HomeMy WebLinkAbout750447.tiff RESOLUTION WHEREAS, a public hearing was held on August 13 , 1975, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of John Gunson, Route 2, Box 161A, Brighton, Colorado, seeking a conditional use permit for the erection of a single family dwelling on the following described property, to-wit: All of the West Half of the West Half of the Northeast Quarter of Section 27, Township 1 North, Range 66 West of the 6th P. M, , Weld County, Colorado, more particularly described as follows: BEGINNING at the Northwest corner of said Northeast Quarter; thence along the North-South centerline of said Section South 0°39'17" East 2638. 09 feet to the center of said Section; thence along the East-West centerline of said Section South 89°17'39" East 661. 13 feet to the Southeast corner of said West Half; thence along the East line of said West Half North 0°36'23" West 2637. 85 feet to the Northeast corner of said West Half; thence along the North line of said Northeast Quarter North 89°17'33" West 660. 91 feet,more or less,to the point of BEGINNING, AND WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the location of the single family dwelling, and WHEREAS, the said requested location for the single family dwelling is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(d) of the Zoning Resolution of Weld County, said location for said single family dwelling may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of John Gunson, Route 2, Box 161A, Brighton, Colorado, for a conditional use permit to locate a single family dwelling on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department, 2. That said conditional use permit is subject to the County Engineer's review and recommendation of access of lot onto adjacent County Road No. 6 j 750447 3. That said conditional use permit herein granted is conditional only for a period of twelve (12) months from date hereof, on condition that petitioner proceed with due diligence to begin construction of said single family residence; otherwise, the Board may upon its own motion revoke the conditional use permit herein granted. 4. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. The Plan states that agri- culture is a resource in Weld County which must be protected from the impacts of urban growth. To accomplish this objective, the plan states that urban residential , commercial , and industrial uses will be encouraged to locate around existing urban centers so that their impacts will be minimized, and so that the cost of providing the services associated with such uses will be minimized to the greatest extent possible. In the pending proposal , the proposed use is not an agriculturally related use, but is an urban residential use proposed for a predominately agricultural area. The proposal sets forth no evidence that the use is related to intended agricultural uses of the land in question. The proposal would in fact, further encourage the break-up of viable blocks of agricultural land in the area in question. As this occurs, such actions tend to further encourage the continued breakdown of viable parcels in the area for urban uses. The land in question consists predominantly of Class III soils which would well support agricultural uses if urban encroachment on the land does not occur; 2) On December 16, 1976, the Board of County Commissioners approved an Agricultural Unit Development proposal , which lies directly to the north and west of the parcels in question. In this case, by resolution, the Board allowed an intensive agricultural activity to be established on parcels adjoining the property in question. The AUD thus established was for the purpose of utilizing the property for breeding of horses and cattle. If further division of properties surrounding this established use is allowed to occur, for the purpose of establishing basically urban uses, the only result can be the enhancement of conflicts between basically incompatible uses, i .e. , the traditional conflicts between urban and agricultural uses. The urban uses which are in fact encouraged through this application, are basically incompatible with uses already established in the area in question; 3) As such urban residential uses, as proposed in the pending application are allowed to occur, the cost of providing services to such rural areas can only be increased, thus resulting in overall increased costs to the taxpayer. As stated by the Weld County Comprehensive Plan, such uses should be encouraged to locate around existing urban centers, where the base for providing such services is already established; and 4) Finally, if such development is encouraged, more andrvre agricultural lands will be split into parcels which are basically too small to support viable farm operations, and too large to be maintained properly by those who work in the city but live in the country. All Planning Commission members are encouraged to attend. INTRODUCTIONS: Bette Kountz and Percy Hiatt, new Planning Commission members, were introduced to the other members. The Weld County Planning Commission held a regularly scheduled meeting on Tuesday, May 18, 1976, at 2:00 P.M. , in the County Commissioners meeting room, second floor, Public Health Building, Greeley, Colorado. Seconded by Harry Ashley. A unanimous vote of "aye" . Motion carried. Page 1273 maintain repair of access roads, water storage areas, and fire protection. Mr. Althen and Mr. Boyer shall maintain all these until such time as the final lot is sold. " Motion by Bill Elliott. Seconded by J. Ben Nix. A vote of aye by Elliott, Kountz, Heitman, Hiatt, Carlson, and Nix. Motion Carried. Development Plats for Lots 2 and 4: The Weld County Planning Com- mission staff recommends approval for the following reasons: 1 ) The proposed uses comply with rezoning PUD development standards; and 2) development standards are compatible as proposed with PUD standards. SUBJECT TO: 1 ) Development standard #1 for both lots (2 and 4) should read: "temporary outside storage shall be allowed only when screened to effectively enclose from view any outside storage; and 2) development limited to plans submitted. Buildings will be moved back 90 feet from road. A third "subject to" shall be to be in compliance with recommendations of the preliminary and final plat. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of the development plats for Lots 2 and 4 subject to Planning staff recommendations. Motion by Chuck Carlson. Seconded by Percy Hiatt. A vote of aye by Elliott, Kountz, Heitman, Carlson, Hiatt, and Nix. Motion carried. ANNOUNCEMENT: Mr. Elliott left at this time. APPLICANT: B. A. S'z Sec. 22 T3N R68W DISCUSSION: Mr. Rademacher explained that he plans to build a residence on 50 acres purchased for agricultural use. This is a split off a piece of land owned by Mr. Weingartner. The total acreage in the whole area is 90 acres. Approximately 26 acres can be farmed and the rest is grassland. The Weld County Planning staff recommends this be denied for the following reasons : 1 ) The proposal at hand is inconsistent with the Weld County Comprehensive Plan. As a result of the latter factor, additional conflicts with surrounding agricultural uses occur. Mr. Rademacher explained that he does not expect to make a living off this farm. He will hold another job. All of the area is irrigated. Eberl and Hurt property belonged to Mr. Weingartner at one time. Mr. Weingartner explained that at one time his farm was going to be subdivided. He appeared before the Planning Commission about three different times seeking approval to subdivide for a residential area. It was approved; but at the time, Mr. Weingartner thought it wasn't going to be, so he asked the developer to turn the property back over. Mr. Weingartner was then told that he could sell the acreage in 30 acre pieces. He sold the first piece in 60 acres. Next, he sold Eberl 30 acres. About three months later he received a violation notice for this. Is an existing house on the property. Rademachers would build another home, and tear down existing house. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners denial of this request for a single family residence. Motion by Chuck Carlson. Seconded by Bette Kountz.
