HomeMy WebLinkAbout20102655.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000110 AGAINST JOHN AND RUTH HERNANDEZ FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, John and Ruth Hernandez, ZCV #1000110, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of November, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, John Hernandez, property owner was present at said hearing and provided testimony, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until February 9, 2011, to allow adequate time for the property owner(s) to bring the subject property into compliance by restoring the property to its original condition or by completing the necessary screening on the site. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #1000110 be, and hereby is, referred to the Weld County Attorney's Office for legal action against John and Ruth Hernandez to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until February 9, 2011, to allow adequate time for the property owner(s) to bring the subject property into compliance by restoring the property to its original condition or by completing the necessary screening on the site. He said his daughter just went through a foreclosure and had to remove all of her things really quickly, so he just brought everything to his place. He said he anticipated being able to have the property clean within a month. I told him that my initial letter was scheduled to expire tomorrow, so tomorrow I would be sending out a new letter that grants 30 days to bring the property into compliance. He said that should be pretty close. He said he just wanted to call and let me know that he is working on it and it really wasn't by choice.
