RE: ACTION OF THE BOARD CONCERNING ZCV #1000065 AGAINST REX AND
TERESA WALKER FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Rex and Teresa Walker, ZCV #1000065, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of September, 2010, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Rex Walker, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until March 14, 2011, to allow adequate time for the property owner(s)
to bring the subject property into compliance by removing the cargo containers on the site and
completing the necessary fencing, and for an additional inspection to be completed by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #1000065 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Rex and Teresa Walker to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until March 14, 2011, to allow adequate
time for the property owner(s) to bring the subject property into compliance by removing the
cargo containers on the site and completing the necessary fencing, and for an additional
inspection to be completed by the Department of Planning Services staff.

23-3-30.K.1 Electricity is the only utility which will be connected to the cargo container used for storage.

VIOLATION REMEDY:
While a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES, building materials and
miscellaneous debris is an Accessory Use in the Agricultural Zone District, it must be completely SCREENED
from all adjacent properties and public right-of-ways. Otherwise, the Noncommercial Junkyard shall be
removed or restored.
Additionally, 2 (two) cargo containers are an Accessory Use provided building permits are obtained. However, I
have been unable to locate any building permits for cargo containers situated on this property. The presence of
more than 2 cargo containers requires a Use by Special Review(USR). If you desire to retain more than 2
(two), the first step in this process is a Pre-Application Request meeting. This step is completely free to the
application, but does require submittal of a short application. My records indicate that I previously sent this

06/04/2010 Phone call Rex Walker(302-0030) called. He said he didn't intend to start a
Noncommercial Junkyard, but he had been forced out of his last
location and had to bring all his stuff to this site. He said he has
started a privacy fence (he said it was a standard wooden privacy
fence). He said it will take him longer to get the cargo containers
addressed. I advised him that my next step is to send a 30 day
letter. I advised him that I actually just sent it on June 1st. My next
step would be to schedule a Violation Hearing. I told him that I could
push off the Violation Hearing to the August Violation Hearings (so
that would buy him close to an additional 30 day). He said that
would help. He said his intent was to build an ag exempt building,
but for financial reasons he may need to just keep a couple cargo
containers and build onto them. I advised him that the cargo
containers will require a building permit (they are not considered Ag
Exempt). He said he understood. I told him to call me if he felt he
finished bringing the property into compliance sooner than July 1st.
He said he would.
06/17/2010 Phone call Rex Walker(302-0030) called again. He said he called me initially
on June 4th. He said during that conversation I indicated to him that
I would wait to send out his 30 day letter until July 1st, but he
received it the following day. I explained that I had already sent the
letter when we spoke, so my intent is to send another 30 day letter
on July 1st, which will take him to August 1st. I will not make the
August Violation Hearing, so this will push his hearing to September
14. I advised him that if he needed additional time he would need to
request it from the Board of County Commissioners at the hearing on
the 14th of September. He said he understood.

DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; does not have valid registration with the State, as required by Section 42-3-103, 42-3-
138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently attached to
the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper equipment to the extent
that it would be unsafe or illegal to USE on public road rights-of-way or otherwise not equipped
with lamps and other equipment, as required in Sections 42-4-202 to 42-2-227, C.R.S. This
definition shall not include implements of husbandry, farm tractors or vehicles customarily
operated in a FARMING operation.
JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones; rags; used
cloth, rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools; used
appliances; used lumber or crates; building materials; fabrication of any material; used pipe or
pipe fittings; used conduit or conduit fittings; used automobile parts; DERELICT VEHICLES;

NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals, paper,
rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD may
also include the storage or keeping of DERELICT VEHICLES registered last or currently
registered under the property owner and/or tenant's name. This definition does not include
COMMERCIAL VEHICLES. If the Zone district allows, the NONCOMMERCIAL
JUNKYARD shall be totally ENCLOSED within a BUILDING or STRUCTURE or visually
SCREENED from all ADJACENT properties and public rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding uses.
A SCREENING PLAN shall be submitted and approved by the Department of Planning
Services.

Bethany,
I would like the zoning department to investigate compliance with the Weld County zoning regulations at 2
locations, 14066 CR 84 and 40734 CR 29, Ault. Both are zoned as agriculture. I believe that the occupants are
in violation of 23-3-30 part K, Cargo Container as accessory structures. The zoning codes states that "two (2)
cargo containers may be allowed on property of less than eighty (80) acres in size..." There are currently=>4
containers on each of these properties. The containers at 40734 CR 29 have been in place for over 2 years and
in discussion with the owner, we were told these were temporary storage facilities that were to be removed
following the completion of their home which occurred over 18 months ago. The containers at the other
location (14066 CR 84) have just arrived in the past month and there are at least 7 containers currently on-site.
I have not discussed this issue with this neighbor as attempts to contact her via telephone have not been
successful and messages not returned. Both lots are—16 acres in size and adjoin my property to the
West/Northwest.
