WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on June 20th, 1979, the Board of County Commis- sioners of Weld County, Colorado held a public hearing in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Carol and Ed Ohman for Recorded Exemption No. 400 on the following described parcel of land: Part of the Northeast Quarter (NE4) of Section 5, Township 6 North, Range 65 West of the 6th P.M. , County of Weld, State of Colorado being more particularly described as follows: Beginning at the East Quarter Corner (E4 Cor) of said Section 5 and considering the East line of the NEn of said Section 5 as bearing South 00°00' 00" East, with all other bearings contained herein relative thereto; Thence North 87 °11' 31" West, 30. 04 feet to the True Point of Beginning; Thence continuing North 87 °11 ' 31" West, 1293.23 feet; Thence North 00°03 ' 29" West, 342 . 50 feet; Thence South 87°23 ' 04" East, 1293. 37 feet; Thence South 00°00 ' 00" East, 346. 84 feet to the True Point of Beginning; Said described parcel of land contains 10.223 acres, more or less, and is subject to any rights-of-way or other easements as granted or reserved by instruments of record or as now existing on said described parcel of land. WHEREAS, the Board of County Commissioners, at said hearing, was to decide whether or not the abovedescribed parcel of land comes within the purview of the definition of the terms "sub- division" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, upon motion and second to approve said Recorded Exemption, the Board of County Commissioners voted 2-2 , the result of which is, in effect, a denial of the Petitioner' s application for a Recorded Exemption. 790810 NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Carol and Ed Ohman for Recorded Exemption No. 400 concerning the abovedescribed parcel of land be, and hereby is, denied. Ed. Ohman which was denied after a public hearing before the Board of County Commissioners. With regard to your concerns regarding the procedures involving land variances, recorded exemptions, subdivision exemptions and other land use matters, please be advised that our Planning Staff is now in the process of re-writing the Zoning Resolution and examining all the procedures involving land use matters which re- gularly come before the Board of County Commissioners and the Board of Adjustment. The Board of County Commissioners will make every effort to streamline these procedures and to remove any inequities that might exist in the present Zoning Resolution. Whenever a land use application such as the one involving Mr. and Mrs . Ed Ohman is heard by the Board of County Commissioners , the Board must make its decision based on the evidence presented to the Board at the hearing on the application. If an application involving a land use matter is denied by the Board of County Com- missioners , the EXCLUSIVE remedy for review of the action of the Board of County Commissioners is found in Rule 106 (a) (4) of the Colorado Rules of Civil Procedure, which does in fact provide a simple and speedy judicial review of any such action of the Board of County Commissioners in denying any land use matter. Mr. and Mrs . Ohman, by their failure to seek judicial review of the action Of the Board of County Commissioners , have apparently accepted the action of the Board in denying their application for a recorded exemption, and therefore, we must consider the matter closed. Their request for a lot size variance was approved by the County Commissioners in a 3-2 vote, but after a considerable investment of time and money, their request for a recorded exemption was denied in a 2-2 vote in the absence of Commissioner Carlson. The Ohnans presented a case to the Council that highlights the frustration of citizens who endeavor to adhere to County planning procedures without wanting to waste their money on required surveys and fees only to have their requests denied. The Council feels that it would be appropriate if the County Commissioners waived all County fees in the case of a reapplication of this specific land split for Carol and Ed Ohman. The County Council suggests that the County Commissioners review the procedures involving land variances for required exemptions, subdivision exemptions, and frontage variances and any other procedures involving citizens' requests for special consideration, to permit final hearing involving one tract of land to be heard by the Commissioners at one time. The property is described as Pt . SEINE* Section 5, T6N, R65W of the 6th P.M. , Weld County, Colorado. This property is located 1-1/2 miles east and 1/2 mile south of Eaton. The property contains approximately 10.2 acres of Class IV and VI non-irrigated soils. The request is to divide the property into two parcels of approximately 4.75 acres and 5.47 acres. The Ohmans desire to sell the 4. 75 acre parcel . The Ohman 's residence is located on the 5.47 acre parcel. On February 14, 1979, the Board of County Commissioners approved a request by Mr. and Mrs. Ohman for a lot size variance so that they could make application for this recorded exemption. At the time they made the decision on that request , the Department of Planning Services Staff submitted a letter of recommendation for denial to the Board. A copy of that letter for denial is included in the attached packet . Nothing has been received by our office that would change our recom- mendation of denial for this request as outlined in the letter to the Board of County Commissioners dated February 7, 1979. However, on April 26, 1979, the Weld County Board of Adjustment granted a variance of 20 feet from the 180 foot of required road frontage. The property contains approximately 10. 2 acres of Class IV and VI non-irrigated soils. The request is to obtain a variance from the minimum lot size requirement , Section 0-4 A. (`l) , so that they may make application to apply for a recorded exemption . If this lot size variance is granted, the Ohmans will proceed with their application for a recorded exemption to divide the property into two parcels . of approximately 4. 75 acres and 5. 47 acres. The Ohmans desire to sell the 4 . 75 acre parcel . The Ohmans' residence is located on the 5. 47 acre parcel. Based upon the information submitted and the adopted policies in the County , the Department of Planning Services Staff recommends this re- quest be denied for the following reasons : 1 . It is the opinion of the Department. or Planning Services Staff that the proposal is not consistent with the intent clause of the record- ed exemption procedure. said clause states: "The intent in establishing the Recorded Exemption pro- cedure is to provide , in accordance with the Weld County Comprehensive Plan , a means whereby non-productive agri- cultural lands may he developed for higher or more pro- ductive uses , insofar as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed . (Rev . 4/17/74 ) Board of County Commissioners Page rebruar:• 7 , 1979 The Plan urges residential development to he closely connected to and served by municipal utilities , and towns should he en- couraged to service new developments within a reasonable service area from the town . The plan further indicates subdivision of land should conform to the overall development goals and policies. 2. It is the opinion of the staff that the proposal is not consistent with the intent clause of the A-Agricultural Zone District which states : "Intent - The intent in establishing the A-Agricultural Zone District is to allow all agricultural related uses in those areas in which agriculture is and should con- tinue to be the predominant land use . This district is intended to discourage encroachment of incompatible uses upon the agricultural land in the district , to encourage agricultural uses as the highest and best use of the land in the district as compared with other uses in conflict therewith , and to provide for the orderly expansion of ' urban growth in conformance with the Weld County Compre- hensive Plan . ( Rev. 12/29/76) The parcel is not prime agricultural land because of vast divi- sions of land creating rural residential tracts.. The nature of the request is not , however , providing for the orderly expansion of urban growth . The Town of Eaton has expressed that 5 acre parcels are acceptable to their land use considerations . The Department of Planning Services Staff feels that if the area were to continue to develop into 5 acre tracts , however , inefficient develonment will result . 3 . It is the opinion of the Department of Planning Services Staff that in the vicinity of the proposed recorded exemption , development has reached a level where the continued division of parcels would evade the intent of the Weld County Subdivision Regulations. The princi- pal purposes of the Subdivision Regulations of concern to the Department of Planning Services Staff are as follows : 1 . "A . To assist orderly , efficient and integrated development . 2 . B. To promote the health , ':afel.v , and tceneral welfare or the residents. 3. C.
