HomeMy WebLinkAbout20100297 RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST WILLIAM AND ABRAHAM ALVARADO FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,William and Abraham Alvarado, BCV#0900146, are allegedly in violation of the Weld County Code, and WHEREAS,despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of February, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, William and Abraham Alvarado, property owners, were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until March 9, 2010, in order to allow adequate time for staff to process the application which has been submitted for the necessary building permit. RECOMMENDATION Staff recommends this case be referred to the County Attorney's office but delay action for 30 days to allow owner or representative to submit a new permit application. He said Justin at Clayton Homes was responsible for the permit and he understood it had been completed. I reminded him that I sent a letter on 11/19/09 to remind of the expiration date and then again on 12/18/09 to advise the permit had expired and a violation was initiated. He had not responded to either letter. I told him I would call Justin. 01/25/2010 Phone Call Phone call to Mike at Clayton. Justin is out of town until 02/01/10. William Alvarado had faxed him a copy of the hearing letter. I advised Mike that a new permit will need to be obtained.
