RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST CORONET INVESTMENT COMPANY, LLC/KURT ALTHEN
FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Coronet Investment Company/Kurt Althen, ZCV #1000005, is allegedly in
violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of April, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Kurt Althen, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorneys Office for legal action, with an instruction for delay of
action upon such referral until July 13, 2010, to allow adequate time for the property owner to
submit an application for a Use by Special Review (USR) permit, or remove the derelict vehicles
and miscellaneous debris, and for an inspection of the property by the Department of Planning
Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#1000005 be, and hereby is, referred to the Weld County Attorneys
Office for legal action against Coronet Investment Company, LLC/Kurt Althen to remedy the
violation of the Weld County Code, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until July 13, 2010, to
allow adequate time for the property owner to submit an application for a Use by Special Review
(USR) permit, or remove the derelict vehicles and miscellaneous debris, and for an inspection of
the property by the Department of Planning Services staff.

moved or structurally altered or operated in the C-3 Zone District until a site plan review has

applicant in the C-3 Zone District certify and state that the performance standards and
district requirements that are applicable to the DEVELOPMENT and USE of property zoned

REMEDY
According to my records I have been unable to locate receipt of the Pre-Application Request
questionairre. As I have previously indicated this property does not appear to be in compliance with
SPR-363 (Site Plan Review). My records reflect that when SPR-363 was completed the East building
was not occupied and there was no associated outdoor storage. However, during a site inspection I
conducted yesterday there are several semi trailers, possible DERELICT VEHICLES and miscellaneous

items were noted: several semi trailers, apparent derelict
vehicles and miscellaneous storage. No pictures were
taken during this inspection.
02/08/2010 Phone Call Kurt Althen (720-849-4655) called. He said he received
my letter and was calling to check in. I explained the
violation. I asked what type of business he had operating
so I could direct him on what type of application he would
be needing to submit. He said it would be a similar use to
that of JB Auto-just South of him. Auto Repair, sale of
used automobile parts, etc (Salvage Yard/auto repair). I
indicated that a Salvage Yard requires a Use by Special
Review (USR) permit. I indicated therefore, he would be
interested in completing the middle portion of the 2nd
page of the Pre-Application Request form (which I will

• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews are required
prior to beginning the application process: however, this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and
