Davis Fire Prevention Division Windsor- Severance Fire Protection District 100 7th Street Windsor, Co. 80550 RE: USR 1551 Great Western Oil and Gas Company Dear Captain Davis, Pursuant to Condition of Approval 1(b) of the above referenced Site Specific Development Plan and Use by Special Review permit may this correspondence serve as notice that Great Western Oil and Gas Company has addressed the requirements of the Windsor- Severance Fire Protection District. As discussed in a telephone conversation with Bill Crews on March 16, 2006; Great Western Oil and Gas will comply with all applicable regulations of the Colorado Oil and Gas Conservation Commission in the construction of the Great Western Pad 4 tank battery and all equipment,pipe and fittings comply with COGCC and API specifications. All of the wells flow lines and the batteries gas gathering line will be constructed with compliant equipment and in accordance with applicable DOT regulations. All of the construction activities will be supervised by either Great Western Oil and Gas employees or their authorized representative. The condensate storage tanks will be placarded with NFPA placards and MSD's for condensate, natural gas and produced water are available upon request. Great Western Oil and Gas Company is anxious to build a strong working relationship with the Windsor- Severance Fire Protection District. In fact, they are not due until 30 days after the report of first production (well completion report?) is filed. But no later than 90 days after the first day of production. A construction permit (either an individual permit or the General Permit) will be issued in response to the APEN. You can keep producing in the meantime—you do not have to wait until the permit is issued. However, in order to meet the Reg. 7 VOC reduction requirements this year(47.5% on a daily basis May 1 — September 30, then 38% the rest of the year), the next several batteries need to be controlled (unless condensate production is < 730 bbl/year). Attached are some APEN exemptions from AQCC Regulation 3 Part A.II.D. I've marked a few of the ones that pertain to oil & gas E&P operations. With the recent adoption of the East Side Industrial Subarea Plan (ESISP) update to the Town's Land Use Plan map, the subject property is now located within the Town's Growth Management Area (GMA) and is depicted as Heavy Industrial on the Town's Land Use Plan map. However, the subject property is not part of any pending annexations and the Kodak campus is not currently planned to be annexed to the Town. The applicant has indicated that they plan to establish drill sites located on Kodak property in order to directional drill to other portions of the property, thereby preserving surface development potential on the property that is proposed for annexation to the Town. Therefore, the Planning Commission recommends approval of USR-1551 to the Weld County Department of Planning Services. Thank you for the opportunity to review this proposal.
