Subject: USR-1738 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV09-00295)was noted. This
violation was initiated due to the operation of a tree trimming business without first submitting and
completing the necessary Weld County Zoning Permits. This case was presented to the Board of County
Commissioners through the Violation Hearing process on January 12,2010. At that Violation Hearing,the
Board of County Commissioners referred this case to the County Attorney's Office, but delayed legal
action for 30 days (02/12/10). This application, if submitted prior to January 12, 2010,would not require
an Investigation Fee.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied,the commercial business and storage shall be removed from the property within 30
(thirty) days or the Violation case will proceed accordingly through the Court process.

Answers to questionnaire filled out by the applicant indicates the following:
• May possibly erect(3) new buildings (#5-d)
• New construction is a mere dream (9)
• That said, if new construction is performed, it shall be to the following:
1. Building permits shall be obtained prior to starting. Certificate of Compliance permits for pole
structures which meet the requirements as Ag-Exempt under Weld County definitions are
required for all proposed new structures and any existing structure which permits were not
obtained.
2. A plan review is required for each building or structure for which a building permit is required.
Two complete sets of plans are required when applying for each permit. Include a Code
Analysis Data sheet for the Weld County Building Department for each structure that requires a
permit. Submittal plans shall include a floor plan showing the specific uses of each area for the
building. Plans shall bear the wet stamp of a Colorado Licensed Architect or Engineer.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2006 International Residential Code; 2006 International Mechanical Code; 2006
International Plumbing Code; 2006 International Fuel Gas Code; 2006 International Energy
Code; 2003 ICC ANSI 117.1 Accessibility Code; 2008 National Electrical Code and Chapter 29
of the Weld County Code.
4. All building plans shall be submitted to the Mountain View Fire District for review and
approval prior to issue of building permits.

I have reviewed the submitted material pertaining to the Site Specific Development Plan and Use
by Special Review for a home business (Parker Tree Service) at 14438 Weld County Road I.
The District does not object to use of the property for the storage of mulch materials.
Water supply for fire protection may be required for new construction on the property. Water
supply for fire protection is not required for private garages, barns, storage buildings and
accessory buildings provided the building is not being used as living space and hazardous activity
• will not be occurring within the structure(i.e. woodworking,vehicle repair garage, spray painting
with flammable/combustible liquids,etc.).

COLORADO
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process. All issues of concern and critical issues
during further review must be resolved with the Public Works Department.
COMMENTS:
Weld County Road Classification Plan (FHU): WCR 1 is a collector road and requires an 80-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required
setback is measured from the future right-of-way line.
Our most recent MDT count reflects 3082 vehicles per day taken in May of 2007.
• The applicant should be aware of the County's road access policy (Weld County Code, 8-2-10) which
states that direct access from a public road will be limited to one (1) per legal parcel, except as further
limited or restricted by zoning or subdivision regulations. If an additional access is requested to a legal
parcel where an existing access already exists, it should be interpreted that the second access would not
be provided unless the denial of the access creates some undue hardship on the property owner.
Site Plan:
1. Due to the volume of traffic on WCR 1 as well as the large number of existing accesses along this
portion of roadway, the applicant shall utilize only the existing access to this parcel.
2. Any improvements to or widening of an access will require an Access Permit and a Right-of-Way
Permit for construction in Weld County Right-of-Way. Both permits can be obtained from the
Weld County Public Works Department. An access greater than 40 feet wide is not acceptable.
3. The existing access, circulation, and gravel driveway shall be graded and drained to provide an
all-weather access to the facility.
4. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other
than grasses, needs to be maintained at a maximum height of 12 inches until the area is
completely developed.
Storm Water Drainage: A water quality capture feature to control run-off from your property is required.
5. Please provide calculations for the required water quality capture feature. If you need assistance
• in sizing the feature please contact, Heidi Hansen at 970-304-6496 ext. 3750
6. Please show the location and size of the water quality feature on the plat and call it out as"Water
Quality Feature, No Build or Storage Area".

• 7. Please add a note to plat stating that "Weld County is not responsible for the maintenance of
drainage related features."
8. The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or
unplanned ponding of storm run-off.
Flood Hazard Development Standards: This area is not in a Special Flood Hazard Area (SFHA) as
determined by the Federal Emergency Management Agency (FEMA).

Environmental Health Services has reviewed this proposal for a tree service business.
There is an existing three bedroom house which is served by Longs Peak Water District
and an individual sewage disposal system that is sized for 6 people (SP-9800600).
There is one full time employee and the applicants may hire another employee in the
future. A shop and a greenhouse may also be built. The applicants provide free mulch
to the public as well as firewood. As the public comes to the site on a year round basis,
sanitary facilities are required. The application indicates they would prefer to use a
portable toilet as in the peak season there are 20 people per week and in the slow
• season 1 person per week who may come on the property.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
Policy 2.2.K Use of Portable Toilets
Purpose: To define when Portable Toilets may be used in lieu of a vault or
septic system.
Policy: Portable toilets may be utilized on sites for temporary and seasonal use
for up to six months as part of the Temporary Seasonal Permits issued by Weld
County Planning for situations such as fireworks stands, Christmas tree stands,
seasonal recreational facilities, etc.
As noted above, it is the policy of this department that portable toilets are allowed when
a use is temporary or seasonal for a time period of six months or less. As the business
is conducted year round the use of portable toilets is not allowed as the facility is not a
seasonal use.
A waste handling plan is required and should include the name, address and phone
number of the waste removal and disposal companies. The plan should indicate how

• any waste associated with the business such as minor maintenance items (equipment
fluids ect.) as well as trash are disposed of.
A dust abatement plan, for on-site dust, is required. The plan should include how mulch
will be contained so it will not blow onto neighboring properties. Control of dust from
vehicles entering and leaving the site shall also be addressed. Noise will be restricted
to the level allowed in the commercial zone district.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
• 1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
3. If the applicant intends to utilize the existing septic system, for employee and
public use, the septic system shall be reviewed by a Colorado Registered
Professional Engineer if the use of the system exceeds 6 people per day. The
review shall consist of observation of the system and a technical review
describing the systems ability to handle the proposed hydraulic load. The review
shall be submitted to the Environmental Health Services Division of the Weld
County Department of Public Health and Environment. In the event the system is
found to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.

• 4. Alternately to item #3 above, the applicant shall install an individual sewage
disposal system for employee and customer use and the system shall be
installed according to the Weld County Individual Sewage Disposal Regulations.
5. In the event washing of vehicles or equipment will occur on site the applicant
shall ensure that any vehicle or equipment washing areas shall capture all
effluent and prevent discharges from washing in accordance with the Rules and
Regulations of the Water Quality Control Commission, and the Environmental
Protection Agency. Washing areas should be designated on the plat.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
• 3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan" at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.

• 9. The facility shall utilize the existing public water supply. (Longs Peak Water
District)
10.The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
11.All pesticides, fertilizer, and other potentially hazardous chemicals must be
stored and handled in a safe manner in accordance with product labeling and in
a manner that minimizes the release of hazardous air pollutants (HAP's) and
volatile organic compounds (VOC's).
12.Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
