RESOLUTION
RE: ACTION OF THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY,
COLORADO CONCERNING CHANGE OF ZONE FROM A-AGRICULTURAL DIS-
TRICT TO C-COMMERCIAL DISTRICT FOR BOULDER SCIENTIFIC COM-
PANY, P. O. BOX 150, BOULDER, COLORADO 80302.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on December 14, 1978 , the Board of County Commis-
sioners of Weld County, Colorado held a public hearing at 9 : 00
o' clock a.m. in the Chambers of the Board of County Commissioners
for the purpose of hearing the petition of Boulder Scientific
Company, P. O. Box 150, Boulder, Colorado 80302, requesting a
change of zone from A-Agricultural District to C-Commercial Dis-
trict for the following described parcel of land, to-wit:
A parcel of land situated in the Southeast Quarter
of Section 31, Township 2 North, Range 68 West of
the 6th Principal Meridian, Weld County, Colorado,
and being more particularly described as follows:
Commencing at an iron pipe imbedded along the North
edge of a paved highway and considered to be the
South Quarter Corner of said Section 31;
Thence along the South line of said Section 31, a
distance of 620.50 feet to its intersection with
the centerline of the C.B. & Q. Railroad Company,
said South line of said Section 31 to ear North
89°54'00" East and with all other bearings described
herein relative thereto;
Thence North 33°11'00" East along the centerline of
the C.B. & Q. Railroad Company, a distance of
35.48 feet;
Thence North 89°54'00" East along a line 30.00 feet
North of and parallel to the South line of said
Section 31, a distance of 59.81 feet to the True
Point of Beginning; Said True Point of Beginning
being at the point of intersection of the North
Right-of-Way line of the County Road and the Fast
Right-of-Way line of the C.B. & Q. Railroad
Company.
Thence North 33°11'00" Fast along said East Right-
of-Way line of the C.B. & Q. Railroad Company, a
distance of 639.50 feet;
Thence South 00°00'00" East, 534.60 feet to a point
of the North Right-of-Way line of the County Road;
Thence South 89°54'00" West along said North Right-
of-Way line of the County Road, a distance of 350.00
feet to the True Point of Beginning.
WHEREAS, a representative of the petitioner was present, and
WHEREAS, Section 8. 2 and 8 . 3 of the Weld County Zoning Resolu-
tion authorizes the Board of County Commissioners to grant a change

of zone upon the showing by the petitioner of certain facts, and
WHEREAS, the Board of County Commissioners heard the testi-
mony and statements of those present on behalf of the petitioner
and has studied the recommendations of the Weld County Planning
Commission for denial of the proposed change of zone, and
WHEREAS, the Board of County Commissioners hereby finds that
the petitioner has not demonstrated changing conditions in the
area to justify the re-zoning nor did said petitioner show the
original zoning classification was faulty, and
WHEREAS, a motion was made for denial of the change of zone
but failed for lack of a second and a motion was made for approval
of the change of zone but failed for lack of a majority vote.
The result is, in effect, a denial of petitioner' s application
for a change of zone.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of
Boulder Scientific Company for a change of zone from A-Agricultural
District to C-Commercial District concerning the abovedescribed
parcel of land be, and hereby is, denied due to the fact that
the motion for denial failed for lack of a second and the motion
for approval failed for lack of a majority vote.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
December, A.D. , 1978 .

District has been recommended unfavorably to the Board of County
Commissioners by the Weld County Planning Commission. The legal
description of the property involved is part if the SEA of Section 31,
Township 2 North, Range -68 West of the 6th Principal Meridian, Weld
County, Colorado.
If you wish to be heard -by the Board of County Commissioners, it
will be necessary for you to indicate your request by signing the bottom
of this letter and returning it to this office. Regular hearing procedure
will then be followed. This includes publishing a notice of -hearing twice
in the legal newspaper, which expenses must be paid by you before the
hearing day.
In order to proceed as quickly as possible, we must receive your reply
by October 25, 1978. If we are not in receipt of your request by that
date, the matter will be tonsidered -closed.

It is the opinion of the Planning Commission that the applicant
has not demonstrated in the submitted application materials or
in oral statements made at the scheduled Planning
Commission meeting that either the original zoning was faulty
or that changing conditions in the area now justify a new
zoning classification .
In addition, Section 8. 3 states :
"There must be definite proof that the area requested
for change has unique characteristics which
distinguish it from surrounding lands and thus make
its rezoning essential.
Again, it is the opinion of the planning Commission that the
applicant has not demonstrated that the property in question
has unique characteristics which distinguishes it from
surrounding lands.
Further, Section 8. 3 states :
"Furthermore, once a change is made , the Planning
Commission must recognize the precedent which is
established, both in the immediate area and in
other parts of the county, for like rezoning of
other lands "similarly situated. "
It is the opinion of the Planning Commission that the approval
of this request would constitute "spot zoning" . The approval
of this rezoning request would establish an undesirable
precedent in the immediate area and other parts of the County
"similarly situated" .
2. It is the opinion of the Planning Commission that the request
is not consistent with the basic goals and policies of the Weld
_County Comprehensive Plan with respect to minimizing conflicting
land uses and industrial development. b addressing industrial
development in general terms, the plan states on Page 62 the
following :
"Industrial development , like commercial development ,
is encouraged to locate in one of the existing
municipalities where such a facility can be
accommodated according to the local comprehensive
plan. Industrial land use is a vital part of
community development. It provides a foundation
for a well balanced, self-sustaining community and
prevents the formation of "bedroom" towns and the
attendant problems created by a community citizenry;
a lack of tax base for community improvement and
lack of community identity. "

P. C. RECOMMENDATION
October 3, 1978
Within Chapter three, Resource Management Policies, the plan
on Pages 48 and 49 sets forth the following policy that
relates to minimizing conflicting land uses.
"In order to minimize conflicting land uses and
minimize the cost of new facilities and services
to the taxpayer, industrial , commercial, business
and residential development will be encouraged
to locate adjacent to the existing 27 incorporated
towns and in accordance with the comprehensive
plans and states wishes of each community. "
Also included in Chapter three on Pages 64 and 65 is the
following policy which is utilized to guide industrial
development within the unincorporated area of Weld County :
"Zaning for industrial use in areas outside the areas
covered by the comprehensive plans of the existing
municipalities shall be encouraged only for low
employee concentration, agriculturally related
industries or -other industries that can show they
cannot reasonably be accommodated within the areas
covered by the municipalities' comprehensive plans . "
It is the opinion of the Planning Commission that the applicant
has not sufficiently shown why this request cannot reasonably
be accommodated within the areas covered by the municipalities '
comprehensive plans.
COMMENTS :
To date , our office has received 3 letters of opposition and one
petition containing the signatures of 34 people who are opposed
to the rezoning request . The petition appears to contain the
signatures of 3 adjacent property owners , the balance of the
signatures are of people living in the general area. Of the -3
letters received, one is from an adjacent property owner, the
other 2 are from property owners who live a z mile or more from
the property on which the rezoning request is being made.

I 3. The ohraining by Purchaser of the rezoning of the property from
"Agricultural" to " Industrial " is a condition precedent to the sale of the
property hereunder. The application containing all required information shall
be made by Purcha r t 4he Weld County Department of Planning Services no later

than August_-1-, 1 18. All _ osts and expenses of the zoning application. and pro-
ceedings thereunder shall be borne by Purchaser. Seller shall cooperate fully
in the zoning application and processing , and shall execute all instruments
necessary or appropriate in the matter. Application shall be made .in the name
of either Seller or Purchaser, as may be required under the governing zoning I
ordinances. Purchaser agrees to notify Seller in writing upon the granting of
such rezoning application. Subject to paragraph 4 hereof, this Agreement shall
terminate on October 15, 1978.
4. In the event final determination has not been made regarding the
rezoning application as of October 15 , 1978, Purchaser shall have the option to . I
extend this Agreement for an additional nrinety—day period upon the payment to
Seller of the sum of $300.00, said sum to be applied to the purchase price in the
event the rezoning is granted. In the event said rezoning application is denied
or final determination has not been made by the zoning authority at the ex-
piration of said period and Purchaser elects not to exercise the second option
granted, said amount shall be retained by Seller. Subject to the exercise of
the foregoing option by Purchaser, if final determination of the rezoning appli-
cation has not been made by the zoning authority at the expiration of said option
period, Seller hereby grants to Purchaser an additional option to extend this
•
Agreement for a period not to exceed ninety days from and after the expiration of
the first option period hereinabove granted, upon the payment to Seller of a sum
equal to 7% per annum of the purchase price of the property for the period covered
by said option. Any sums paid by reason of the exercise of the second option
granted herein shall be in addition to the purchase price of the property and
shall be retained by Seller regardless of the final determination of said rezoning
application.
5. If the rezoning application is denied or if a final determination
has not been made and purchaser elects not to exercise any available option , or
at the expiration of the second option exercised by Purchaser, the Agreement
shall become null and void and of no further force and effect. Seller agrees to
return to Purchaser the $1 ,800.00 earnest money paid hereunder upon the denial of
the rezoning application or upon Purchaser furnishing evidence to Seller of the
withdrawal thereof.

6. This property is subject to the terms and conditions -of an
Oil 8 Gas Lease dated the 15th day of September, 1972 , and any amendments
thereto between Seller and X 0 Exploration, Inc. A condition precedent
to the sale of the subject property is the obtaining by Seller of an a-gree-
ment on behalf of X 0 Exploration , Inc. , or its assigns , that no well shall
be drilled within five hundred (500) feet of a building or structure hereafter
constructed on the subject property without Purchaser' s prior written consent.
The consideration required by X 0 Exploration , Inc. , or its assigns, for
entering into such an agreement shall be borne solely by Purchaser.
7. The Seller agrees to deliver to Purchaser, not less than
ten days prior to the date of closing a commitment from a title insurance '
company -authorized to do business in the State of Colorado binding said
company to issue its regular form of owner's title insurance policy in the
amount of the purchase price to the Purchaser, and the Seller further agrees
to pay for the issuance of said owner's title insurance policy.
8. If title is found to be not merchantable, a written notice '
of its defects shall he given to the Seller within seven days from delivery
o the Purchaser of the title insurance commitment, and the Seller agrees to
correct such defects at Seller's own expense within ninety days from receipt
if said notice of defects , and there shall be an automatic extension of the
:losing date to a date not later than five days beyond the time allowed for
:endering said title merchantable; and in the event said title has not been
•endered merchantable within the time allowed herein, the Purchaser may, at
its option, waive such defects, or have any money paid at such time returned
to it, and upon return of the title insurance commitment to the Seller, the
°urchaser shall be released from further obligation under this Agreement.
9. The closing of this transaction shall be thirty days from the
late Purchaser notifies Seller in writing that the rezoning application has
)een approved. The exact time and place of the closing shall be mutually agreed
upon by the parties hereto.
10. Upon the performance by Purchasers of all the covenants and
agreements contained herein, the Seller will deliver on the date of closing

,n executed general Warranty Deed conveying the premises set forth in
paragraph 1 .
11 . All taxes , including installments for special assessments ,
for the years prior Lo the current year shall be paid by the Seller. Taxes ,
including installments for special assessments , for the current year shall

I urchaser, based upon the taxes assessed against such property for the
preceding year.

12. IL is mutually agreed that time is of the essence in this
Agreement. In the event of failure or default of the Purchaser in the
payment of the purchase price or in the performance of the covenants agreed
to be made and performed by Purchaser, this Agreement may be terminated at
the election of the Seller, and if so terminated Purchaser shall forfeit
all payrent: theretofore made and such payments may be retained by Seller

as full satisfaction and liquidation of all damages the Seller maythave

We have reviewed the Boulder Scientific Company application for a change of
zone from Agricultural to Industrial Zone District, and we ask for your considera- .
tion of the following comments.
1 . The attached sheet is a copy of our right-of-way plans for this portion of
State Highway 52. The wire fence shown on our plans and on the Legal Descrip-
tion map delineates the existing right of way on the north side of the highway.
Care should he taken to insure that the proper right of way for S.H. 52 is taken
into consideration.
Traffic projections in this area indicate the need for a total of 150 feet of
right of way. We ask additional right of way necessary to meet one half of
this need be protected on the north side of the present centerline by reserva-
tion, setback, or dedication (preferably the latter) as local zoning laws and
regulations permit.
2. Although the proposed use of this property will result in an average of one
truck per day, according to the information provided, we feel that considera-
tion should be given to locating access for this site as far to the east as
possible. This would help to avoid potential conflicts between the railroad
tracks and vehicles entering this site. Any necessary reconstruction work
which might be required to accomplish this objective requires a Driveway Permit.
Application for this permit should be made to Mr. David N. Fraser, District IV
Maintenance Superintendent, P. 0. Box 850, Greeley, Colorado 80632.
3. It would not appear that the three proposed buildings will contribute signifi-
cantly to increased storm runoff. However, if paved parking areas are to be
provided, on-site detention should be utilized to protect the highway right
of way from increased runoff.

Dear Chuck:
We have reviewed the above change and offer the following comments :
1 . The soils are classified as Otero sandy loam on a 3
to 5 percent slope. This is a deep, well drained
soil with rapid permeability and poor water holding
capacity. It is ideally suited for urban develop-
ment and recreational uses. It has a dryland capa-
bility of Class VI and would not be considered prime
agricultural land.
2. The parcel of land does not affect any major irrigation
systems on canals .
3. While our maps do not delineate the flood plain, a pro-
jection of the Coal and Rock Creeks flood plain would
indicate the parcel to be outside or above the 100 year
flood plain.
4. The soils would rate only slight limitations for septic systems
and shallow excavations for foundations .
Due to the size of the parcel and its relative poor agricultural capability,
we find no real conflicts with our interests.

Indeed , we object to the proposal to rezone Section 31 , Weld
County , from agricultural to industrial to accomodate the building of
a chemical plant. by Boulder Scientific Products .
There are many reasons , ecological and economic , that could be
given in opposition to the zoning change . But , mostly we 're all weary
of every need taking priority over the most important of all our natural
resources . . people ! We are all family recbl ents attempting to raise
our children in a positive , country atmosphere cond ucive to instilling
basic values of life . We think that this resource that we offer to
our country and its future is far more valuable than the budding of
a chemical plant designed to produce cleaning solvents . We ask you
please not to jeopardize this community of families and their homes
through rezoning this area for industrial Use.
