HomeMy WebLinkAbout20102394.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING PETITION FOR ABATEMENT OR REFUND OF TAXES - GABINO GUERRERO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, State of Colorado, at a duly and lawfully called regular meeting held on the 11th day of October, 2010, at which meeting there were present the following members: Chair Pro-Tem Barbara Kirkmeyer, and Commissioners Sean P. Conway, William F. Garcia, and David E. Long, with Chair Douglas Rademacher being excused, and WHEREAS, notice of such meeting and an opportunity to be present has been given to the taxpayer and the Assessor of said County, with said Assessor, Christopher Woodruff, being present, and taxpayer Gabino Guerrero, not being present, and WHEREAS, the Board of County Commissioners has carefully considered the attached petition, and is fully advised in relation thereto. The building has 6,480 square feet and was built in 1981 and has had several permits for remodeling. It is considered to be in average condition due to on-going maintenance. The building is mostly owner occupied with the retail space leased to supplement the mortgage. The owner is appealing the 2008 value of$388,800, to a value of$340,650. The owner's accountant helped file the abatement. I spoke with both the owner and accountant they did not relies the base period was 2005 and half of 2006. They had no bases for the requested adjustment. The subject sold,July 21, 2006 for$502,000. The sale included a liquor license. Comparative Sales Approach The subject is valued at$60.00 psf for 2008. I found three restaurant and retail sales ranging from $63.94 to $77.46 psf. Two of the sales are older sales and located in Fort Lupton and required adjustments. After adjustments and rounding the range was from$77 to $80 psf. Using the lower end of the range the subject market value is $498,960 or$77. Income Approach Lease rates in the Greeley area for restaurants are$11.50 to$13 NNN, retail rates on South 8`"Street average around$8 NNN. There are several other retail properties along Hwy 52 in Dacono. Specific rates were not given to the Assessor's office, however one owner indicate he was receiving rates ranging from $6 to $8 psf, after expenses during 2005 and half of 2006. During the base period of 2005 and half of 2006 retail vacancy was around 15%and cap rates were 8%. The indicated value from the income approach is$380,052 or$59 psf. Considering the subject is partially leased the most weight is given to the income approach.
