WHEREAS , the Board of County Commissioners of Weld County, Colorado , pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 22nd day of October, 1979 at the hour of 9 :00 o 'clock a.m. for the purpose of hearing the application of Lyle Picraux for approval of a Unit Development Plan for commercially zoned property on the following described real estate, to-wit: A tract of land in the Southwest one- quarter of Section 32 , Township 1 North, Range 68 West of the Sixth Principal Meridian, County of Weld, State of Colo- rado more particularly described as follows : Commencing at the Southwest corner of said Section 32; thence North 0°27 ' 37" East along the West line of said Section 32 a distance of 50 . 00 feet; thence South 89°25 ' 15" East a distance of 30 .00 feet to the true point of beginning; thence North 0 °27 ' 37" East along the East right of way line of County Road No . 3 a distance of 940 . 81 feet; thence South 89°22 ' 25" East a distance of 689.91 feet; thence South 0°27 ' 37" West a distance of 252 . 30 feet; thence North 89°22 ' 25" West a distance of 342 .91 feet; thence South 0°27 ' 37 " West a distance of 688 . 22 feet more or less to the North right of way line of Colorado State Highway No . 7 ; thence North 89°25 '15" West along said North right of way line a distance of 347 . 00 feet more or less to the point of beginning. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the approval of the Unit Development Plan upon the aforementioned tract of land, and WHEREAS, Section 6 . 6 of the Weld County Zoning Resolution authorizes the Board of County Commissioners to approve a Unit Development Plan upon a showing by the Petitioner of compliance 7-' L0 34/5 790023 with all of the requirements of Section 6 . 6 of the Weld County Zoning Resolution, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for approval of the application for a Unit Development Plan complies with all of the conditions set out in Section 6 . 6 of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the petition of Lyle Picraux for approval of a Unit Development Plan on the tract of land set forth above be , and hereby is, granted subject to the following: 1. The Development Standards contained in the Unit Development Plan. 2 . The unit development plat being amended to show a reservation of an additional 25 feet of highway right-of-way along the South side of the property and deleting one access to the property from County Road 3 . 3. No additional building or electrical permits shall be issued on the Unit Development area until the Development Standards for the Unit Development have been placed on the Unit Development plat and said plat has been delivered to the office of the Department of Planning Services . 4. Development Standard #16 being amended to include the following sentence: Gravel base shall be used until such time that paving occurs . The permitted uses on the hereon described property within the Commercial Unit Development shall be those uses as listed in the Commercial Zone District of the Weld County Zoning Resolution adopted by the Weld County Board of County Commissioners . 2 . Agricultural production may be permitted. If agricultural production is not pursued on all or any portion of the Commercial Unit Development that portion not in agricultural production shall be maintained in a manner so as to prevent fugitive dust, erosion, growth of noxious weeds , and non-ornamental ground cover shall not exceed 12 inches in height. 3 . The minimum setback of buildings and the maximum height of buildings shall be in compliance with the requirements of the Commercial Zone District as set forth in the Weld County Zoning Resolution. 4 . The installation of signs shall conform to the specifications and requirements of the Weld County Zoning Resolution. Applicable permits shall be obtained prior to installation. 5 . Use of property shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems . 6 . The unit development area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and the growth of noxious weeds. 7. Access to the site shall be limited to County Road 3 . Access to the unit development area shall be limited to a total of three. All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 8. As shown on the unit development plan, additional 25 feet of right-of-way shall be reserved along the south side of the unit development area. 9. All construction, plumbing, and electrical work shall be done in accordance with the Weld County Building Code . 10. Prior to construction of any structures within the unit development area a soils and foundation investigation shall be conducted by a qualified soils engineer to determine proper foundation design on the site. The soils and foundation investigation report shall be submitted to the Weld County Building Inspection Division with the building permit application . 11 . Drainage design of the unit development area shall be in compliance with the Hydrology Study for Lyle Picraux, dated July 18, 1979 prepared by D. K. Rice and Associates, Inc. which is hereby made a part of the Development Standards . Said study is in the office of the Department of Planning Services . 12 . It is intended to use the retention pond area both as a storage area for drainage and as a reservoir for fire protection. The retention pond area shall maintain a minimum amount of 25 , 000 gallons of water storage for fire protection. All fire protection facilities , including hydrants , shall be located in accordance with the recommendations of the Dacono Area Fire Protection District as defined by letters from such District dated December 1 , 1977 and September 29 , 1979 and on file with the Weld County Department of Planning Services. 13 . Adequate off-street parking shall be provided by the developer for customers and employees in accordance with the parking requirements as set forth in the Weld County Zoning Resolution . 14 . The developer shall also provide adequate paved space for the circulation of traffic in the parking areas, which shall not be a part of the off-street parking. 15 . Adequate off-street loading and maneuvering space shall be provided for individual use requirements. 16 . All off-street parking, access drives, and loading areas shall be paved and properly graded to assure proper draining. Gravel base shall be used until such time that paving occurs . 17. Exterior lighting may be maintained for security purposes provided it does not obscure the vision of highway traffic or create a nuisance for adjacent properties. 18. A minimum of 15% of the total lot area shall be maintained as landscaped area (not covered by buildings or asphalt) . The developer shall be responsible for constructing and maintaining any greenbelts, natural buffer zones, or any other landscaped areas. The landscaping plans shall include provisions for the re-seeding to natural grasses of all areas upon which the natural ground cover is removed by construction that are not otherwise covered. Said re-seeding shall be commenced upon completion of construction, but in the event such construction is completed after October 1 of any calendar year, not later than May 1 of the following year. The landscape development, having once been installed shall be satisfactorily maintained. 19. The unit development plans shall be limited to the plan submitted and governed by the Development Standards stated above and applicable Weld County regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Unit Development Plan by thePlanning Commission and the Board of County Commissioners before such changes form the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. Comments : 1 . The Longmont Soil Conservation Service did not respond to the referral sent to it. 2 . The Erie Planning Commission ' s negative response to this request addresses the issue of rezoning amd not the unit development issue. A copy of its letter is in the attached materials. 3 . To date, our office has not received any opposition to this request from surrounding property owners. Enclosed also is a copy of the letter I have previously sent to Mr Picrau:r. regarding the need to use the drainage water for a holding pond for fire protect- ion. For the present anticipated builders supply yard and buildings, we feel that the lake if properly lined will hold water in sufficient supply for the first phase of his planned construction. We also asked for a dry hydrant to be installed in the pond. This will be accomplished by Mr. Picraux with our assistance to make it usable. We would ask that the minimum water storage in the lake or pond on a year round basis be no less than 25,000 gallons of water to cover the possible needs for the enclosed proposal. We discussed the construction of a holding pond or lake in the south- west part of the developement, and you indicated that the drainage of the • ground in the developement would be utilized to keep the pond filled. I feel if the pond can be constructed to hold the water on a year around basis, it would be satisfactory. I would then ask that you install a dry hydrant as we discussed, the bottom of the hydrant not less than 18 inches from the bott- 2 om of the water and the top or outlet not more than 10. feet above the intake. This hydrant would be of 6 inch size, with a strainer or perforated pipe on • the bottom and outlet to be fitted with 6 inch pipe threads. We discussed the amount of water to be available for our use at the site, and as I told you we would be satisfied with a storage capacity of not less than 50,000 gallons for units 1, through unit 4 of your plan. As I stated, our pumpets could be hooked directly to the dry hydrant and then supply the vehicle fighting any fire that may occur. We could also utilize our tanker system in the event that more water is needed or for initial attack. Mien you begin the construction of unit 5 of your plan, I would then ask that a water supply be constructed, so that a wet hydrant would be avail— able near the shopping part of the unit, and that the wet hydrant have a continuous water pressure of not less than 40 psi, and capable of flowing 750 gallon of water per minute. This would not be required until unit 5 of • your plan is started. Possibly by the time unit 5 is begun, you may have access to a water supply on which to tie in. Planned Unit Developement shall consist of 9.48 acre tract of land in the southwest on quarter of Section 32, Township 1 North, Range 68 West of the sixth principal meridian, County of Weld, State of Colorado. b. ) Proposed Developement in its preliminary phases will allow for construction of a builders supply yard, conditions for adequate office space, and en— closed storage units. ARTICLE II PERMITTED USES Shall be in agreement with the conditions of P.U.D. and within the re— strictions set forth by the developer of said P.U.D. building sites shall not be used for any purpose not permitted by the zoning resolution of the County of Weld, nor shall anything be done thereon which is in violation of any Federal, State, or Local law or ordinance, or regulation lawfully promulgated thereunder. A description of proposed operations in sufficient detail to permit judgement of Whether or not they are permitted uses under the terms of then existing zoning ordinances shall be made available by developer. ARTICLE III BUILDINGS Shall be located in compliance with zoning set backs easements and right of ways established by the county. All permanent structures must meet all required building codes set forth by the County of Weld. The developer shall be respon— sible for site and engineering analysis, showing location and design of buildings. Density control shall limit allowable building area to accomodate no more than fifty percent of the usable land proposed in the P.U.D. . Height regulations shall be within zoning regulations and the owner's discretion. Provisions for controlling the architectural and aesthetic impact of the buildings shall be enforced by the developer. It shall be noted that all buildings should maintain a certain architectural similarity within the confines of materials used in construction, architectural changes shall be approved by the owner as tends may allow changes to occur in order to meet aesthetic values. Con- struction or alteration of all buildings in P.U.D. shall meet the building standards of the County of Weld in effect at the time such construction or alteration is performed. The subjected ground cover proposed shall be in final phase concrete and asphalt with gravel base used only as an interim. ARTICLE V ERROSION CONTROL Run off control shall be handled by the developer in accordance with the requirements of Weld County and approved engineering practices subjected to concentrated run off control. A water retention pond shall be sized and built by the developer and maintained in accordance with the applicable governmental regulations. As we have commented in earlier reviews of this property, the existing right of way on State Highway 7 is not adequate to meet projected needs. An addi- tional 25 feet of right of way should be protected along the south boundary of this property by reservation, setback, or dedication (preferably the latter) as local zoning laws and regulations permit. 2. It is indicated in the Hydrology Study that this development will consist of two phases. Phase 1 will probably not generate sufficient traffic by itself to warrant acceleration/deceleration lanes at County Road 3. However, if an "intensive commercial/retail complex" is built in Phase 2, it is likely that such improvements would be warranted. Consideration should be given to pro- viding access to Phase 2 through an internal roadway system connecting to County Road 3. 3. We do have concern with regard to the planning and transportation implications of this development, as we have indicated in our previous reviews. The Weld County Comprehensive Plan and the State Policy on Human Settlement in Colorado encourage that new development be directed toward existing developed areas. In most cases the runoff created, following development of the property, exceeds the historic rate. The excess runoff must be held on the site until after the peak storm passes. For the purposes of this report, the historic runoff will be estimated using the existing characteristics and a 5 year storm return period while the developed runoff will be computed using a proposed development plan and a 100 year storm return period. This report will use the concepts, information and techniques as set forth in the "Urban Storm Drainage Criteria Manual " 1969, by Wright-McLaughlin Engineers as prepared for the Denver Metropolitan Urban Drainage and Flood Control District. AREA HYDROLOGY The proposed development occupies the southwest 1/4 of the southwest 1/4 of Section 32, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado. The site is within the tributary boundaries of Coal Creek. The 100 year flood plain of Coal Creek does not impact the proposed development. (See Vicinity Map). The property and surrounding area currently has an agri- cultural use with some light commercial uses. To the northwest, the Erie Air Park serves Weld County. HISTORIC RUNOFF The historic runoff can be divided into two minor drainage basins. The main drainage basin roughly occupies the southern 2/3 of the property, while basin #2 comprises the remainder of the site. (See Figure 1 ) . Basin #2 drains northward to another channel that also connects to Coal Creek. Using a 5 year storm intensity of 1 .5 inches per hour, drainage area of 225 acres, and a runoff coefficient of 0.35, the runoff rate in Basin #1 is estimated to be 11 .8 cu. ft. per second. This historic rate will be the maximum outlet rate allowable for the developed site. Basin #2 utilizes the same storm intensity, drainage area of 15.3 acres and an undeveloped agri- cultural runoff coefficient of 0.3. This runoff rate is estimated to be 6.9 cfs. (See calculation section) . DEVELOPED RUNOFF The PICKRAUX PLANNED DEVELOPMENT will ultimately be developed in two phases. Phase 1 will consist of constructing additional offices and storage areas on the western portion of Basin #1 . (See Figure 2) . Development of this area will cause a slight decrease in the drainage area of Basin #2. Approximate building sizes and pavement locations are shown in Figure 2. Using this proposed development plan, a 100 year storm intensity of 2.1 inches per hour, a total drainage area os 24.1 acres and a composite runoff coefficient of 0.45, the developed runoff rate is estimated to be 28.5 cfs. Basin #2 is estimated to be 10.9 cfs. It should be noted that the majority of Basin #2 will remain in its historically undeveloped, agricultural char- acter and will not require any detention facilities. Phase II of this development will consist of an intensive commercial/re- tail complex on the remaining portion of Basin #1 . O. 37.9 Ac Using an area increase to 27.9 acres, a time of concentration of 30 minutes, an intensity of 3.2 inches per hour, and a composite runoff co- efficient of 0.85, the ultimate runoff rate is computed to be 91 .1 cfs. Again, the maximum permissable outlet rate will remain 11 .8 cfs. (See Figure 3). DETENTION FACILITY DESIGN Detention facilities for this site will consist of a detention pond and outlet tower with a permanent ponding capacity of 6,684 cubic feet. The maximum ponding capacity shall be 134,952 cubic feet. Maximum ponding depth will be 6 feet. Storm flow in excess of the 100 year maximum will exit the pond through a wier in the earthen dike in the southwest corner of the pond. Overland flow will carry this excessive runoff across Bonanza Drive to the existing runoff channel . The outlet structure will consist of an ARMCO 101-C slide gate attached to the easterly end of an 18" diameter corrugated metal pipe (CMP) . Welded to the western end of the discharge tube shall be a steel plate with a 11 " diameter circular hole cut at the base. This will meter the storm runoff to 11 .8 cfs. Attached vertically to the discharge pipe near its entrance shall be 2.5' x 18" cmp. This will cause the water to permanently pond at 4 feet. At the entrance to this standpipe shall be an open metal grate, the openings of which should not exceed 2" x 4". The combination of these gates and metering plates will allow the manual drainage of the pond at a rate not in excess of 11 .8 cfs. (See detention pond detail ) . To slow this runoff rate, a detention pond with an engineered outlet system should be constructed in the southwest corner of the property. All runoff should be channelled into this detention/retention pond and exit under Bonanza Drive to the existing storm runoff channel . Proper construction of this facility will insure that the excess runoff will be controlled during peak storms while at the same time creating an aesthetically pleasing pond to complement the commercial development.
