Owner or Authorized Agent / �jate ' PIPE `/-s-rO EXHIBIT 2010-2160 • • 1) Explain, in detail, the proposed use of the property. • Import Line receives used vehicles that are bought through online auctions%nd sells all functional parts of the vehicle to local auto shops, dealers, and walk-in customers. Import Line intends to use the vehicles immediately as they are received, and does not have plans to store vehicles on site. a) Once the vehicles are transported into the property, each vehicle is disassembled for its useable components such as, mirrors, doors, engines, transmissions, and interiors. b) Remaining vehicle parts and shells are scrapped at Rocky Mountain Recycling. c) Tires are taken to local tire yards, where they are either recycled or sold as used tires. d) Usable parts will be stored on racking shelves or inside the warehouse, which is located south of the main office. The yard is to be kept free of all parts. (See map attached for more details of land) e) Through interaction with consumers and a parts locating system, used parts are ordered by shops and individuals throughout the country. f) Parts are then either shipped or delivered to the recipients. g) In addition, Import Line sells an average of 3 motor vehicles a month 2) Explain how this proposal is consistent with the Weld County Code, Chapter 22 of the Comprehensive Plan. • Import Line, operating as a commercial business, strives to achieve the goal and • mission of Weld County Code, Chapter 22 of the Comprehensive Plan by adhering to the following objectives: a) To encourage the preservation of aesthetically and economically valuable views of the city by fencing around the parameter of the yard, creating anonymity for travelers on the highway, as well as for the surrounding businesses. The east facing entrance to the yard, directly lining Highway 85, is adorned with a red, metal, eight-foot fence, which is also used to guard the entrance to the yard. b) To promote the best use of land while protecting citizen's property rights. c) To promote economic development while protecting the environment, as well as the health and safety of citizens, by taking all necessary precautions to dispose of toxic auto fluids in a safe and effective way. d) In addition, Import Line avoids the placement of any materials outside the screened area. • Furthermore, Import Line takes pride in professionalism, customer satisfaction, and eco-friendly practices. At Import Line, used vehicles are put in the back to work in a variety of different ways, which benefits consumers, as well as the environment. Import Line strives to preserve and protect a visually clean appearance and other environmental amenities of the rural areas using the land strictly for its required purposes, to fully comply with the ordinances of Weld County. • • • • 3) Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. • Import Line is located in Zone District — I3 • Import Line, under the Amend Section 23-3-330 of Chapter 23, is categorized as an Industrial Use firm operating a "Salvage Yard", which is defined as an open area where used motor vehicles and vehicle parts are bought, sold, disassembled and handled. Import Line works rigorously to follow guidelines to ensure that the land is being used properly. The following describes the specific procedures in which the employees at Import Line are required to follow, in order to fully comply with the ordinances of Weld County: a. Motor Vehicles that are purchased from online auctions are towed into the screened area immediately. b. The vehicles are then dissembled and multiple components are removed such as, engines, transmissions, doors, and interiors. Each component is handled, recycled, and stored in a safe, effective way. c. Engine & Transmission Handling: • All engines and transmissions are transported to the main warehouse located south of the office and placed on a concrete surface to begin the draining process. • Oil, transmission fluid, coolant, antifreeze, brake fluid, and power • steering fluid are safely removed from engines and transmissions, then stored in secondary containment, 500 gallon composite barrels on site. • Once a month, the fluids are taken by a local hazardous liquid company called Safety Cleaning: In any case, if the barrels become full before a months period, Safety Cleaningis contacted to schedule an immediate pick up. • Gasoline is siphoned out of the used vehicles and stored in secondary containment; 500 gallon composite barrels for use in company delivery vehicles. • All engines and transmissions are then logged and stored on pallet racks in the main warehouse. d. All usable parts are stored on racking shelves in the main warehouse. The yard is to be kept free of all parts. e. Remaining parts and vehicle shells are scrapped at Rocky Mountain Recycling, and tires are either recycled or sold as used tires. • Import Line complies directly with the intent of Weld County by understanding the importance of protecting the environment, as well as human health, and takes all necessary precautions to dispose of all toxic fluids in a safe manner. • • 4) What type of uses surround the site (explain how the proposed use is consistent and compatible with surrounding land uses). • East of Import Line, there is an established Heavy Equipment Recycling Business called Tri County. • West of Import Line, there is an established Trucking Company called Baum Gardeners Trucking. • North of Import Line, there is an established Crane Company called M&A Trailers Manufacturing. • South of Import Line there is an established Concrete Plant called Ready Mix. • In addition, South of the Concrete Plant (Ready Mix) exists a company that MI `[ ex•tttracttsgravel from the earth and sells it to consumers. 5))V Describe w ��n detail the following: a. Highway 85 To Whom It May Concern: The following is our report for the evaluation of subject I. S. D. S. 1. The latest pumping receipt is attached. The tank is reported to be 1,000 gallon. This is meets the requirements for this application.. 2. We have found no record of any permit for subject system. The firm that pumped the system recorded the information used to • evaluate the system. The owner at the time of the installation is now deceased. 3. We have performed percolation tests in the vicinity of the field to evaluate the system. We stayed approximately 10' from the field to obtain, what we feel, are more representative data. The percolation rate for this area is 17.2" per inch. 4. The following criteria was used to evaluate this system: The facility consists of an office only. There are 5 employees working at this site. There are no public facilities at this site. Potable water,is brought into this facility. The well is used only for washing and flushing the toilet. Q = 5 employees X 20 gallon per day = 100 G. P. '/<, of Section 31, T. 1 N., R. 66 W. of the 6th P. M. The full legal description is included as Appendix 1 of this report. There are no major drainage ways in or near to this property. The South Platte river is approximately %2 mile West of the west line of this property. The property is located in Weld County and is not adjacent to any named developments. To the South of the property is a small lake that appears to be the remains of a gravel mining operation. To the East is Highway It 85, To the West is a warehouse development and a Ready Mix Concrete Plant. To the North is more small warehouses and offices for small businesses. DESCRIPTION OF IMPROVEMENTS The proposed use for this parcel is as an Auto Salvage Yard. The parcel is • currently covered with gravel and two buildings. We are not proposing any additional improvements at this time. DESCRIPTION OF THE PROPERTY The property consists of 197,264.65 S. F. (4.53 Acres). The drainage on the property is generally to the Northwest. We are proposing to provide a pond, as required, in the vicinity of the Northwest corner of the property. The water from the pond will be released onto the property to the West at the allowable rates in accordance with Weld County Regulations. There are no irrigation facilities located on or adjacent to the property. This parcel is located at the peak of the drainage for this area. The lake at the south of the property is approximately 7 feet below this property so there appears to be no groundwater concerns for the proposed use of this property. H. DRAINAGE BASINS AND SURBASINS Major Drainage way, this parcel is located in the South Platte drainage basin. This parcel falls in Zone C floodplain per FIRM, Flood Insurance Rate Map,map number 080266 0995 C, map revised date September 28, 1982). An 8 %2"X 11" • portion of this map showing the property is included in appendix 2 of this report. • Local Drainage, this property is configured such that most of the property is draining to the Northwest and discharging in a sheet manner onto the property to the West. A small portion of this parcel drains into the U. S. Highway 11 85 on the Easterly side of the parcel. We have included the total parcel area in our calculations for detention requirements at the Northwest corner of the parcel. III. DRAINAGE DESIGN CRITERIA This drainage report was prepared in accordance with the Urban Drainage and Flood Control District, Drainage Criteria Manuals as amended by Weld County. The rational Method was used to determine the peak runoff for both the 10 and 100 year storm recurrence interval. Detention volume requirements were determined using the equation: V= KA (SO-1) Where:V = Required Volume, Acre Feet. • • K=coefficient, function of the design storm. A = Drainage Area in Acres. Detention Release rates are based on analysis of the historical runoff of the 5 year storm using the formula Q=C IA IV DRAINAGE FACILITY DESIGN General Concepts: The design concept for this site is to provide a detention pond to accommodate the required detention volumes. The storm flow will be collected into the pond via surface flow. The outfall is controlled to provide for the allowable release rates. This release will be to the property to the West at a location mutually agreeable to both owners. Due to the nature of the proposed use of this property we are proposing to install a sand trap and an oil separator to assure that the water discharged to the neighbor will be clean. We are proposing that this installation will replace the need for Water Quality Control Volume for the detention pond. • 2. • SPECIFIC DETAILS: Drainage swales and Inlet/Pipe System; Runoff is conveyed through the property as shown on the Grading and Drainage Plan. Swales are formed at required locations by onsite grading to direct flows to the detention pond. Detention: Based on developed impervious area of 48% for the developed property the required detention volumes are 8,623 cu. ft. for the 10 year storm and 16,755 cu. 11. for the 100 year storm. Allowable Release Rates: Based on the historical 5 year storm event falling on the historic, undeveloped site with 2% impervious for the entire site. Q =C IA C =0.16 from Table RO—5 A =4.53 Acres I = 1.9iph Q= 0.16 X 1.9 X 4.53 = 1.377 cfs. We are proposing to control the release rate for this project with the use of a sand trap and an oil separator. The separator will be sized to release the water from the pond at the allowable rate for the historic 5 year storm ( 1.38 c. f. s.). As shown on the plan the pump will be sized to pump the 1.38 c. f. s. (620 G.P. M.)and • discharge it onto the property to the West. We will meet with the owner to the 4. • West to determine the exact location and geometry of the discharge facility prior to preparing the final drainage plan. The 24 hour 100 year flow into the pond area is 78,931 C. F. This was derived as follows: 4.8"= 0.40' 0.40 X 4.53 acres X 43,560 C. F. =78,931. The pump pumping at 1.377 c. f. s. is equal to 118,972 C. F. in 24 hours calculated as follows: 1.377 X 60 seconds X 60 minutes X 24 hours= 118,972 C. F. This will give us adequate storage for the 100 year 24 hour storm. We are providing enough storage in the pond to accommodate the high initial runoff that will occur in the event of a 100 year storm and still provide 1' of freeboard. Erosion Control: Erosion shall be controlled by use of resurfacing for all areas that are disturbed. Either with gravel or recycled material. The resurfacing will take place as soon as practical to alleviate any erosion problems. During construction erosion control Best Management Practices consisting of silt fences, straw or hay bale barriers shall be utilized on an as needed basis. • Maintenance Costs: We have reviewed the annual maintenance of the submitted plan and determined that this design will require no more than cleaning the sand trap and the separator,as required, and annual checks of the system and possibly some minor maintenance of the discharge facility. We have estimated that,at to- days costs,the annual maintenance cost to the owner will be approximately $ 1,000.00 per year. The oil cleaned from the separator will be disposed of as required through a recycling company. V. CONCLUSIONS: This proposed drainage plan meets the minimum requirements of the Weld County Amendments to the UDFCD Manuals and the UDFCD Manuals. Onsite detention and the sand/oil separator system will reduce the developed runoff rate to allowable rates established by the criteria and state law. Email address: importlineauto@yahoo.com. The owner is Andy Chau Le. The position of the facility in legal terms is as follows: Located at the southwest corner of U.S. Highway# 85 and W. C. R. #4. It is in the N. W. '/, of Section 31, T. 1 N., R. 66 W. of the 6th P. M. The approximate center of Import Line Auto in longitude and latitude is: Longitude 40 degrees, 1 minute, 18 seconds West and Latitude 104 degrees, 49 minutes, 5 seconds North. • Import Line Auto compromises of approximately five acres of land. The facility has an inventory of approximately 200 vehicles and processes about 200 units each year. About one half of the facility is devoted to processed or staged vehicles and one half is devoted to the storage of reusable parts. 100 of the total of 200 vehicles are trucks and the rest are cars. The current warehouse facility keeps parts out of the weather and provides a fence around the perimeter of the facility. No battery reconditioning is done at this facility. In order to run the organization effectively, we believe that it must fully comply with ordinances of Weld County. Explanation of Topographical Map The topographical map is part of Section 20, Township 1 North, Range 66 West of the 6th principle Meridian located in Weld County, Colorado. 2. Comprehensive inspections of all discharge sites and all storm water related improvements shall be conducted. These inspections shall be dated and all findings shall be documented on an inspection form. The inspections shall take place during our quarterly inspections of population sources. 3. Hazardous Materials and How They are Handled a. Gasoline and Diesel Fuel Fuels are pumped out of all vehicles in the shop whrn they are • staged. Diesel fuel is recycled in our tractors and gasoline is recycled in our other yard equipment. Demand is greater than the supply, hence fuel storage is never more than 50 (fifty) gallons. b. Used Motor Oil and Transmission Lubricants Used motor oil and transmission fluid from and engines and transmissions is drained inside of the shop and deposited in a waste oil heater tank. The waste oil heater is EPA approved. Excess fuel is stored in sealed and labeled 55-gallon drums. The drums are placed in a concrete building with six-inch concrete beams on each open end. • 6 c. Antifreeze • All antifreeze is drained inside of the shop, stores in sealed and labeled 55 gallon drums, and resold after all the foreign materials have settled or separated. d. Batteries Used batteries are stored inside of the shop and resold. Discharged batteries are sold to a licensed battery manufacturer. Discharged batteries are stored in a plastic container with a lid. e. Brake Fluid Brake fluid is drained in the shop and deposited in the waste oil heater, which is capable of burning brake fluid in small amounts. f. Freon • All auto air conditioning systems are discharged with an approved evacuation and cleaning system. Used Freon is sold to Air Conditioning Certified shops. g. Parts Washer Solvents and Residues Our parts washer uses a biodegradable solvent. The filters are deposited in a landfill. h. Herbicides We use approximately two gallons of Roundup per year. We apply with a hand sprayer to individual thistles and a few other obnoxious weeds. All the recommendations on the label are • 7 followed and all handling utensils as well as the Roundup are • stored inside. i. Windshield washer fluid is siphoned out of all vehicles and used in our vehicles. 4. Solutions to Materials Exposed to Storm Water. a. Over two hundred vehicles are stored on the site. During the stage process, engines and transmissions are removed and drained. The stage process also includes the removal of fuel, antifreeze, batteries,brake fluid, Freon, and wish shield washer fluid. b. Reusable auto parts stored outside create harmful pollution problems. All loose auto parts are stored in racks or on pallets in • the warehouse facility. c. Suspension components stored outside may be greasy but storms have little effect in washing off the grease. All loose suspension components are stored on racks or on pallets. • 8 • 5. Spill Prevention and Response Program All pills, no matter how insignificant are cleaned up immediately. All bays are swept daily and heavily used concrete slabs are swept at least once a week. Vehicles are kept in good working order. Faulty seals and hoses are repaired immediately. Vehicles are maintained inside the shop to further reduce possible storm water contamination. We have a permanent home for shovels near the shop. Fifty-five gallon drums as well as five gallon buckets are readily accessible. 3M oil • absorbent pads are stored inside the shop. Professional clean-up personnel use this same material in major oil spills. The used pads are deposited in a sealed drum to be picked for recycling. Local Fire Department: In case of a hazardous spill the local fire departments hazardous material team may be helpful. • 10 6. Employee Training • All new employees are given a full written job description when they are hired. The Pollution Prevention Plan has become an integral part of our policy and is addressed to them on their first day of employment at Import Line Auto. An employee who is familiar with all company policies trains new employees. This training lasts from one to two weeks. The new employee works one on one with a fully trained employee. All members of the pollution prevention team are full time employees and keep a watchful eye on new employees, giving environmental housekeeping pointers to new as well as established personnel. Frequent company meetings held allow our pollution prevention • team to give helpful hints, and "pats on the back," when all employees are present. We have two or three meeting a year. • 11 7. Storm Water Controls • During all storm events, 3M oil absorbent pads are placed in the ditch near the southeast corner of the shop. This concrete ditch drains the work area on the south side of the shop. The pads are placed in the ditch in such way that they float on the surface of the escaping water.
