RESOLUTION
RE: RECORDED EXEMPTION NO. 254 - NORMAN BOLL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting held
on the 11th day of April, 1977, in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Norman Boll, Weld County,
Colorado, more particularly described as follows :
A tract of land in the NEq of Sec 13 T3N R68W
6th P.M. Weld County, Colorado
Beginning at the E4 Cor. of said Sec. 13 and
considering the East line of the NWa of said Sec.
13 to bear N 0°46 ' 53" E, with all bearings here
in relative thereto, thence along the following
courses:
S 89°54 ' 16" SW 450. 00 feet to a point thence
N 48° 40' 13. 5" W 2004. 05 feet to a point thence
S 89°44 ' 26" W 700 .00 feet to a point on the N-S
centerline of said Sec. 13 thence
N 0°40 '27"E 1324. 05 feet to the No Cor of Sec. 13
thence N 89°34 ' 34" E along the North Boundary of
Sec. 13, 2675. 69 feet to the NE Cor. of said Sec 13
thence S 0°46 ' 53" W along the East boundary of
Sec 13, 2663. 54 feet, more or less to the point of
beginning.
Said tract subject to existing road right-of-ways
contains 114. 862 acres.
does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-
28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land from
the definition of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove des-
cribed parcel of land owned by Norman Boll, be exempt from the
definition of the terms, "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS

RE : Recorded Exemption 254
Dear Commissioners:
The attached application, plat , and related materials
are in reference to a request by Norman Boll for a
recorded exemption. The parcel of land is described
as part of the NE* of Section 13, T3N, R68W of the
Gth P.M. , Weld County, Colorado. Said property is
located 21 miles east of Mead. The subject property
contains 114. 862 acres of Class II , III , and IV irri-
gated soils. The request is to split the property
into parcels of 114. 10 acres and . 762 acres. Each
of the two resulting parcels would contain an existing
set of improvements. Based upon the information sub-
mitted and the adopted policies in the County, the
Planning Commission staff recommends the request be
approved for the following reasons :
1. The Town of Mead Planning Commission has indicated
the Town of Mead has no objections to the granting
of this request .
2. The proposed split conforms with the intent clause
of the recorded exemption procedure (Section 9-2 of
the Weld County Subdivision Regulations) , the intent
clause of the agricultural district (Section 3. 3 A of
Board of County Commissioners
April 11, 1977

Weld County Zoning Resolution) , and the Weld County
Comprehensive Plan in that each resulting parcel
would have an existing set of improvements and the
use would be compatible with the surrounding agri-
cultural uses.
The Planning Commission staff recommendation for approval is
conditional upon either the lot size of Lot B being increased
to a minimum of one acre as required in Section 9-4 (A) (7) of
the Weld County Subdivision Regulations or the applicant
obtaining approval from the Board of Adjustment for a variance
from the above referenced section of the Weld County Subdivision
Regulations.

town in Weld County, it is our policy to refer the request to

I Norman A. Boll purchased the NE4 Sec. 13 T 3 P 68 on the first day of January
1957. On the first day of January 1962 I purchased an additional 90 acres joining
the south of the above mentioned z Se.
The winter of 1963 and 1964 I had a house built for my son and farming partner
on lot B as shown on the inclosed survey.
The fall of 1975 the Public Service Company Of Colorado approached me about
purchasing land from me to erect the now present Thomas Reservoir needed to
store water for the operation of the St. Vrain Nuclear Plant.
Since they had previously purchased part of the adjoining reservoir site a few
years before they approached me it seemned futile for me to refuse selling to the
Public Service Company because they had the right to condemn my property if they
so chose. On March 18th of 1976 I then sold 13". acres to the Public Service Company.
My problem at present is; the farm now consits of only 114 acres and it is not
feasible to have 2 homes on such a small farm, because I am ready to retire I
would like to request your permission to sell the home on lot B since it is
located above the irregation ditch on a piece of dry land.

This home has three bedrooms, kitchen, bath, living room, family room with a
fireplace all on the main floor. There is a full basement improved with bedrooms,
