WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County , Colorado, and WHEREAS , a public hearing was held on the 31st day of January, 1979 at 2 : 00 o' clock p.m. for the purpose of hearing the petition of Warren Ruger, 181 Weld County Road 27 , Brighton, Colorado 80601 , requesting a change of zone from A-Agricultural District to C-Commercial District for the following described parcel of land, to-wit: That part of the South one-half of Section 31, Town- ship 1 North, REnge 66 West of the 6th Principal Meridian, We?.d County, Colorado, described as follows: Beginning at the Southeast corner of that part of the Southeast one-quarter of said Section lying West of the right of way of the Union Pacific Railroad Company, said point being 1804.55 feet West of the Southeast corner of said Section; thence North 13°43' East, 885 feet along said right of way of the Union Pacific Railroad Company to the true point of beginning; thence West 200 feet; thence North 13°43' East, 129.41 feet; thence East 200 feet more or less, to said Union Pacific Railroad Company right of way line; thence South 13°43' West, 129.41 feet to the true point of beginning. WHEREAS , Section 8. 2 and 8. 3 of the Weld County Zoning Resolu- tion authorizes the Board of County Commissioners to grant a change of zone upon the showing by the petitioner of certain facts , and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission, and having been fully informed, is satisfied that the request for re-zoning complies with the Weld County Comprehensive Plan and the conditions set out in Section 8 . 2 and 8 . 3 of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County , Colorado that the petition of Warren PLC <( 790024 BOOK 1'782370 860 Ruger, for a change of zone from A-Agricultural District to C-Commercial District on the abovedescribed tract of land be , and hereby is , granted due to the changing conditions in the area and further because it seems to be a product of A-Agricul- tural Zone in the Commercial and Industrial area. BE IT FURTHER RESOLVED by the Board that the reasons for approval contained in the Planning Commission recommendations dated December 19 , 1978 be , and hereby are, incorporated as the findings of fact of the Board of County Commissioners in this matter. Warren Ruger Z-316 : 78 :20 PLANNING COMMISSION RECOMMENDATION December 19, 1978 It is the opinion of the Planning Commission that the applicant has demonstrated that changing conditions in the area now justify a new zoning classification. This determination is based, in part , on the fact that since the approval of the original county zoning in January, 1962 , for this property, conditions in the area have changed and will continue to change as the City of Brighton' s growth pattern continues in the immediate area. This is evidenced by the fact of the IDA Industrial Park annexation by the City of Brighton in July, 1977 , and January and February, 1978, which annexed approximately 39. 1 acres adjacent to the property under consideration.
