I am sending this email as a "trial" as it is an effort to stream line our process. This request would otherwise need to be scheduled and heard in a work session or 9:00 a.m. BOCC hearing. If you find this process to be satisfactory we'll draft up a policy and begin to email you similar types of requests, with a follow-up resolution approving the extension on the Consent Agenda. It's my hope that this process will save time for the BOCC, staff, and the applicant. SUBJECT: Proposed Extension request to finalize conditions of approval and record the plat for USR-1709 (Site Specific Development Plan and Special Review Permit for an Oil and Gas Support and Service Facility (Crude Oil Truck Unloading Facility) in the A (Agricultural) Zone District) for Suncor Energy (U.S.A. ) Pipeline Company PURPOSE OF MEMO: To determine whether or not to grant an extension request (or hold a work session) to allow additional time for Suncor Energy (U.S.A. ) Pipeline Company to finalize conditions of approval and record the plat. 2010-1588 min, 7-/9-tort] CC,1: Ft �P P!Qef pi_4)oaq EXECUTIVE SUMMARY OF REQUEST: Suncor is requesting an extension until December 31, 2010 to finalize conditions and submit the plat for recording for USR-1709. This proposed facility will be located south of and adjacent to County Road 20 and approximately X mile east of Highway 85. USR-1709 was approved by the Board of County Commissioners on December 16, 2010. The approved resolution stipulated a 180 day time frame to finalize conditions of approval and submit the plat for recording. The applicant has submitted evidence indicating that several conditions of approval have been addressed. The most substantial condition of approval remaining is finalizing the improvements agreement for onsite and offsite improvements for this facility. STAFF RECOMMENDATION: Staff recommends that the extension request be granted. This proposed USR is for a new facility that has not been built, this property is not in zoning violation and granting this extension will not have any adverse impacts on the surrounding area. As you know, the project was originally approved by the Weld County Board of Commissioners on December 16, 2009 and since that time we have been diligently working on the numerous conditions of approval, many of which have been completed and forwarded to the Planning Department. In order to ensure that there is an adequate amount of time to complete the final conditions of approval, we are requesting the extension to December 31,2010. A final letter will be sent to you prior to that date, with all of the documentation and correspondence outlining how all of the conditions have been met and will include two paper copies of the final USR plat,with a final mylar to follow.
