RE: Road Improvements & Maintenance Agreement for WCR 41.5/Balsam Avenue—Document # 850087

Dear Mr. Loloff:
Weld County has received numerous complaints from citizens in the immediate area of your Balsam
Avenue sand and gravel pit. The complaints concern excessive dust is being generated on-site, and by
haul trucks on Balsam Avenue utilizing the facility. Weld County staff members have performed site
observations to corroborate these complaints and have observed the following:
• Haul trucks traveling both north and south on Balsam Avenue to and from the Loloff pit
• Excessive dust being generated on Balsam Avenue by these haul trucks with no dust control measures
being implemented.
Per the agreement signed on 10/18/1985, that was recorded 10/30/1985, Weld County reminds you of
your obligation for road maintenance and improvements associated with the Loloff Pit (USR-690) located
on WCR 41.5/Balsam Avenue. In accordance with the terms and conditions of the Road Maintenance
Agreement (Document# 850087), Loloff Construction Inc., agreed to the following:
• The approved Haul route is from the pit entrance, south to the Greeley city limits.
• Dust control on the road from the time material is transported until road improvements are complete.
• Road improvements will be achieved when materials transported from the site average 400 tons/day.
(2009 Pit Production = 155,906 tons/365 days = 427.14 tons/day)
• Improvements will consist of 4"of HMA over 5"of Class "6"ABC.
Weld County has determined that the current operator (Richardson Consolidated, Inc.) of the Loloff Pit
(USR-690) is currently not observing the requirements of the Road Maintenance Agreement, as
mentioned above. In order to maintain an adequate healthy environment and safe driving conditions for
the general public, Weld County requests immediate compliance with the haul route and dust control
obligations mentioned above. Weld County requests that a written response from you and the pit
operator, be sent to the Weld County Public Works Department, indicating compliance will take place
immediately.
Weld County will also be contacting the pit operator to relay these concerns and requirements.

We contracted Richardson Consolidated Inc with the problems of the dust and the truck
traffic traveling north from the pit. They assured us that they would take immediate
action to comply with the requirements set forth in the Road Improvement and
