HomeMy WebLinkAbout20101424.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING CONCERNING PROVISION OF PUBLIC HEALTH SUPPORT AND AUTHORIZE CHAIR TO SIGN - WELD COUNTY JUVENILE ASSESSMENT CENTER, DBA YOUTH AND FAMILY CONNECTIONS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding Concerning the Provision of Public Health Support between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Department of Public Health and Environment, and the Weld County Juvenile Assessment Center, dba Youth and Family Connections commencing July 1, 2010, and ending June 30, 2011, with further terms and conditions being as stated in said memorandum, and WHEREAS, after review, the Board deems it advisable to approve said Memorandum of Understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding Concerning the Provision of Public Health Support between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Department of Public Health and Environment, and the Weld County Juvenile Assessment Center, dba Youth and Family Connections, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Memorandum of Understanding. Long Date of signature: p1 lack OYi 1-0 mkt G. - SAS \-k 2010-1424 9UI1 i CL . t1L TG HL0037 10 Dt, lD MEMORANDUM OF UNDERSTANDING CONCERNING THE PROVISION OF PUBLIC HEALTH SUPPORT The Weld County Juvenile Assessment Center, D.B.A. Youth and Family Connections ("YFC"), and the Weld County Department of Public Health and Environment, by and through the Weld County Board of County Commissioners for Weld County, State of Colorado ("WCDPHE"),hereby enter into this Memorandum of Understanding ("MOU") and agree as follows: 1. The YFC is a collaborative multi-agency, single entry site which contributes to the safety of youth, families and the community through prevention, intervention, comprehensive assessments and improved access to services. 2. The WCDPHE is a partner agency with the YFC in this community-wide endeavor, and as such, has agreed to provide staffing support in a .5 FTE Public Health Nurse for the YFC facility. The .5 FTE will be the employee of WCDPHE. WCDPHE will be responsible for its employee's pay, benefits and other compensation and any specialized equipment or resources to access WCDPHE related data base/case management systems, as necessary. 3. The YFC will provide funding to WCDPHE from grant monies provided to the YFC, to cover the cost of the .5 FTE Public Health Nurse, such funding not to exceed a total amount of$35,551 during the term of this MOU. 4. The YFC will provide WCDPHE personnel assigned to the YFC: a safe work site, a suitable work station area, general office supplies, access to general office equipment, to include a computer with Internet access, telephone, fax machine and photo copier; training and use of YFC protocols for the assessment, referral and case management of persons receiving services through the YFC, as may be relevant to the .5 Public Health Nurse duties; daily work assignments and functional supervision. 5. The WCDPHE will provide the YFC: a. A WCDPHE supervisor who will provide the direct supervision of WCDPHE personnel and liaison to the YFC for purposes of communication, problem solving and coordination. b. A .5 FTE Public Health Nurse hired and supervised by WCDPHE to be available as a liaison with services through WCDPHE and assist with compiling statistical data on project outcomes and reports. c. The Public Health Nurse will provide pregnancy prevention education to all case managers from each partner agency, and assist the Coordinator/Case Manager with needs assessments and recommendations for direct service needs. d. Youth identified as teen parents, pregnant teens and those who are sexually active will be presented with pregnancy prevention education/materials or specific Page 1 of 4 t o1Q— /41211 services deemed supportive to their remaining in school, complying with existing court orders or maintaining employment while ensuring their infant child, if applicable, is receiving necessary food, shelter,health care, and supervision. e. Quarterly reimbursement claims will be submitted to YFC from WCDPHE which include a time sheet setting forth the hours worked by the .5 Public Health Nurse performing duties for the YFC pursuant to this MOU. Upon receipt of the claim, the YFC will pay the amount of the claim to WCDPHE, subject to the limitation set forth in paragraph 3 of this MOU. 6. The YFC will provide work schedules for WCDPHE personnel assigned to the YFC which will be agreed upon jointly by the WCDPHE supervisor and the YFC Director, subject to change by mutual agreement and based on the needs of both organizations. 7. The YFC will provide and be responsible for the cost of any translation services necessary for non-English speaking clients. 8. The YFC Director will provide an assessment of the performance of the .5 Public Health Nurse to WCDPHE for the use of WCDPHE every six (6) months. The assessment will include YFC comments regarding job performance as it relates to the duties set forth in paragraph 5. 9. Policy/Protocol Conflicts- In the event WCDPHE personnel assigned to the YFC encounter a policy or protocol that conflicts with WCDPHE policy, the WCDPHE employee will report the conflict to the YFC Director and his or her WCDPHE supervisor. The YFC Director and WCDPHE supervisor will review the issue and resolve it in a mutually agreeable manner. 10. Confidentiality- Information sharing is a key component to the success of evaluating the needs of YFC clients, delivering integrated services and reducing the duplication of services by partner agencies. To further this endeavor, WCDPHE and YFC will share information on YFC clients contained in their respective data base systems, as permitted by law and with a written Release of Information form that is HIPAA compliant and signed by a parent/legal guardian of the juvenile client. All information obtained through this manner is confidential and may not be disseminated to the public or released outside the YFC, unless such further release is authorized by written consent of the juvenile client's parent/legal guardian. 11. Liability- The WCDPHE and YFC acknowledge that applicable Colorado state laws govern liability for negligent or wrongful acts or omissions committed by its employees while participating in activities under this MOU. Liability for negligent or willful acts of personnel from either WCDPHE or YFC, undertaken outside the terms of this employment, will be the sole responsibility of the respective employee and the employee's agency. Notwithstanding any other provision contained herein, no party to this MOU waives any immunities to which the party may be entitled, pursuant to law. Page 2 of 4 12. Duration- The term of this MOU is from July 1, 2010 through June 30, 2011. Either party may sooner terminate this MOU by providing at least 30 days prior written notice to the other party of the terminating party's intent to terminate. 13. Modification- This MOU may be modified at any time by mutual consent of both participating agencies. Modifications to this MOU shall have no force or effect until such modifications are in writing and signed by authorized representatives of each participating agency. 14. No portion of this MOU shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may possess, nor shall any portion of this MOU be deemed to have created a duty of care which did not previously exist with respect to any person not a party to this MOU. 16. It is expressly understood and agreed that the enforcement of the terms and conditions of this MOU, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any claim or right of action whatsoever by any other person not included in this MOU. It is the express intention of the undersigned parties that any individual or entity other than the undersigned parties receiving services or benefits under this MOU shall be an incidental beneficiary only. 17. Participating Agency Signatures- By signing this Memorandum of Understanding, each agency agrees to be bound by the conditions set forth herein. The term of the MOU is for 7/1/2010 through 6/30/2010. The funding amount is This MOU provides for a .5 Public Health Nurse to educate YFC case managers in regard to pregnancy prevention, and pregnancy and parenting issues for at risk youth who are admitted to the YFC. The program provides for direct support services and education designed to support and nurture positive infant care, enhance parenting skills, reduce the potential for additional pregnancies and promote self sufficiency for young parents. Pregnant teens and teen parents will receive referrals and services supportive to their remaining in school, complying with court orders or maintaining employment while ensuring their infant child, if applicable, is receiving necessary food, shelter, health care, and supervision. Funding for these services was awarded to the Juvenile Assessment Center dba Youth and Family Connections through the Colorado Strategic Statewide Use Fund out of the Department of Human Services. The only changes are to the name (JAC dba Youth and Family connections, ) , the dates of the agreement, and the funding amount. I read through the summary of the program, and could not figure out the new funding amount. I asked Judy Nero to send an email to you and me with the new funding amount. It goes in paragraph 3.
