HomeMy WebLinkAbout20100041.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION REGARDING VIOLATION#0900311 AGAINST JOSE AND NADINE CASTRUITA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Jose and Nadine Castruita, ZCV #0900311, are allegedly in violation of the Weld County Code, and WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not been corrected, and WHEREAS, on the 12th day of January, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS,Jose Castruita, property tenant, and Nadine Castruita, property owner,were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. REMEDY During my last inspection, I noted that 1 (one) DERELICT VEHICLE remains situated outside of the newly installed SCREENED area. Therefore, in order to correct this violation and cancel the above referenced Violation Hearing, the Derelict Vehicle shall be removed, re-registered or placed behind the newly installed fencing. If this is completed prior to January 12th (my last inspection will probably be on the 11th), the above hearing will be cancelled and the violation case closed. RECOMMENDATION The Department of Planning Services staff recommends that this case be forwarded to the County Attorney's Office for immediate legal action.
