The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process. All issues of concern and critical issues
during further review must be resolved with the Public Works Department.
COMMENTS:
The City of Dacono has jurisdiction over this portion of WCR 13 and access requirements will be
determined by the City.
Site Plan:
1. Parking areas and the access drive shall be surfaced with gravel, recycled asphalt or the
equivalent and shall be graded to prevent drainage problems (requirement based on 200 vehicles
• per day maximum, additional vehicles may trigger paving of the access).
2. Please provide a maximum number of people and traffic at the site for Public Works to comment
on. Due to the wide range of estimates that have been given for this project and because a
number of people and traffic greater than 500 people and 200 vehicles per day would trigger
additional submittal requirements (i.e. traffic study, drainage report, etc.) the applicant will be
responsible for keeping the numbers under the maximum or amending the USR and providing
additional submittal items. The maximum number of vehicles per day shall be specified on the
USR plat.
3. Perpendicular parking spaces should be 9'x19' with a drive aisle 24' wide (Weld County Code,
Appendix 23-A). Please adjust the parking and circulation plan to reflect this (do not enlarge the
proposed parking area). Please provide a count of the available parking spaces. Parking outside
of the fenced parking lot area would indicate that there may be more traffic than the allowed 200
vehicles per day and may trigger a traffic count by the County. If the traffic count is found to be
higher than the USR permits, the applicant may be required to amend the USR.
4. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other
than grasses, needs to be maintained at a maximum height of 12 inches until the area is
completely developed.
Storm Water Drainage: The area and calculations provided for the water quality capture feature are
acceptable.
• 5. The area for the water quality feature shall he called out as "Reserved Drainage Area, No Build"
on the USR plat.

6. Please place on the plat the following statement: "Weld County is not responsible for the

maintenance of drainage related features."
7. The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or
unplanned ponding of storm run-off.
Geologic Hazard Area: The proposed site is in a Geologic Hazard Area.
8. Per the Weld County Code Section 23-2-550, the applicant must submit the application for review
to the Colorado Geological Survey. Please refer to the County Code for application requirements
and procedures.
Flood Hazard Development Standards: This area is not in a Special Flood Hazard Area (SFHA) as
determined by the Federal Emergency Management Agency(FEMA).

Michelle,
The City of Dacono is requiring Mr. Lo to provide a Traffic Study before they will approve his access onto WCR
13/Colorado Blvd. Public Works had originally commented, in our Memo dated April 19, 2010, that we would require a
traffic study and possible amendment of this USR if the number of roundtrips went over 200 vehicles per day. Because
Mr. Lo will be providing a traffic study for the City of Dacono we would like to revise our comment to say that the site may
operate within the limits of that traffic study. If traffic to the site goes over what was stated in the traffic study, a new study
and amendment of the USR may be required.

Michelle,
Mr. Lo had originally submitted much higher estimates for people and traffic generated by his proposed flea market, but
greatly reduced his numbers after our first 7-Day Completeness review resulted in requests for a traffic study as well as a
full drainage report. At our meeting on March 11, 2010 we discussed these requirements and Mr. Lo adjusted his
estimate to be below what the County would require for a traffic study and drainage report. We suggested that he speak
to the City of Dacono about any access requirements.
In our referral comments memo dated April 19, 2010, we stated that the City of Dacono has jurisdiction over WCR 13 at
this location and access requirements would be determined by them.
We again met with Mr. & Mrs. Lo on May 21, 2010 and informed them that we were waiting for the referral comments from
the City of Dacono.
le City of Dacono's referral comments were received on May 24, 2010 and the City is requesting a traffic study before
ey will approve an access for this USR but the applicant has indicated that he is not willing to have a traffic study
prepared for the site.
The County is requesting that Mr. Lo provide an approved access for his USR. He will need to obtain it from the City of
Dacono, who will set their own requirements for granting the access. Public Works strongly recommends that the
applicant work with the City of Dacono to acquire access from WCR 13.

Dacono has control over granting access off of Colorado Blvd.,.without access I don't think we can recommend approval
so he's going to have to give Dacono what they want in regards to the traffic study info and see what they say after that.
He'll need to get on it pretty quickly too or else I would think it will push out his hearing date to give his engineer time to
do the study and Dacono and Janet time to review it.

Yia,
After speaking with the County Engineer, it was determined that you do not need to do the Geologic Hazard Permit at
this time. If you expand your operation in the future and have to put in permanent bathroom or other facilities, the
permit would be required. We will ask that you put the following note on your final plat.
"The site is in a Geologic Hazard Area. The temporary use allowed by this Use By Special Review permit does not require
a Geological Hazard Development Permit (GHDP). If the use is expanded in the future and permanent structures are
constructed, a GHDP will be required."
In response to your second email...I don't think I fully understand what you are asking. We are not requiring that you
aye the parking lot. If you were to go over the 200 cars per day maximum we would require you to come back in with a
w application and at that time we may request that you pave the access.
My comments on the parking area layout mean that your surveyor will need to adjust the interior fences inside the
parking area to be 62 feet apart (19' parking space+ 24' drive aisle + 19' parking space). I was also asking that you don't
increase the size of the parking area when you adjust the interior fences because your parking area will not be for 200
vehicles. This is because in your application you said that vendors may have cars in the vendor area and because the
200 vehicles is PER DAY so we expect cars to come and go throughout the day, not all 200 to arrive and leave at the
same time. I don't expect you to provide painted parking stripes on the gravel, your surveyor can give an estimate of
how many parking spaces there will be or you could measure the fences people will park against and divide by 9 (spaces
are 9 feet wide). The adjustment of the parking aisles does not need to be done now and can be done after your
hearing, that way if there are other changes for your surveyor to make, he can do them all at one time.

I discussed your application with our traffic engineer and she said that she would have to review it on the basis of what
you submit so we are unable to give you a definitive answer to your question.
It is important that you provide us with honest estimates of the number of people and traffic you expect at the site and
we need to set the requirements from those estimates. It is not proper for you to adjust your estimate based on our
requirements. If you lower the numbers simply to lessen the requirements, you may go over the numbers in your
application and be required to go through the entire process again.
If you think there will be 700 people on the site you should put that in your application and allow us to review it. I
understand that you are trying to save money and start out small but we don't want to review false numbers based on
our requirements that would cause you to violate your USR.

COLORADO DATE: 5/12/2010
Environmental Health Services has reviewed this proposal for a flea market and sports
fields. The facility will be operated for 6 months during the year and there would be a
maximum of 500 people at the site, including vendors.
Bottled water, handwashing units and portable toilets will be provided. The use of
temporary sanitation facilities is acceptable as the use is for 6 months, 2 to 3 days a
week. A minimum of six portable toilets are required for an event that occurs
over a 6 hour time frame. Eight portable toilets will be required for an event that
exceeds a 6 hour time period and at least one unit should be handicap accessible. A
minimum of two portable hand washing stations are also required.
• All food vendors must adhere to the Colorado Retail Food Establishment Rules and
Regulations. An approved mobile unit is an acceptable method to provide food.
The applicant is proposing to provide recycled asphalt on the entrance drive, parking
area and market area. Recycled asphalt will be sufficient for dust control in those
locations. A dust control plan that demonstrates how on site dust will be contained on
the other areas of the site is also required. The plan could include bringing in a water
truck or establishing vegetation as necessary.
A waste handling plan is required and should include the name, address and phone
number of the waste removal and disposal company. The plan should indicate how any
waste associated with the flea market is disposed of.
The applicant shall comply with the Colorado Department of Agriculture (CDA), Division
of Animal Industry regulations that may apply to the selling of live poultry. As there is a
possibility of salmonella contamination from the handling of live poultry, at a minimum
hand sanitizer should be provided at booths that are selling live poultry as well as
signage indicating hands should be washed with soap and water. A signage example
will be provided by this department.
We have no objections to the proposal; however, we do recommend that the following
• conditions be part of any approval:
• We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment (WCDPHE). The plan shall include at a minimum, the
following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
2. The applicant shall submit a dust abatement plan for review and approval, to
WCDPHE.
We recommend that the following requirements be incorporated into the permit as
development standards:
• 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan".
6. There shall be no open burning conducted on the site, with exception to burning

• defined as "agricultural open burning" as defined by Regulation No. 9 of the
Colorado Air Quality Control Commission Regulations,
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
8. Adequate drinking, handwashing and toilet facilities shall be provided for
employees, vendors and patrons of the facility, at all times.
9. Hand sanitizer shall be provided at booths that are selling live poultry as well as
signage indicating hands should be washed with soap and water.
10.A minimum of six portable toilets are required for any event that occurs over a 6
hour time frame. Eight portable toilets will be required for any event that exceeds
a 6 hour time period. At least one unit should be handicap accessible. A
minimum of two portable hand washing stations shall be provided.
11. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
12.The applicant shall comply with Colorado Retail Food Establishment Rules and
Regulations governing the regulation of food service establishments.

13. If applicable, the applicant shall comply with the Colorado Department of
Agriculture (CDA), Division of Animal Industry.
14.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

• 1. Per the questionnaire from the applicant, a building permit to address accessibility will be
required. Building permit shall be obtained prior to starting. Building plans drawn to scale shall
be submitted for approval. A plan review is required for each building or structure for which a
building permit is required.
2. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2003 ICC ANSI 117.1 Accessibility and Chapter 29 of the Weld County Code.

Thank you for the opportunity to review and comment on USR-1742 Yia Lo. The site proposed for the
use by special review is eligible for annexation to the City and the site is within the City's Urban Growth
Boundary. The City of Dacono Comprehensive Plan designates this area as future industrial use. At
this time, the City of Dacono is not requesting the applicant be directed to the City of Dacono to discuss
annexation as the use described in the application is considered temporary. Should permanent
• structures, public improvements or other uses be proposed for this site, the City requests the applicant
be directed to the City of Dacono to further discuss annexation.
Overall, the City does not have significant issues with the proposed land use (flea market) as described
in the application. There are questions/concerns regarding the estimated number of people estimated
to use the site without sufficient infrastructure such as (permanent) restrooms and a public water
source. Furthermore, the City requests more information regarding the frequency of the portable
restrooms being serviced and trash removal. The City also has concerns about the intensity of the
proposed use and demands the flea market may create for public safety personnel and the availability
of such personnel.
The applicant indicates that 100-200 vehicles will access the site. The City has concerns about the
limited number of access points to the site. Based upon the traffic estimates, the City of Dacono
requests a traffic impact study be conducted as part of this application to identify any unique demands
and necessary improvements as Colorado Boulevard. Colorado Boulevard is maintained and
controlled by the City of Dacono at the petitioned site. Specifically, the City would request a trip
generation analysis, which would include the number of daily and peak hour anticipated trips
associated with the proposed flea market, the time of day the peak operations are expected to occur
and the probable distribution of these trips on the roadway network.
