The access is closed to farm vehicles to WCR 5 as required by Weld County Public Works and approved by the County Attorney and which allows the neighbor access to his property along his property line as requested. I assume that you will note in the file that the closure of the access is satisfactory to the request of the February 1, 2010 deadline. Like you indicated, the applicant fenced off the entire road access into the dairy and your property. The applicant (Bangma/Mile High Dairy) was required (as a condition of approval for their Use By Special Review Permit approved by the Board of County Commissioners) to close the access (located on their property) to prevent any dairy trucks. . . from utilizing the access. However, the applicant should not be closing that portion of the access that is located on your property (thereby denying you the ability to access your property) . I have spoken to our Public Works Department as well as with the consultant who is working with the applicant in regards to this issue. The applicant's consultant has agreed to convey this to Bangma so that the edge of the fence will be moved to their southern property boundary thereby keeping the portion of the access on your property open. The schedule indicated the fence would be installed by December 31st, 2009. However, the improvements agreement schedule (exhibit "B") of the agreement states that the improvements shall be completed .5 years from the date of approval of the final plat. The final plat was submitted for recording on October 13, 2010. To allow ground sufficient time to thaw for fence installation while maintaining consistency with the improvements agreement ("Schedule B"), staff will require the applicant to install the screening fence by no later than: April 13th 2010. If the fence is not installed by this date, then staff will schedule a hearing before the Board of County Commissioners for noncompliance with the requirements for Amended Use By Special Review Permit 686 (AMUSR-686) . 2) Access: The southernmost access into the dairy property is required to be closed (and is indicated as closed on the plat). Staff met with representatives for the applicant (AGPRO) last week and indicated that this access needs to be closed immediately. Staff is requiring that the applicant provide evidence that this access has been closed to the Department of Public Works and Planning Services. 3) Lagoon: I have reviewed the application materials and checked with the Environmental Health Department re: this and have confirmed that the pond is a stormwater/process water pond (not just a stormwater pond). The pond design has been approved by the Department of Colorado Public Health and Environment and engineered drawings of the pond structures have been forwarded to the Weld County Department of Public Health and Environment as required. 4) In regards to operating equipment during late night/early morning hours, has the dairy been consistently operating during the middle of the night or only occasionally? Development Standard #4 states: "The hours of operation are 24 hours "per day, 365 days per year. Equipment operations, trucks, farming activities, and maintenance activities, other than emergencies, will occur primarily during daylight hours, as stated in the 1 application materials." - ThQdevelopment standard does give a allowance for night-time operations (during emergencies. . .) but does make it clear that operations will occur predominately during the daytime hours. If the applicant is consistently running equipment, trucks. . . during nighttime hours - staff would appreciate any evidence you can provide (in the form of pictures/time logs. . .). I was told coming on 2 years ago that I would have my property that this dairy accesses daily back from an easement the was relinquished by you in a meeting. I began putting a fence up shortly after the meeting and the posts were broken off by employees of the dairy. They said they were unable to access the pens to clean. I told them that it wasn't my problem. Being a good neighbor I asked if he needed access until he can build a new fence. He said he would have one in about 6 months. That was over a year ago. I contacted Jaquelin, who worked in the Del Camino office what was going on with all the requirements that this dairy promised to meet in the meeting. She said a line of credit was set up to have the fence built by no later than the end of the year, 2009 Mr Bagman told Kevin Vendagna that it would be done by Oct 2009. The only thing he's done was spending money on new tractors, manure spreaders, the new lagoon, and a sprinkler. By the way this wasn't suppose to be a lagoon, The purposed was for flood control. I can see this lagoon from my deck and several times this year it is so full that it is a few feet from reaching the spillway. , The smell is much worse than it was when Bernie Hooglan the dairy. He just went from 2 small lagoons to one 3 times the size. We were sold a load of crap promises from this family dairy (who don't even live on the property) as far as I and the other neighbors are concerned. What recourse do I have to make him meet his requirements? After the first of the year Kevin and I are hiring a surveyor to relocate the property markers and I will put up a fence and if he touches that fence he will deal with the Sheriff's office with trespass violation. Again, what recourse do I have, the county won't even back the property owners from big dairy money. I am pissed, you guys have let him run up and down road 5 with spreaders running over and dumping along the roadway. He runs loaders and spreaders all night long. I can hear the loaders and the backup siren in the winter time at 11:00 at night. The only thing he has somewhat complied with was the lights, and those he turns on at about 5:30 in the morning. I spoke to him about 8 months ago about the fence and he said he didn't have the money because the price of milk. I told him I got laid off from my job of 18 years but I still needed to meet my bills, no body is going to give me a pass. I just found another job. I told him maybe he should give up some of the money from the trust fund to build the fence. . . let's just say he didn't take kindly to that advice. Well what am I supposed to say? He is using my property for his business. Is that fair? 2 ® Sorry to vent but Kevin Vendagna and I are pretty feed up with the whole situation and we would like some actions on his part.
