RE: ACTION OF THE BOARD CONCERNING ZCV #1000040 AGAINST VIVIAN BEST
AND EDWARD TERRAZAS FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Vivian Best and Edward Terrazas, ZCV #1000040, are allegedly in violation
of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of July, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, upon hearing the testimony and statement of those present, the Board
deems it advisable to dismiss the matter, based upon an additional inspection to be completed
by the Department of Planning Services, verifying the necessary vehicles and equipment have
been removed from the site.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV#1000040 be, and hereby is, dismissed.

VIOLATION REMEDY:
As we have previously discussed, the operation of a landscaping company requires a Use by Special Review
(USR). My records indicate that a Pre-Application Request meeting was conducted with Chris Gathman on
June 10, 2010. Chris granted an extension of the Violation Hearing to the August Violation Hearings. This
extension should grant you enough time to complete and submit your Use by Special Review application or to
remove the business operations and all associated storage from the property.
RECOMMENDATION:
The Department of Planning Services recommends this case be forwarded to the County
Attorneys Office for immediate legal action or the Commercial Vehicles, operations and
storage be removed from the property.

05/18/2010 Office visit Ed Terrazas came to the Greeley Planning Office. Tom Parko and I
met with him and he partially submitted his Pre-Application Request.
He needed to go back home and write a brief narrative and fax it in to
Tom. Tom tentatively scheduled him for June 3rd since Mr. Terrazas
would be out next week and this week was already full.

• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews are required
prior to beginning the application process; however, this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre-Application reviews are held Thursday and Friday of any given week in the Greeley office.
To be on the pre-submittal agenda, the request and required checklist items must be received one week prior to
the review date, and shall include at a minimum, a description of the property including surrounding lands and land
uses, property owners name and contact information, a brief narrative and a map delineating the property location,
in addition to the other items listed.
