HomeMy WebLinkAbout20101829 RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO AUGUST 11, 2010 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, August 11, 2010, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem — EXCUSED Commissioner Sean P. Conway Commissioner William F. Garcia Commissioner David E. Long Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Elizabeth Strong Director of Finance and Administration, Monica Mika MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of August 9, 2010, as printed. Commissioner Long seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: No public input was given. CONSENT AGENDA: Commissioner Long moved to approve the Consent Agenda as printed. Commissioner Garcia seconded the motion, and it carried unanimously. PRESENTATIONS: RECOGNITION OF SERVICES, BAGS OF LOVE - RUTH AND JOSEPH AKINS, ESTHER CARROLL, AND SISTER MARY REGIS LEAHY: Chair Rademacher read the certificates into the record, recognizing Ruth and Joseph Akins, Esther Carroll, and Sister Mary Regis Leahy for their service with Bags of Love. Commissioner Conway stated it was an honor having lunch with these individuals in the Town of Platteville on Monday. He stated the organization began in the basement of a home and now it is operated out of a garage in the Town of Frederick. He stated the group has prepared 600 Bags of Love for children who are in challenging circumstances, and the group was recently recognized with the Channel 7 Volunteer Award for its contribution to Weld and Adams Counties. Commissioner Conway stated Weld County is fortunate to have citizens who are making a real difference in children's lives. Minutes, August 11, 2010 2010-1829 Page 1 BC0016 COMMISSIONER COORDINATOR REPORTS: Commissioner Conway stated the Weld County Clerk and Recorder has indicated the Emissions Program may be delayed by 30 days due to the Colorado Department of Public Health and Environment experiencing challenges with identifying vehicles; therefore, the start date may be moved from November 1, 2010, to December 1, 2010. BIDS: PRESENT BID #B1000123, AUDIT SERVICES - DEPARTMENTS OF ACCOUNTING AND FINANCE AND ADMINISTRATION: Monica Mika, Director of Finance and Administration, stated said bid will be presented for approval on August 25, 2010. In response to Chair Rademacher, Ms. Mika confirmed there is only one (1) local vendor that submitted a bid. NEW BUSINESS: CONSIDER CANCELLATION OF TAXES ON CERTAIN PERSONAL PROPERTY, MOBILE HOME AND/OR POSSESSORY INTEREST ACCOUNTS: Bruce Barker, County Attorney, stated according to State statute, the Treasurer has the ability to recommend the Board remove uncollectable accounts from the database. He stated the uncollectable accounts are typically mobile homes which have been removed from Weld County, occasionally there is personal property on the list, which was declared; however, it is no longer located in Weld County, and rarely there is real property on the list, one (1) of which is listed today. Commissioner Garcia moved to cancel the taxes on listed personal property, mobile home, and/or possessory interest accounts. Commissioner Long seconded the motion. Chair Rademacher inquired as to whether these accounts are sent to collections. Mr. Barker stated it is not worth it to send the accounts to collections, since the properties are no longer at the previous locations. There being no further discussion, the motion carried unanimously. CONSIDER VETERAN'S SERVICE OFFICERS MONTHLY REPORT AND CERTIFICATION OF PAY AND AUTHORIZE CHAIR TO SIGN: Ms. Mika stated that Dorothy Strong, Veteran's Office, does a great job for Weld County and she is an unsung hero. She stated the Veteran's Office is running efficiently and successfully, with few expenses other than Ms. Strong's salary, and she should be commended. Chair Rademacher stated he would like the opportunity to thank Ms. Strong in person. Commissioner Conway moved to approve said Veteran's Service Officers Monthly Report and Certification of Pay and authorize the Chair to sign. Commissioner Garcia seconded the motion. Commissioner Conway concurred with the comments made by Ms. Mika and Chair Rademacher, and indicated he appreciates all Ms. Strong's hard work. There being no further discussion, the motion carried unanimously. HEARING TO OBTAIN PUBLIC INPUT CONCERNING DENVER METROPOLITAN WASTEWATER RECLAMATION DISTRICT NORTHERN TREATMENT PLANT WASTEWATER UTILITY PLAN: Doug Meyer, Weld County resident, inquired as to whether a National Environmental Policy Act (NEPA) study was completed or if only computer modeling was utilized. Commissioner Conway stated any project of this nature must comply with State and Federal rules and regulations for wastewater treatment facilities and he assumes a NEPA study is part of the permitting process. Mr. Barker concurred. Mr. Meyer inquired as to what effects the facility will have on the ground water. Chair Rademacher stated the treatment facility will be constructed in accordance with the new standards; therefore, it will be much cleaner than other nearby plants. Mr. Meyer stated last August at a meeting he attended, the Environmental Protection Agency (EPA) indicated the pH level is rising in the South Platte River and Escherichia coli (E. Coli) is on the rise. Chair Rademacher stated those are the reasons Regulation 31 was amended by the State Water Quality Control Commission; however, it contains EPA water standards which may be impossible to achieve. He stated he is a member of the Northwest Water Quality Association, which has determined the new regulations cannot be met, and there are coalitions opposing the new regulations statewide. Mr. Meyer indicated computer modeling was utilized to take water rights away from farmers in Weld County, and smart growth is a good idea for metropolitan Minutes, August 11, 2010 2010-1829 Page 2 BC0016 areas; however, it is not beneficial to the Weld County. Commissioner Garcia stated he has located the website address for Denver Metropolitan Wastewater Reclamation District; it is www.metrowastewater.com, and he suggested Mr. Meyer contact the District. In response to Mr. Meyer, Chair Rademacher stated the Board will consider approval of the treatment plant in a land use hearing. Mr. Barker stated the City of Brighton may be annexing the property where the water treatment plant will be constructed, in which case Weld County will not be involved in its approval. Mr. Meyer stated he does not want to stop progress; he just wants to ensure the progress is completed properly and in accordance with State statutes. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
