WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 3rd day of January, 1979 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption No. 364 , being the property of Ms. Arvilla Sarchet, described as the East Half Northeast Quarter, Section 23 , Township 3 North, Range 66 West, of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : The East Half (E'4) of the Northeast Quarter (NE4) , except the West 10 acres of the Northeast Quarter of the Northeast Quarter (NE4NE} ) of Section 23, 7bwnship 3 North, Range 66 West of the 6th P.M. , Weld County, Colorado. Said described parcel of land is subject to any rights-of-way or other easements as recorded by instruments of record or as now existing on said described parcel of land. does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-lA (3) of the Weld County Subdivision Regulations . A copy of that letter of recommendation is included in the attached packet . Nothing has been received by our office that would change our recommendation of approval for this request as outlined in the letter dated September 18, 1978 to the Board. The condition for approval in the letter dated September 18, 1978 has been met . (i .e. , a zoning permit for a mobile home as a principle dwelling) . Because of my husband's death and due to the fact that we make our living from cattle and dry land farming I would like to sell this land for two reasons. Sarchet for a lot size variance. The property on which this request has been made is described as Part of the El of the NE* Section 23 , T3N, R66w. of the Gth P. M. , Weld County , Colorado. This property is located 411; miles east of the Town of Platteville. The property contains approximately 70 acres of Class IV and VI non-irrigated soil . The request is to obtain a variance from the minimum lot size requirement , Sec- tion 9-4 A. (6) , so that, she may make application to apply for a recorded exemption . If this lot size variance is granted, Mrs . Sarchet will proceed with her application for a recorded exemption to divide the property into two parcels. Mrs . Sarchet wishes to sell 10 acres more or less out of the northeast corLer of the property which will include an existing mobile home which Mrs . Sarchet ' s son lives in . The balance of the property which also has an existing residence on it will continue to be used as pasture. Based upon the information submitted and the adopted policies in the County , the Department of Planning Services Staff recommends this request be approved for the following reasons : 1 . The request is in compliance with the intent clause of the recorded exemption procedure (Section 9-2 , Weld County Sub- division Regulations) , the intent clause of the Agricultural Zone District (Section 3 . 3 A. of the Weld County Zoning Resolution ) , and the Weld County Comprehensive Plan in that each parcel does have an existing set of improvements located on it .
