RE: SITE SPECIFIC DEVELOPMENT PLAN AND SECOND AMENDED PLANNED UNIT
DEVELOPMENT PLAN, 2NDAMPF-336, FOR DEL CAMINO CENTER PUD (TO DIVIDE
BLOCK 2 AND BLOCK 2A INTO ONE (1) ADDITIONAL LOT) - UQM PROPERTIES,
INC., C/O RAW LAND SOLUTIONS, LLC
A public hearing was conducted on November 10, 2010, at 10:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 17, 2010, and duly published
September 22, 2010, in the Fort Lupton Press, a public hearing was conducted to consider the
request of UQM Properties, Inc., c/o Raw Land Solutions, LLC, for a Site Specific Development
Plan and Second Amended Planned Unit Development Plan, 2ndAmPF-336, for Del Camino
Center PUD (to divide Block 2 and Block 2A into one (1) additional lot). Bruce Barker, County
Attorney, made this a matter of record.
Chris Gathman, Department of Planning Services, presented a brief summary of the proposal
and entered the favorable recommendation of the Planning Commission into the record as
written. He stated the applicant plans to divide two existing lots within the development, which
was originally created through the PUD process, and the applicant is not proposing to develop
or complete any construction on the vacant lots at this time. He confirmed any future
development of the site must follow the Site Plan Review (SPR) process. He stated the site is
located within the three-mile referral area for the Towns of Firestone and Frederick, and the City
of Longmont; however, the site is located outside of the Intergovernmental Agreement (IGA)
areas for the Town of Frederick and City of Longmont, and the IGA with the Town of Firestone
is no longer in place. He clarified the City of Longmont indicated no conflicts with the proposal,
no referral response was received from the Town of Frederick, and the Town of Firestone
indicated a pending residential development will be directly east of this site, and questioned
what the height requirements were for the site. He confirmed any buildings constructed on the
site in the future are subject to the requirements of the SPR process, which indicates a
maximum of 50 feet. Mr. Gathman indicated the site is served by the Saint Vrain Sanitation
District, which indicated no conflicts, and the Central Weld County Water District, which did not

provide a referral response. He further indicated no correspondence has been provided by
surrounding property owners, and the existing PUD contains both commercial and industrial
designations. He displayed photographs of the site and the surrounding area, indicating one lot
within the PUD is built out, and the other two lots are vacant.
Don Carroll, Department of Public Works, stated the Del Camino Center PUD is located within
the 1-25 RUA (Regional Urbanization Area), formerly known as the 1-25 MUD (Mixed Use
Development). He clarified street improvements within an RUA are required to include curb,
gutter, sidewalk, and a paved access lane. He indicated the access to the site is on Specialty
Place, which is not maintained by the County, and provides access from the 1-25 Frontage
Road. He clarified the Colorado Department of Transportation (CDOT) maintains jurisdiction
over the access, and since there is no new development expected at this time, CDOT is
amenable to discuss necessary requirements during any future SPR process. He stated the
drainage on the site appears to be adequate, and the Department will require the applicant to
provide additional information concerning drainage rates when development is proposed in the
future. He clarified a traffic study was not required; however, the applicant is required to provide
a weed management plan.
Lauren Light, Department of Public Health and Environment, stated the site will be served by
the Central Weld County Water District, and the Saint Vrain Sanitation District. She confirmed
the Waste Handling Plan will be addressed through the SPR process, since it is not currently
known what type of operations will occur at the site, and the Department does not have any
outstanding concerns with the application. Mr. Gathman clarified the applicant has satisfied
Condition of Approval #2.Q, therefore, it may be deleted.
Teresa Kerrigan, Raw Land Solutions, LLC, represented the applicant and stated UQM
Properties, Inc., purchased the property and the existing building and has moved their
operations into the existing building. She clarified the other two lots are a strange configuration,
and it is intended that the lots will be utilized in the future, or sold for other uses. She confirmed
the applicant does not have any particular plans for the use of the lots at this time; however,
they desire the opportunity for flexibility in the future. She requested the deletion of Condition of
Approval #2.R, and clarified the use on the site has already been established, therefore, the
intent of the language has already been met.
No public testimony was offered concerning this matter.
In response to Chair Rademacher, the Board concurred with the deletion of Condition of
Approval #2.Q, as requested by Mr. Gathman. Further responding to Chair Rademacher,
Mr. Gathman indicated this is a unique case where new lots are being created, and the
language within Condition of Approval #2.R would normally apply; however, staff does not have
any issues with the requested deletion. The Board concurred with the deletion of Condition of
Approval #2.R, as requested by the applicant.
In response to Chair Rademacher, Ms. Kerrigan indicated she has reviewed, and concurs with,
the Conditions of Approval and Development Standards, as modified.

Commissioner Kirkmeyer moved to approve the request of UQM Properties, Inc., c/o Raw Land
Solutions, LLC, for a Site Specific Development Plan and Second Amended Planned Unit
Development Plan, 2ndAmPF-336, for Del Camino Center PUD (to divide Block 2 and Block 2A
into one (1) additional lot), based on the recommendations of Planning staff and the Planning
Commission, with the Conditions of Approval as entered into the record. Her motion included
the deletion of Conditions of Approval #2.Q and #2.R, with the required re-lettering. The motion
was seconded by Commissioner Conway, and it carried unanimously. There being no further
discussion, the hearing was completed at 10:25 a.m.
This Certification was approved on the 15th day of November, 2010.
