HomeMy WebLinkAbout20101665.tiff 943 RESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF COUNTY ROAD 26 TO THE EAST OF THE INTERSECTION OF COUNTY ROADS 26 AND 21.5- MULTIPLE PETITIONERS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Road Petitions from Daisy Kiyota, 11964 County Road 21.5, Fort Lupton, Colorado 80621; Howard Kiyota, 12012 County Road 21.5, Fort Lupton, Colorado 80621; Golden Dome Aggregates, LLC, c/o Brian Dominic/Larry Clark,619 North Cascade Avenue, Suite 200, Colorado Springs, Colorado 80903; and Donald and Shirley Ann Kanzler, 11528 County Road 23, Fort Lupton, Colorado 80621, copies of said petitions being attached hereto and included by reference, requesting vacation of a portion of right-of-way for County Road 26 to the east of the intersection of County Roads 26 and 21.5, being more fully described as follows: The public road right-of-way lying 30 feet south of the north section line of the NE1/4 of Section 2, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado. WHEREAS, the County Attorney's Office and Departments of Public Works have recommended approval of said request since that portion of right-of-way is not needed for the safety and welfare of the traveling public, and WHEREAS, any persons owning dedicated and recorded easements and rights-of-way for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by Weld County, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion of road right-of-way, with said vacation to become effective upon recording as required below. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Road Petitions from Daisy Kiyota, Howard Kiyota, Golden Dome Aggregates, LLC, and Shirley and Donald Kanzler be, and hereby are, accepted. This will require the vacation of the right-of-way for a portion of-WCR 26. The Weld County Planning Department stated that the amendment to Lot B of RE-4153 will not be approved unless the right-of-way of WCR 26 is vacated. The Weld County Public Works would support petition to vacate any county rights-of-way identified in the petition. The extension of WCR 26 at this location is not feasible due to the existing structures encroaching the right-of-way, canal crossing, flood plain issues crossing the South Platte River, and the new connection to U. S. Highway 85. No parcels would be land-locked by approving the petition. All adjacent property owners have signed the petition for vacating. No additional buildings will be constructed in the flood plain without the appropriate flood hazard development permits. They have each been executed by the appropriate land owner(s) of the properties adjacent to the right-of-way for the portion of WCR 26 we are petitioning to be vacated in the NE 'A of Section 2, Township 2 North, Range 67 West. Michelle Martin at Weld County Planning stated that the Amendment to Lot B of RE4153 will not be approved unless the paper right of way for County Road 26 is vacated. We have met with Jackie Hernandez at Weld County Public Works regarding this issue. She stated there is a paper right of way for County Road 26 from the 1889 Resolution. She believes there should not be any issues for vacating the paper right of way, shown on the attached map. The specifics are: The existing Weld County Road 26 comes to a physical dead-end at its intersection with Weld County Road 21 A but the County has a recorded Right-of-Way to continue Weld County Road 26 to the east. We are seeking vacation of the ROW for WCR 26 to the east of that intersection of WCR 26 and WCR 21 A ,that runs 30 feet south of the north section line of Section 2. It is needed to facilitate our planned amendment to the existing Recorded Exemption 4153. 1 Ir your meeting you provided Lisa with the appropriate forms to be completed by all property owners whose land is adjacent to the existing right-of way. It has taken some time but I believe we now have all owners in agreement. As we move forward with this request, can you let me know: A) Are there fees we need to pay when we file the Petition to Vacate? B) Do we address our request to you or some other individual at Public Works? C) Do we schedule County Commissioner meetings, or does Public Works do that?
