RE: Building Permit as related to farm buildings.
Question- What buildings are required to have building permits within the
County of Weld?
Opinion - It is the opinion of this office that all buildings, structures, dwell-
ings or residences, no matter where located within the County of
Weld, that it is necessary to have a building permit before such
structure, dwelling, building or residence is remodeled, reconstructed
originally constructed, or otherwise worked upon in a major fashion,
must have a building permit, EXCEPT those excluded specifically
by statute. The exclusion is as follows: those buildings or structures
used for the sole purpose of providing shelter for agricultural im-
plements, farm products, livestock, or poultry. With this in mind,
it is the opinion of this office that any building which is used for
more purposes than those enumerated, such as building designed
as a tool or work shed which also houses agricultural implements
is also required to have a building permit. It is the opinion of this
office that the exception contained in the statute is a very narrow
one and designed merely to remove from the requirement for build-
ing permits those buildings which do not customarily have people
within their walls for more than brief periods of time. Therefore,
should the building department come across buildings which in their
opinion would have people contained within their boundaries, such
as a large egg producing building, where large amounts of machinery
and people work for extensive periods of time during the day or other
hours, that such a building is not within the exception of the statute,
and therefore needs a building permit. It is not enough that a build-
ing be useful or necessary for the agricultural business for which
it is being designed and built to exempt it from the requirement of
a building permit. The statute only covers certain building structures
and does not include all nature of agricultural buildings as such. It
would be of perhaps the best policy to continue to require all builders
to obtain building permits, and those that can be determined from the
application or from the contact with the builder,should the building
permit not be obtained in advance as may from time to time happen,
that it lies within the exception no further proceedings should be
taken. However, if the building is determined from the appliation
before the money is taken, or from the inspection by the building
department upon discovery of a structure being built without a build-
ing permit that it does not fall within the narrow confines of exclusion
that all measures should be then taken to see that the building is
constructed with a building permit and under the proper Uniform
Building Code as adopted by Weld County.
