WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 13th day of June, 1977, at the hour of 9 : 00 o'clock a.m. , for the purpose of hearing the application of Edward Hesslink, for the granting of a Conditional Use Permit for a boarding stable for horses on the following described real estate, to-wit: A tract of land in the Northeast Quarter (NE1) of the Southeast Quarter (SEa) , Section 10, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, more particularly described as follows : Beginning at a point on the North Line of said Southeast Quarter (SEa) of Section 10 , said point of beginning being the Northeast corner of that tract of land described in deed recorded in Book 73 at Page 384 of the records of the Weld County Recorder: Thence South 89°53 ' 30" East, a distance of 178. 03 feet to the point of beginning of Parcel 2 : Thence South 89°53 ' 30" East a distance of 327.25 feet; Thence South 00°01 ' 34" West a distance of 1318. 83 feet; Thence North 89°50 ' 42" West a distance of 333. 41 feet; Thence North 00°17 ' 38" East a distance of 1318 . 57 feet to the Point of Beginning of Parcel 2 . Parcel contains 10. 000 acres , more or less, including public road rights-of-way. Basis of bearings in the above description is the North line of the Southeast Quarter (SEa) of Section 10 , taken to be South 89°53' 30" East. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the grant of the Conditional Use Permit for a boarding stable for horses on the above described real estate, and WHEREAS, Section 3. 3. (E) . (4) (d) of the Weld County Zoning Resolution authorizes such a use in an Agricultural District on 91-65a9 770162 the grant of a Conditional Use Permit by the Board of County Com- missioners, and WHEREAS, the Board of County Commissioners of Weld County heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed and satisfied that the request for a Conditional Use Permit for a boarding stable for horses on the hereinabove described real estate, complies with all of the conditions as set out in Section 3. 3. (E) . (4) (d) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com- missioners of Weld County, Colorado, that the application of Edward Hesslink, 2460 East 16th Street, Greeley, Colorado 80631, for a Conditional Use Permit for a boarding stable for horses on the hereinabove described tract of land be and hereby is, granted subject to the Development Standards contained in the Conditional Use Permit. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 13th day of June, A.D. , 1977. The permitted uses on the hereon described parcel of land shall be the facilities as shown for a horse boarding stable and a mobile home to be utilized as a residence for the manager of the stables. The facility is designed and approved only as a boarding stable; it is not to be utilized as a riding stable, horse training center, or for any type of rodeo activities. 2. The Conditional Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust , and the growth of noxious weeds. 3. As recommended by the Army Corps of Engineers and the Colorado Water Conservation Board, the mobile home must be installed at an elevation 4615.6 feet above MSL. 4. The Conditional Use Permit shall be limited to the plans as shown hereon and governed by the development standards stated above and all applicable Weld County regulations. Any change to the plans and or the development standards shall require the approval of another Conditional Use Permit before such changes shall be permitted. Box 758 Greeley, Colorado 80631 Conditional Use Permit Development Standards We have applied for the above mentioned permit for several reasons. First, we bought our place "on contract" in 1974, with five years to obtain refinancing. We cannot get financing, unless we have more income than we do at the present time, With the stables we want to build, our income would be more, but we need help in the operation and up keep. Our son, Vern and his family will live in the mobile home, and he will manage the stables. In the refinancing, Vern and his wife, Jo Ann will be joint owners of the property. The mobile home will be moved to the property, with sewer system constructed in compliance with Soil Conservation and Weld County Health Department specification and recom- mendations, sized to accommodate a new hone to be built in the future. In regard to the purposed stables. 'fie now have ten horses, that were on pasture here last summer, the owners, when ask to move them, said they could find no place to go with them. We do not have proper care facilities, so basicilly we will be up grading as well as enlarging on our stable enterprise. . There is a demand for better horse care facilities in this ares. /The stables will consist of a pole barn, opening to the south, with approximately 30' runs, constructed of wood and chain linked fence, leaving about seven acres of permanete pasture. Manure from the stables will be cleaned our when needed and spread on the pasture. The stables are strickly for boarding horses. It will not be used. for a riding stable, nor for any type of Rodeo practing or activities. People who board their horses here, will have the right to groom their animals on the place. They will not ride on our place as there is no room. There are many horses in this area, and the roads have signs now indication horse back riding aera. U . D . The Planning Commission found no problems with the requested Conditional Use Permit for boarding stables . They recommended approval contingent upon adequate provision for flood proofing . In reviewing actions requested for the Commercial Unit Development located west of 59th Avenue on 10th Street , the Planning Commission considered staff concerns related to uses permitted, highway access , frontage roads , pedestrian circulation , and landscaping . [t was understood by the Commission that permitted uses would be similar in nature to uses by right in the City ' s C- 1 , C- 2 , C- 3 and C- 4 commercial districts . The Planning Commission voted to recommend approval of the proposed C .U . D. and site plan while stipulating the following conditions : 1 . Provisions be made for pedestrian movement from the west end of Lot B to the east boundary of Lot A 2. As stipulated in the unit development standards , require 15% landscaping in the site plan The Planning Commission also discussed the problems of access and the necessity of a frontage road . They recommend a limitation of two highway accesses as stipulated in the document . The site in question is located in an old oxbow of the Cache la Poudre River. 2. The site is located in the outer limits of the 100-year floodplain as delineated on plate 6 of the Corps of Engineers, Volume II, Floodplain Information Report. 3. I have determined the 100-year flood elevation to be 4614 MSL. 4. From the Greeley Quad, scale 1" = 2000 ' with 10 ' contours, and spot elevations in the area, I estimated that the area would be inundated to a depth of about 2 feet. 5. I would recommend a first floor protective and low opening elevation of 4615 MSL, which would be approximately 3 feet above the existing ground, assuming an elevation of 4612 at the building site. We concur that the site is in a backwater area which is not important for conveying floodflows. The 100-year flood elevation applicable to the site would be 4613.6 feet mean sea level. As you know, the Federal Insurance Administration is determining a floodway on the Cache la Poudre which will be based on a 1 foot rise in the 100-year water surface. The 100-year flood would then be 4614.6. Some communities are requiring facilities to be con- structed 1 foot above the floodway elevation. Economic analyses usually show that the average annual flood damages decrease significantly by the additional 1 foot rise. Insurance rates also become very low, as shown by the inclosure, at two feet above the base flood elevation which in this case would be 4613.6. We are not sure whether this stream reach would be in the Al-AT or A8-A14 zone. In short, our recommendation would be to construct to 4614.6 as a minimum and preferably to elevation 4615.6. Flood proofing is usually required only for structures for human habitation or for facilities which would suffer extreme monetary loss. The barn would probably not have to be flood proofed. We do not know if there would be any local drainage problems. The quad- rangle map indicates a marshy zone through the old channel on the outer perimeter of the area. Post Office and Court House Omaha, Nebraska 68102 Re: Floodplain Development The attached data is in reference to a proposal to construct a horse barn and residence on property located east of Greeley, Colorado. A copy of the property survey is attached, however, no elevations are displayed on the plat. I have also included a copy of Plate 6 Flood Plain Information, Cache la Poudre River, Colorado, Volume II, Greeley, Weld County, March 1974. On the copy on Plate 6, I marked the approxi- mate boundary of the property in question and the locations of the buildings to the best of may knowledge. This request is to secure the necessary technical assistance to aid our decision making process in Weld County. To study the map, it would appear the requested improvements would be located within the 100 year flood plain. Part of the property does appear to be in the Standard Project Flood area. After site inspection, it would seem that the property would he considered on the fringe of the flood plain and more particularly be in a back water area. From evaluation of available contour maps, I have estimated that there may be a potential of six to twelve inches of standing water on the subject property during a 100 year storm. If this is so and if the property is in the fringe area and therefore would not appear to encroach the movement of the flood, it would appear reasonable to allow development so long as the applicant floodproofed or elevated the main floors of the structures to the baseline of the 100 year occurance eleva- tion at that location. If so, I would desire to know such elevations. I would hope there is adequate information attached to allow a review of this request. I would hope this response can receive as prompt attention as is feasible so I may respond to the applicant at an early date regarding his proposal. Hess link 2460 E 16th St. Greeley, CO 80631 This letter is in reply to your request for soils information and its limitations for a mobile home site and septic tank filter field. The soils on the proposed site are Aquolls and Aquents with a gravelly substratum. These nearly level soils are on bottom lands and flood plains of all major streams in the Weld County area. The Aquolls, which have dark colored surface layers , make up about 657. of the map- ping unit. The Aquents, which have lighter colored surface layers, make up about 25%. The remaining 10% is made up of flooded sandy loam soils. These soils are deep, poorly drained soils. Typically they have mottled, mildly to moderately alkaline, loamy or dlayey surface layers and underlying material, and are underlain by sand or sand and gravel within 48 inches. They may or may not have a gleyed (blue and grey coloration from chemical activity) layer in the underlying material. Most of these soils are subject to flooding. A watertable is at or near the surface early in the spring and recedes to as deep as 48 inches by late fall:in some years. These soils have severe limitations for most uses. Uses such as shallow excavations, dwellings with basements , mobile home sites and septic tank filter fields have severe limitations due to the high water table and high frost action potential. However, these uses are feasible with proper planning4engineering. An on-site investigation is highly recom- mended as is a percolation test of the soil.
