of the Aguirre's that the Union Ditch Company sign the letter and
return it to my office in the stamped, self-addressed envelope enclosed herewith. Your
attention to this matter and assistance is greatly appreciated.

LETTER AGREEMENT
THIS AGREEMENT IS MADE and entered into this day of August , 2005 by
and between Union Ditch Company at 1025 9th Avenue #309, Greeley, Colorado
80631, party of the first part, and Jose Aguirre and Josefina Aguirre, parties of the
second part;
WHEREAS, the parties of the second part are the owners of the property
generally known as Lot A of Recorded Exemption No. 3128, a part of the NE 1/4 of
Section 26, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado;
and
WHEREAS, Union Ditch Company is the owner of an easement and a ditch that
traverses along the entire east side of second party's property; and
WHEREAS, storm water drainage has historically drained off of said property into
the Union Ditch company as hereinabove described; and
WHEREAS, the first party desires to put in writing the historical drainage of storm
water off of second party's property into the Union Ditch;
NOW WHEREFORE, it is agreed by and between the parties hereto that
historical storm water drainage off of Lot A of Recorded Exemption No. 3128, being a
part of the NE % of Section 26, Township 5 North, Range 65 West of the 6m P.M., Weld
County, Colorado, may continue to drain into the Union Ditch Company which traverses
along the entire east side of the second party's property herein described.
IN THE EVENT of any change in the historical drainage, the parties will meet to
discuss and determine if any changes or modifications need to be made to this
agreement.

("CPTEDP") . I met with Commander Broderius to discuss CPTEDP ways to prevent
crime on the applicants' property. Mr. Broderius provided me with some suggestions
concerning possible environmental designs to reduce the potential of crime on the
applicants' property. I have relayed that information to the applicants.

This letter is submitted on behalf of the applicant in the above referenced USR which
has been approved by Weld County. For your convenient reference, I am enclosing
herewith a copy of your letter of May 21, 2004.
In response to your letter, please be advised that all setbacks will be maintained within
the site. The parking and driving areas will be built to county standards and will be
graveled, and will be maintained pursuant to a dust abatement plan. The County is
requiring that the parking area be screened and the property will be appropriately
landscaped. The applicant intends to comply with these requirements.
The applicant will attempt to comply with your request concerning the architectural
features on the property. There will be no dumping of waste material on the property
and waste will be disposed of pursuant to an appropriate waste disposal plan approved

Thank you for the opportunity to review this Site Specific Development Plan and Special Review
Permit for a Use Permitted as a Use,by Right, an Accessory Use, or a Use By Special Review in
the Commercial or Industrial Zone District (Concrete Business) in the A (Agricultural) Zone
District. The City of Greeley Planning staff has reviewed the application for this USR from Jose
& Josefina Aguirre located south of and adjacent to CR 54 and '/z mile east of CR 45 and wish to
forward the attached comments. If this use is allowed it is suggested that the following be
required:
The appropriate setbacks under the applicable zone should be maintained within the site.
The parking and driving areas should be paved to help with dust abatement. The surface of a
parking space or maneuvering area for parking and driveway access to parking areas should
consist of concrete or asphalt and should be completely constructed prior to use of said areas
and spaces. It appears there are already eight or more cars parked on the site on a regular basis.
With this density of use the parking area should be screened with landscaping from the
residential use:
The proposed building should have architectural features to help break-up the expanse of the
walls to avoid the appearance of a single, large, dominant building mass, (such as the one that is
already located on the property) breaking up the mass into smaller elements, and/or using
material changes.
No dumping of waste material should be allowed on the property. If outside storage is allowed it
should be screened from the residence on site and from the public right-of-way.
The Public Works Department requested that 60' of right-of-way be maintained along CR 54 as
this is a minor arterial.

You asked if there are any outstanding Public Works items associated with this case. I got a chance to drive
by on August 18, 2006. There were workers in the process of cleaning out the site. The applicant has
installed a solid privacy/screening fence adjacent to WCR 54. In my previous memo dated May 12, 2004, the
Weld County Public Works Department recommended a 45° section on both sides of the access to provide
additional sight distance in both directions at the approach to WCR 54.
The other item was the distance from the centerline/section line of WCR 54. On the plat draw, we have
identified WCR 54 as a collector road, which requires an 80-foot right-of-way at full build-out. There is
presently a 60-foot right-of-way. A plat drawing identifies 10 additional feet to be reserved for future right-of-
way. I did not have my measuring tape with me. Hopefully, the new solid metal fence is built outside the future
right-of-way.
The off-street parking did not have any wheel guards or curb stops to keep vehicles from extending beyond the
boundaries of the spaces and from coming into contact with other vehicles, walls, fences, or plantings. These
are items of concerns that should have been addressed and completed.

The following septic design for Jose Aguirre is submitted for your review and approval.
I. On July 2, 2005, a percolation test was performed by Freese Engineering for the
subject property. The percolation rate was found to be 7.6 min/in. Use 10.0 min/in
for design. The soil profile was 0-1 foot topsoil and 1-8 feet sand and small gravel.
There is no limiting layer and no ground water was observed at 8 feet.
2. Mr. Aguirre also wishes to use one (1) bathroom for his employees. We have used
ten (10) day workers at fifteen (15) gallons/person/day for computation purposes.
Mr.Aguirre says that the existing septic tank is 1750-gallon.
3. The absorption bed shall be a minimum of 888 square feet. As an alternative, an
Infiltrator®system may be used (28 units, 4 rows @ 7 units each). See attached
computations.
4. The new absorption field shall be constructed and installed in accordance with
Weld County Health Department regulations.
5. No traffic shall be permitted on the new absorption field after construction.
