WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado at a public hearing held on the 11th day of April, 1979 in the Chambers of the Board of County Commissioners of Weld County, Colorado that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption No. 384 , being the property of Willard and Marian Helzer, described as Part of the West Half of the Northeast Quarter and Northwest Quarter of Section 12 , Town- ship 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : The Northwest Quarter of Section 12, and all that part of the West Half of the Northeast Quarter of Section 12, 'Ibwnship 6 North, Range 65 West of the 6th P.M. , lying above the center line of the North Side lateral described as follows: Beginning at the northwest corner of said Northeast Quarter of Section 12, thence South on the West line of said quarter section 1912 feet, to the center line of the North Side Lateral as now constructed; thence following the center line of said North Side Lateral North 41°27' East 251.2 feet; thence North 18°45' Fast, 324.7 feet; thence North 03°12' Fast, 652.8 feet; thence North 22°54' Fact, 317 feet; thence North 07°35' Fast, 469 feet to the North line of said quarter section; thence West on the North line of said quarter section 485 feet to the point of beginning. does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definitions of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, %_ 790826 and Section 2-1A(3) of the Weld County Subdivision Regulations. COLORADO April 11, 1979 Board of County Commissioners Weld County, Colorado 915 10th Street Greeley, CO 80631 RE : Recorded Exemption #384 Dear Commissioners : The attached application, plat and related items are in reference to a request by Willard and Marian Helzer for a recorded exemption. The parcel of land is described as Pt. WZNE1/4 and NW4 Section 12 , T6N, R65W of the 6th P. M. , Weld County, Colorado . This property is located 1-1/2 miles southwest of Galeton. The property contains approximately 171 .8 acres of Class III and IV irrigated soils in the Agricultural Zone District. The request is to split the pro- perty into parcels of approximately 9 . 9 acres and 161. 8 acres . The Helzers have sold their farm in Weld County in exchange for a larger unit in Nebraska. The purchasers of the Helzer farm (Mr. and Mrs. Vernon Cecil) have no need for the buildings as they already have a set of improvements on their farm. Due to time factors involved with the purchase and sale of the farms, Mr. Vernon Cecil has been granted power of attorney for the purposes of this recorded exemption. Mr. Cecil desires to sell the improvements parcel , Lot A, while maintaining the larger unit, Lot B, in agri- cultural production. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be approved for the following reasons : 1. The proposed split conforms with Section 9-2 of the Weld County Subdivision Regulations (intent clause of the recorded exemption procedure) , Section 3 . 3 A. of the Weld County Zoning Resolution (intent clause of the Agricultural Zoned District) , and the Weld County Comprehensive Plan in that each parcel does have an exist- ing set of improvements . The use will be compatible with sur- rounding agricultural uses . The request will allow agricultural and related uses to be the predominant land use. This request complies with the provisions of Section 9-4 (A) of the Weld County Subdivision Regulations, with the exception of Section 9-4 (A. ) (5) . In a letter dated April 5, 1979, the Weld County Health Department stated that the applicant ' s septic ,system is in violation of Weld County Individual Sewage Disposal /System Regulations . The Department of Planning Services Staff /System for approval is conditional upon the applicants taking out a repair permit on their septic system in accordance with Health Department Regulations .
