HomeMy WebLinkAbout20100990.tiff RESOLUTION RE: APPROVE REVISIONS TO BYLAWS OF FAMILIES, YOUTH AND CHILDREN COMMISSION (FYC) WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Bylaws of the Families, Youth and Children Commission (FYC) were approved by the Board by Resolution #980802 on May 11, 1998, and amended by Resolution #981668 on September 9, 1998; by Resolution #981826 on October 5, 1998; and by Resolution #2003-0396 on February 10, 2003, and WHEREAS, after review and upon the recommendation of the FYC and the Weld County Department of Human Services, the Board deems it advisable to amend said Bylaws, a copy of which are attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the FYC Bylaws be, and hereby are, amended as attached. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 10th day of May, A.D., 2010. I-{S v.` ik '4-/D) /p g I U 2010-0990 SS0002 BYLAWS WELD COUNTY FAMILIES, YOUTH AND CHILDREN (FYC) COMMISSION Article I - Name of Commission The Commission shall be called the "Weld County Families, Youth and Children Commission" (hereinafter referred to as "the FYC"). Article II - Functions of the FYC The functions and duties of the FYC are to: Function as the "Placement Alternatives Commission" for Weld County, as referred to in C.R.S. § 19-1-116 (2)(a), and prepare the plans required by C.R.S. § 19-1-116 (2)(b). Review and advise the Board of County Commissioners of Weld County regarding the following: 1) Weld County's compliance with the out-of-home placement allocations and associated requirements of C.R.S. §§ 26-5-101, et. seq. 2) Weld County's Family Preservation Program with Core Services and RTC Prevention Program, and the Multidisciplinary Youth Assessment Team (MYAT). 3) The effectiveness of programs within Weld County which are designed to prevent or reduce placement. i• Function as the "Family Preservation Commission" for Weld County, as referred to in C.R.S. § 26-5.5-106 (1), and comply with the review and reporting requirements of C.R.S. § 26-5.5-106 (2). Article III - Membership of FYC A. Membership - The FYC shall consist of ten(10) members. The membership shall include: (1) A physician or licensed health professional. (2) An attorney. Page 1 of 5 Pages 2010-0990 (3) A representative of a local law enforcement agency. (4) A representative of the probation department. (5) A representative from a local mental health clinic. (6) A representative of a local school district. (7) A foster parent/adoptive parent. (8) A member-at-large. (9) An accountant or other financial professional. (10) A clinic nurse. No members may be employed by or otherwise associated with a provider of out-of-home placement services. B. Appointment of Members - The members of the FYC shall be appointed by the Board of County Commissioners of Weld County, according to the following procedure: (1) Persons interested in serving on the FYC shall submit an application which will provide biographical information. (2) A Nominating Committee, consisting of the FYC Executive Committee members and the Director of the Weld County Department of Human Services, shall review each application and establish a list of nominee(s) for vacancies and reappointments for consideration by the FYC. (3) The FYC shall review and consider the list for recommendation to the Board of County Commissioners. (4) The Board of County Commissioners shall review the list of nominee(s) and may interview such nominee(s) according to the Board's desires. The Board, in its sole discretion, may appoint members to fill vacancies or reappoint members for additional terms. (5) The Board of County Commissioners may designate on an annual basis such Community Advisors as the Board deems necessary in order to benefit the FYC ad hoc committees of Program Effectiveness and Outcomes, Family Support, and Collaboration and Innovation. Such community advisors shall be representative of the community and have demonstrable personal or professional knowledge of the area of their designation. Community Advisors shall not vote on matters which Page 2 of 5 Pages come before the Standing Committees for determination. (6) The Board of County Commissioners may appoint members to serve as Standing Members in certain positions listed in Paragraph III.A., above, where, by virtue of the member's unique abilities, or because of the position itself, a standing membership is justified. C. Terms of Members - Regular membership terms of the FYC shall be for three (3) years. No member may serve for more than two (2) consecutive terms. New FYC members may be assigned first terms of less than three (3) years to assure appropriate staggering of members' terms. Article IV - Officers A. The FYC shall elect from its own members a Chair and Vice-Chair. Term of office shall be for one year. B. In the absence of the Chair, the Vice-Chair will act in that capacity. C. In the absence of the Chair and the Vice-Chair, a temporary Chair will be selected by the FYC. D. The secretary shall be the Service Utilization Assistant at the Weld County Department of Human Services. Article V - Nomination and Election of Officers The nomination and election of annual officers shall be held during the first regular meeting of each calendar year. Each nomination shall be seconded to be placed on the ballot, and elections shall be written ballot unless there is no contest for the office. Article VI - Meetings A. Regular meetings of the FYC will be conducted quarterly on days agreeable to the membership, provided there is business to conduct. B. Written notice of all regular meetings shall be mailed to each member at least seven (7) days prior to each regular meeting date. C. Special meetings may be called when deemed necessary by the Chair. Page 3 of 5 Pages D. A quorum shall consist of not less than six (6) members of the FYC. A quorum shall be necessary at any meeting in order to conduct business. E. The concurring vote of a majority of those present shall be required to pass any motion made. E. Robert's Rules of Order shall prevail to the extent they are not in conflict with specific provisions of these Bylaws. Article VII - Duties of Chair It shall be the responsibility of the Chair to call all special meetings, preside at all meetings, and carry out general Chair responsibilities. Article VIII - Duties of Vice-Chair It shall be the responsibility of the Vice-Chair to assume the duties of the Chair in his absence. Also, he shall perform other duties assigned by the Chair. Article IX - Duties of Secretary It shall be the responsibility of the secretary to send members notices of all meetings of the FYC and to keep minutes, or to arrange for the keeping of minutes, of all meetings. Article X - Amendment of Bylaws These Bylaws may be amended according to the following procedure: 1. The proposed amendments to the Bylaws may be presented at any meeting of the FYC at which a quorum is present, provided seven (7) days notice has been given to each member. 2. For passage, such proposed amendments must receive the vote of the majority of the entire membership of the FYC. 3. All amendments approved by the FYC must be approved by the Board of County Commissioners of Weld County prior to becoming effective. Page 4 of 5 Pages Article XI - Disputes Disputes between the Department of Human Services and the FYC shall be resolved as expeditiously as possible either by concurrence between the two entities or by intervention by the Board of County Commissioners. Article XII - Confidentiality Members of the FYC may, by virtue of such membership, inspect or be privy to records and other materials containing personally identifying information maintained by the Weld County Department of Human Services. Members shall protect the confidentiality of such records and other materials. Except as provided by law, no information in possession of a member of the FYC about any individual client shall be disclosed in a form including identifying information. Revised 5/10/10.
