Please review Surveyor Note number 4 on the Plat as it seems to contradict the use of the newly approved CDOT access
for residential purposes.
Easements shall be shown on the final plat in accordance with County standards (Sec.24-7-60) and Utility Board
requirements.

The Weld County Health Department has reviewed this proposal. The proposed
amendment is to vacate Outlot A and add one additional residential lot which will be
zoned Estate. The proposed residential lot will be 20 acres in size and will be served
with a tap from Left Hand Water District and an individual sewage disposal system.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from Left Hand Water District
2. This subdivision is in rural Weld County and is not served by a municipal
sanitary sewer system. Sewage disposal shall be by septic systems designed
• in accordance with the regulations of the Colorado Department of Public
Health and Environment, Water Quality Control Division and the Weld County
Code in effect at the time of construction, repair, replacement, or modification
of the system.
3. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area.
Contact the Water Quality Control Division of the Colorado Department of
Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit
for more information.
4. During development of the site, all land disturbances shall be conducted so
that nuisance conditions are not created. If dust emissions create nuisance
conditions, at the request of the Weld County Health Department, a fugitive
dust control plan must be submitted.
5. In accordance with the Regulations of the Colorado Air Quality Control
Commission any development that disturbs more than 5 acres of land must
incorporate all available and practical methods that are technologically feasible
and economically reasonable in order to minimize dust emissions.
6. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld
County Code shall be placed on any recorded plat.
• 7. Activities such as permanent landscaping, structures, dirt mounds or other
items are expressly prohibited in the septic absorption field site.

Thank you for referring Highland Farms Outlot A FP (AmPf-1045) to the School District The District has reviewed
the development proposal in terms of (1) available school capacity. (2) required land dedications and/or cash-in-
lieu fees and (3) transportation/access considerations Based on this review. and the District's school capacity
benchmark policy the School District finds that it cannot support this proposed development at this time.
However, when Erie Elementary 26 opens in 2011 the District believes there will be sufficient capacity to support
this development.
Detailed information on the specific capacity issues. the land dedication requirements and transportation impacts
for this proposal follow in Attachment A. The recommendation of the District noted above applies to the

Specific comments concerning this proposal regarding School Capacity are as follows
• Specific Impact: This application will create the potential to add 1 new dwelling unit with a potential impact of 1
additional student in the Erie Elementary. Erie Middle and Erie High School Feeder
• Benchmark. Determination-Erie Middle School is projected to exceed 125%of capacity in 5 years with students
from this development Tne School District is therefore not supporting this application at this time
• Arliirtror;ai Capacity Impacts-An additional elenlentarychool is available for the Erie area through the 2008 bond
approval and is expected to open In 2011 depending on the availability of operating funds.
• Mitigation Options-Weld County and the developer should also be aware that the School Board has developed
a mitigation policy that would assist in providing capacity for the new students in this subdivision. tinder the
policy. should an applicant wish to begin construction on a residential development prior to the Districts ability to
provide additional capacity,the applicant may mitigate the developments impact on the feeder by agreeing to a
voluntary, per-unit payment. Funds would be used to provide permanent or temporary capacity within the
impacted feeder. The Planning Department would be happy to discuss this type of mitigation for the proposal
with either the town or developer
• Phasing Plan-The District would appreciate a phasing plan from the applicant to more accurately calculate the
impacts of this development.
• (LLANO DEDICATIONS AND CASH.IN.LIEU FEES
The implementation of the Intergovernmental Agreement (IGA) Concerning Fair Contributions for Public School
Sites by Weld County requires that the applicant either dedicate land directly to the School District along with
provision of the adjacent infrastructure and/or pay cash-in-lieu (CIL) fees based on the student yield of the
development CIL fees only provide funds for land acquisition, which is only a small component of providing
additional school capacity for a feeder. Specific comments regarding land dedications and CIL fees for this referral
are as follows.
• Dedication and/or Cash-in-lieu Requirements-The District does not anticipate the need for another school
site in this area Since no land dedication is required. CIL fees will be assessed. Current fees are included
on the attached chart. however fees paid will be those in effect at the time of payment.
• Number of Units covered by dedication/cash-rrl-treu-All residential units will be subject to CIL fees
• Dedication/Cash-m-tree Procedures- Cash-in-lieu payments are to be made to the St. Vrain Valley School
District Business Office- 395 S Pratt Parkway Longmont. CO
3l TRANSPORTATION/ACCESS
Transportation considerations for a project deal with bussing and pedestrian access to and from the subdivision.
Pedestrian access. in particular, is an important goal of the School District in order to facilitate community connection to
schools and to minimize transportation costs. Specific comments for this application are as follows:
• Provision of Busing-Busing for this project.under the current boundaries,would most likely be provided
• Pedestrian/Access Issues — This proposal appears to have adequate pedestrian pathways and sidewalks for
students to connect to neighboring schools.

Dear Ms. Martin:
Thank you for the opportunity to comment on the proposed amendment to the fmal plat of Highland Farms
Planned Unit Development. Highland Farms is located just south of Highway 52 and east of Weld County Road
3. Currently there are nine lots ranging in size from 1.8 to 2.56 acres with single family homes. The applicant,
Balmes Homes LLC, seeks to vacate 20 acres originally planned for open agricultural land("Outlot A")from
Highland Farms PUD and add 1.53 acres of open space to Highland Farms. The applicant also seeks to change
• the status of the 20 acres from agricultural to residential allowing for one homesite.
The property is currently used by a variety of wildlife, including but not limited to red foxes,raccoons, striped
skunks,coyotes,mule deer,white-tailed deer, red-tailed hawks,and great horned owls. Residents moving onto
this property should be aware that wildlife will to use this site. Conflicts may occur when people and pets share
space as with wildlife. Foxes and coyotes may prey on unattended pets, deer may eat ornamental shrubs and
flowers,raccoons may get into trash containers and open garages,and skunks may burrow under decks. While
uncontrolled pets are at risk from coyotes, foxes and raccoons, pets can also have negative impacts on wildlife.
Cats kill many birds and rodents,while dogs chase and harass wildlife such as deer. For the safety of both pets
and wildlife, dogs should be contained in appropriate enclosures and cats should remain in homes. Information,
brochures,and tips for co-existing with wildlife are available on the Colorado Division of Wildlife website at
www.wildlife.state.co.us.
Hunting has historically occurred in this area and hunting and firearms use is mentioned in Weld County's right to
farm ordinance. We would encourage that hunting and target practice should continue in this area.
Landscaping and plantings on the property should utilize plants that provide quality habitat for wildlife. Fencing
should be wildlife-friendly minimize risk and allow unrestricted movement by deer and other wildlife.
Black-tailed prairie dog colonies are found throughout Weld County. Prairie dogs found on sites to be developed
should either be moved to another location alive or humanely euthanized before onset of construction. A permit
from the Colorado Division of Wildlife is required prior to implementation of any trap/transplant effort.
Burrowing owl surveys are recommended if destruction or poisoning of prairie dog burrows will occur between
March 15 and October 31 of any year. Recommended Survey Protocol and Actions to Protect Nesting burrowing

Dear Ms. Martin:
Colorado Geological Survey has completed its site visit and review of the above-referenced application. I
understand the applicant proposes to amend the Highland Farms PUD Final Plat to change Outlot A from a
non-residential agricultural lot to a 20-acre estate residential lot,and to construct one single-family residence
and septic system. With this referral,I received a CD containing a PUD Final Plat Application, ability-to-
• serve letters from local utilities,road plans, and Highland Farms HOA Declaration of CC&Rs; a set of three
drawings by Integral Surveying: an Amended Final Plat(February 9, 2010),and Landscape and Utility Plans
(February 25, 2010); and a location map. No geologic or geotechnical information was submitted. The site is
not undermined. CGS does not have any objections to the proposed redesignation and development of
Highland Farms Outlot A. However, please note the following:
Potential geologic and geotechnical constraints. The site is underlain by eolian(wind-deposited)soils over
Laramie Formation bedrock. Eolian soils often exhibit collapse under loading and wetting, and the Laramie is
composed of potentially expansive shales and claystones interbedded with non-expansive sandstones,coal
beds and lignites. CGS recommends a site-specific geotechnical investigation to characterize subsurface
conditions and address potential development constraints such as expansive bedrock, expansive and collapsible
soils,and shallow groundwater/perched water conditions.
ISDS. According to the NRCS Soil Survey, the site is somewhat limited in its suitability for conventional
ISDS (septic tank absorption fields) due to low-permeability soils. An engineered septic systems may be
required.

Per our conversation today, CDOT is taking a"wait and see" approach with Greg Balmes' access permit. As we've
discussed, CDOT was not aware of the 2005 plat note stating that the access he permitted as residential was limited to
agricultural and oil accesses. Rather than revoke Access Permit#401001 at this time, CDOT will watch as Greg Balmes
goes through the county process. If that plat note is sucessfully removed in the county process, CDOT will consider
Access Permit#401001 to be in good standing. The residential house will be fully permitted.
Additionally, CDOT has request from the applicant written proof that all rights of access thru the Highland subdivision to
the eastern lot have been removed. This proof is forthcoming according to the applicant.
