Dear Kim,
Per our phone conversation of 12/15/09 concerning the Final Approved Planned Unit Development of
Markey Circle:
As we discussed,the Mackey's are no longer financially capable to continue the project and will
be signing a Deed in Liu of Foreclosure on the real estate.
Colorado Community Bank has too much at stake to allow the subdivision to be abandoned. We are
presently looking at reputable developers to acquire and complete the project.
Colorado Community Bank would request that the Mylar be filed and that no collateral ($143,819.00) be
required until ground is broken.
