WITNESSETH, that the grantor, for and in consideration of the sum of$1,125,000.00, the
receipt and sufficiency of which is hereby acknowledged, has granted, bargained, sold and
conveyed,and by these presents does grant,bargain,sell,convey and confirm,unto the grantee,
his heirs and assigns forever, all the real properly, together with improvements,if any,situate,
lying and being in the said County of Weld and State of described as follows:
• A tract of land being that part of the NEI/4 of Section 31,Township 4 North,Range 66 West of
the 6!h P.M.,lying South and East of the centerline of Farmers Independent Ditch and the
Northerly 8.50 feet of the SEI/4 of said Section 31 lying East of the Farmers Independent Ditch,
County of Weld,State of Colorado.
Together with fourteen(14)shares of stock of the Fanners Independent Ditch Company,
fifteen(15)shares of stock of the McKay Lateral Ditch Company,2 irrigation wells,Permit Nos.
R-13416 and R-13417,one domestic well,one-third of the allotted well augmentation coverage
of Contract No.548,Groundwater Management Subdistrict of the Central Colorado Water
Conservancy District,and all other water and water rights,ditch and ditch rights used upon or
appurtenant to the property.

appurtenances, unto the grantee,his heirs and assigns forever. And the grantor,for himself,his
heirs, and personal representatives, does covenant, grant, bargain, and agfec to and with the
grantee,his heirs and assigns,that at the time of the ensealing and delivery of these presents,he
is well seized of the premises above conveyed,has good,sure,perfect,absolute and indefeasible

has actual knowledge and which were accepted by Grantee(s) in accordance with Section 8b
(Matters not shown by the Public Records;and Section 8c(Survey Review)of the Contract to
Buy and Sell Real Estate relating to the above described real property, inclusion of the property
within any special tax district; and, the benefit and burdens of any declaration and party wall
agreements,if any.
The grantor shall and will WARRANTY AND FOREVER DEFEND the above-bargained
premises in the quiet and peacable possession of the grantee,his heirs and assigns,against all and
every person or persons lawfully claiming the whole or any part thefeuf. The singular number
• shall include the plural,the plural the singular,and the use of any gender shall be applicable to all
genders.
