RE: ACTION OF THE BOARD CONCERNING AGREEMENT FOR CONVEYANCE OF
EASEMENT FOR CERTAIN IMPROVEMENTS TO COUNTY ROAD 13 AND AUTHORIZE
CHAIR TO SIGN NECSESARY DOCUMENTS -STEVEN BUHLKE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on April 21, 2010, the Board was presented with an Agreement for Conveyance
of Easement for Certain Improvements to County Road 13 between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Public Works, and Steven Buhlke, 26502 County Road 13, Loveland, Colorado
80537, with terms and conditions being as stated in said agreement, and
WHEREAS, pursuant to the Weld County Home Rule Charter, Article 3, Section 3-13, the
concurrence of three of the members of the Board is required to approve a Resolution, and
WHEREAS, the motion to approve said agreement received only two votes and therefore
failed; and the effect of the failure to obtain a majority vote is a denial of the motion, and
WHEREAS, at the following Board meeting of April 26, 2010,the Board deemed it advisable
to reconsider the matter, and after review, moved to continue the matter to May 5, 2010, and then to
May 19, 2010, to allow consideration of the matter before a full quorum of the Board, and
WHEREAS, at said meeting on May 19, 2010, after review,the Board deems it advisable to
continue said matter to June 9, 2010, in order to allow adequate time for the County Attorney, Bruce
Barker, and the property owner's attorney, to achieve a resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for Conveyance of Easement for Certain Improvements to
County Road 13 between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Public Works, and Steven
Buhlke, be, and hereby is, continued to June 9, 2010.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 19th day of May, A.D., 2010.
